The Left's Deeply Dishonest Response To A Rational Judicial Decision: A Perfect Example Of Emotions Trumping Facts

The insanity of the byzantine "Assault Weapons" laws in the various blue states has to be seen to be believed. For instance, in the People's Republic of New Jersey, any muzzle device must be pinned and welded to the barrel, and cannot be a flash suppressor but can be a compensator. Adjustable stocks? Hah! And bayonet mounts are bad too, presumably because there have been far too many bayonet attacks, and if it saves just one life...

And California may be even more insane. But a rational judge heard a lawsuit against the nuttiness, and agreed that it is laughably counter to the 2nd Amendment and other precedents.

California's Assault Weapons Ban Violates Second Amendment: Judge

“The Heller test asks: is a modern rifle commonly owned by law-abiding citizens for a lawful purpose? For the AR-15 type rifle the answer is ‘yes.’ The overwhelming majority of citizens who own and keep the popular AR-15 rifle and its many variants do so for lawful purposes, including self-defense at home. Under Heller, that is all that is needed. Using the easy to understand Heller test, it is obvious that the California assault weapon ban is unconstitutional. Under the Heller test, judicial review can end right here,” Benitez wrote.
That makes sense. it is a rational critique of California's law, and is amply supported in the judge's 94 page ruling.

But in the introduction to the ruling -- in fact the first sentence -- the judge equates the AR-15 with another popular tool.

Like the Swiss Army Knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment.
And in the absence of any substantive challenge to the judge's holding, the ranting fascists who currently hold sway in California latched onto that throwaway line to insert an emotional tag to their attacks.

“Overturning CA’s assault weapon ban and comparing an AR-15 to a SWISS ARMY KNIFE is a disgusting slap in the face to those who have lost loved ones to gun violence,” California Gov. Gavin Newsom, a Democrat, said late Friday. “This is a direct threat to public safety and innocent Californians. We won’t stand for it.”

“Today’s decision is fundamentally flawed, and we will be appealing it. There is no sound basis in law, fact, or common sense for equating assault rifles with swiss army knives,” Bonta added.

Never mind that the judge wasn't making a legal point, or even anything more than a comparison of two popular things. It has no force of law, has no influence on the legal arguments, has nothing whatsoever to do with the following 94 pages of legal discussion, but there is the hyper-emotional hook to get the soccer moms exercised!

It is deeply dishonest, but one of the important tools in the socialist kit. Find something that, taken out of context, seems odd or discordant. Then hammer the trivial point home, conflating the unimportant with the substantive.

This is what they are best at; obfuscating the real issues and inflating nonsense to ridiculous importance. Just look at the other hot-button issues of the day, and you will see similar tactics. Trans (fake) women should be allowed to compete with real women? Why? For their own mental health? But that has nothing to do with fairness in competition. Voter ID is the Devil! Why? Because blacks can't get IDs? That's arrant nonsense, but they couch it in vague terms and latch onto ancillary points to buttress that deeply offensive argument.

Never mind that their arguments make no sense. It is the emotional aspect that is important. And it works.

18 My favorite part of that ruling, even better than the Swiss Army Knife analogy? The judge *repeatedly* refused to use the terminology "assault rifle" in his ruling. Referred to them numerous times as "modern rifles". Judge was of Cuban extraction. No more better lover of freedom, than someone who knows real tyranny.
I hope this ruling stands up to appeal.

54 I scanned the decision when I saw the first article on it yesterday. (Yes, only scanned. It is 94 freaking pages!)

The judge really does a comprehensive takedown of California's defense of the law, addressing everything from the facts they entered in support of the law (non-existent), their expert witnesses (clueless to blatantly incompetent), actual facts regarding the AR-15 (it is not a machine gun), the various standards of review (the law fails on all of them), and everything in between.

It will be "interesting" to see California try to appeal this.

Besides death, the tool on the right, the ubiquitous Estwing Hammer, causes Tennis Elbow because of the harmonics when you strike another object with it. If you don't want the "Elbow", use a hammer with a wooden handle. Straight grained Hickory is best.

78 It's a side issue, but I still don't get the "ban" thing. With all the idiotic, pointless, and unconstitutional restrictions, one can own an AR-15 in CA. And buy and sell such. There is no "ban".

But what is important is how the "judiciary" reacts to this. It's a direct confrontation of the internal lawlessness - repudiating Heller - that's gone on in the inferior courts for many years now.

