THEY GOT NOTHING

News item from late last week about how the FBI found a "completely constructed" LEGO model of the Capitol in the house of some Jan Sixer they busted, one of those nefarious Oathkeepers.

That's it. That's their evidence.

Reading the charging documents put out by the DOJ, they sound like some kid padding out his resume with impressive-sounding job titles. Like he pumped gas for a summer and claims experience as a "petroleum transfer engineer."

What's notable is what is not being charged. Nobody is being charged with 'sedition', 'insurrection', or 'treason' or anything like that. It's mostly trespassing, vandalism and some federal statute about "interfering with a government function", which I doubt anyone has ever been charged with ever before. I think the fed prosecutors had their clerks put in an all-nighter going page by page through the federal registry looking for some, *any* statute to charge them with.

For example, according to the graphic in this piece, one of the trespassers was charged with "Parading, Demonstrating, or Picketing in a Capitol Building." Seriously. Is there actually a federal statute about this or are they just making it up?

The feds are going to get laughed out of court. I hope. It assumes the defendants have competent legal counsel, and I'm not sure this is the case. These are normal Americans who may not be able to afford the high-dollar attorneys with the expertise in handing federal cases.

Of course, I doubt the Biden administration cares about whether they get convictions, rather, the process is the punishment, as they say. This is is just "how dare those rubes defy us?" revenge theater from the DOJ who took the opportunity to punish some Americans who don't think the election was fairly decided and who had the temerity to say so publicly.

Oh, and then it came out that no, the Oathkeeper's LEGO set was not "completely constructed", but most of it was still in the box. So the FBI lied about that, too. Is there anything about 1/6 that they *aren't* lying about?

Well, no.

A reminder - there were morons there that day. None that I know of went into the Capitol building. But at least one was on the West side and was hit by tear gas by the Capitol Police. The Capitol Police claimed that they did not employ tear gas that day.

Sicknick's cause of death was known on January 7, the day he died. There is still someone charged with assaulting him even though he wasn't actually assaulted.

This is why prosecutors in places like NYC, Seattle, Portland, California, etc, fast-tracked catch and release of BLM protests, to minimize secondary and tertiary harm incurred for arrest. Then they drop prosecution so that no costs be incurred by the alleged offender.

Prosecutorial discretion is the end of the American legal system.

127 There's an LI article about one of the 1/6 protesters who just had his appeal denied (for the denial of bail).

The guy is a kind of a racist jerk, but he didn't do anything that justifies keeping him locked up, in 23-hour a day isolation, for six months and counting. He attended the Trump rally, wearing a business suit, unarmed. He walked down to the Capitol, entered through doors that were already open, and then left after he heard that there had been gunfire in the building.

He went home, and later told a friend he had been in the Capitol and showed him some video he had taken on his phone. His "friend" reported him and he was arrested and charged with trespassing and disorderly conduct.

He applied for bail, but was denied. He appealed the denial. The appeals court ruled against him. Remember that pre-trial bail is supposed to be granted to all but the most serious and dangerous offenders.

The reason the appellate court affirmed the denial of bail was because the guy, when he was 20, had been in a car with some other kids, one of whom (not him) had shot a potato gun filled with frozen corn at the house of another kid, in a dispute over a bike.

Heh, I once picked up $500, a free ticket within the US from the airline and a rescheduled later flight for giving up my seat on a connecting flight out of Sky Harbor. They had to radically reduce the aircraft take-off weight because of the heat.

174 I worked in a closed-loop wind tunnel for a while. Not a huge test section, around 10'x8'. A small conventional low-speed tunnel.

But you take the same air and keep on dicing it up, blasting it past the same walls over and over again and it gets hot. Most of the energy you're putting into the system just gets converted into heat. In between runs we'd spin down, open the doors and do model changes. it was 150-200 degrees in there. Like walking around in a convection oven.

That's what I carry around in my head as an upper marker for hot.

Wasn't apologizing for him. Just trying to give some context to why the court rationalized this obviously unjust decision to deny him bail. In the stupid prior incident with the potato gun, the gun had had the words "WHITE IS RIGHT" and a Confederate flag on it, and this guy had a bunch of anti-Semitic YouTube videos downloaded on his phone. He'd also apparently made posts online where he had made anti-Semitic and racist and sexist comments.

It's not against the law to be a racist or anti-Semitic jerk. But the court piggy-backed those sentiments onto the fact that he'd made statements about civil war and revolution and had repeated the Thomas Jefferson quote about periodically needing to refresh the tree of liberty, and used that to depict him as a guy so dangerous that they couldn't risk releasing him before trial. It was obviously bullshit.