Will SCOTUS finally address the historically unprecedented insurrection and anarchy within its own "system"? Country is so dumbed down and hollowed out now, one cannot have much confidence.

Every man between 18 and 55 is required to own a semi-automatic rifle chambered in 5.56, with detachable magazine, 300 rounds of ammunition, and a first-aid kit containing gauze, clotting agents, and a tourniquet. Once every three years you have to demonstrate competence with your weapon by hitting a 12 inch target at 100 yards 15 times out of 20, walking a mile, and receiving a refresher on first aid. Conscientious objectors may forego the weapon and replace it with a larger first aid kit and more training in assisting emergency personnel.

Every young man at age 17 goes through "militia training" in high school, consisting of marksmanship, area search techniques, personal and vehicle searches, checkpoint operations, first aid, and specialized local training. For example, in areas with lots of flooding you might receive training in building levees. All this is overseen by the county sheriff.

97 Yesterday I cleared a horrible jam in my 1911 with a brass rod, using the bottom of a Wilson mag as the "hammer". Not ideal. Have a small toolkit in range bag, does not include a hammer.

Have never had such a jam before. Lead SWC bullet, nose-down into the ramp. Stuck there like an m-effer - even great force doing all the conventional things would not move it. Gonna examine that mag today.

Rest of match proceeded normally - well, my shooting was horrific, but haven't shot that gun in a while, and was not focusing well. But no more jams.

A Shingle Hammer. Used when roofing material was often wood shakes, mostly Cedar. Used for splitting the shakes.

Also there's the Drywall Hammer, which usually had a square striking surface and the axe blade side was used to pry drywall over or to shave oversized boards.

Were you using it right? I have used one many times, and you get the hook under the lip on the can, and lever up on the knife handle to force the cutter through the top of the can. The applied force naturally tend to keep the blade from folding.

It's actually a pretty effective can opener.

That being said, I have used the scissors on my knife to cut aluminum flashing and used the saw to cut 1x2 pieces of wood for survey stakes when I forgot to bring a saw. Used the knife blade to sharpen the stakes.

I enlisted at the end of the draft era for Vietnam. The drill Sergeants in boot camp gave extra rations of hell to the draftees because they were the guys who deferments finally ran out.

True, but society needs the winnowing and curing process that the draft provides. I would like to see some States try a STATE draft directly into 2y hitches in the State Guard with lots of exemptions for school, work, etc.

It would serve several purposes - 1) Motivate the shiftless and undecided 18yos, 2) help those that do get called to move on in life, and 3) chase the true weasels out of State.

Why? because then our military is not a mercenary force. Mercenary forces throughout history have a very bad reputation.

Think how much they've gotten away with now since they are an all volunteer force. Don't like what they do? Fine. Leave.

I think the worst thing was our military being an all volunteer force. Sure it looks good so far but the prospects are not good. One Commander in Chief with a propensity for tyranny and it's all over.

Had a buddy that was the personnel office on the Carl Vinson. They almost had to miss a deployment because so many women in engineering got pregnant at the same time and had to be sent back. They flew a COD off one day that had over a dozen pregnant female Nukes on it and the ship's paper ran a cartoon the next day with a picture of the plane being catapulted with a "baby on board" sign on the back. YES. Former Infantry Marine here, and they last our NCOs need to is to have their time wasted babysitting malcontents who don't want to be there. I think Marines are more hardass about this because our Corporals are given much more responsibility than other branches (no offense to Navy intended...)

And "NCOs are the backbone of the Marine Corps". Mess with that and everything falls apart and we're no better than... Army

In theory a draft is equitable and makes sure that a good cross representation of society is what makes up the force. Those planes were truly devastating doing anti-shipping work in the Bismarcks and along the New Guinea coast. The hulls and upperworks of barges and most freighters were like cardboard for .50 caliber bullets. The upperworks of Japanese destroyers (and everyone else's) were one-quarter-inch steel, or less - not very good against .50 bullets, especially concentrated .50 fire.

Someone on Ike's staff realized that the Allies in Normandy would need x,000 tons of supplies per day, and until Cherbourg was captured, there would be no way to get that kind of supplies to the armies. Someone decided that 2 of them would be a good idea (thankfully, as one was destroyed by a storm a few days after the landing), but not 3, not 4. Then someone designed it, someone found a way to build it, someone let the contracts and got them deployed to the embarkation ports in southwest England, tugs were assigned and units were designated to construct them. And so on.
It's said that D-Day was the largest undertaking ever organized in human history. I believe it.
