No it wasn't. The actual bill was passed while they still had 60 votes in the Senate on Christmas eve. The "fix" which supposedly eliminated financing abortions (for the so-called blue dogs) and giving the unions a break on the taxes on Cadillac plans was done with reconciliation.

Then the house passed a DIFFERENT bill. It had to be different, as the Senate's bill was unworkable.

That is the nub. The Commerce Clause needs to be completely amended so that such a ridiculous interpretation can never again even be suggested. That still leaves the problem of this authorization to do anything by way of calling it a tax. I'm not sure how we solve that problem.

Requires doctors who treat Medicare patients be reimbursed at the full rate

Sets up a medicare tax on the unearned incomes of families that earn more than $250,000 annually.

Offer more generous subsidies to lower income groups. Households below 150% of the federal poverty level would pay 2% to 4% of their income on premiums. Health plans would cover 94% of the cost of benefits.[18] Households with incomes from 150% to 400% of the federal poverty level ($88,200 for a family of four) would pay on a sliding scale from 4% to 9.8% of their income on premiums, rest will be covered by government advanceable, refundable tax credit. Health plans would cover 70% of the cost of the benefits.[18][19]

In 2014, if a company with more than 50 workers does not offer coverage, they will be obligated to pay $2,000 for each full time worker in the company, exempting the money due for the first 30 employees. For example, an employer with 53 workers will pay the penalty for 23 workers, or $46,000.[18]

Would increase Medicaid payment rates to primary care doctors to match Medicare payment rates, which are higher, in 2013 and 2014.[18]

The federal government would pay all of the costs of expanding Medicaid under the reform until 2016, 95% in 2017, 94% in 2018, 93% in 2019, and 90% thereafter. Some states that already insure childless adults under Medicaid would receive more federal money for covering that group through 2018.

The Medicare patients will receive 50% discount on brand-name drugs would begin in 2011. By 2020, the government would pay to provide up to 75% discount on brand-name and generic drugs, eventually closing the coverage gap.[18]

Would extend the ban on lifetime limits and rescission of coverage to all existing health plans within six months after signing into Law.[

If this is a tax, then those waivers are not worth the paper they were written on.

It wouldmean that the Executivecould GRANT Bills of Attainder, which are expressly forbiddenby the Constitution for Congress to pass.
So Obama's waivers are shit. I wonder how that will play out?

The SCOTUS just stabbed Obama in the back on that one. Savor that little victory.

210 Are you sure this is as bad as you're making it sound? Roberts has forced the "victors" to define it as a tax. First, he has established a limit on the power of Congress via the Commerce Clause. Second, he has forced Congress to come out from behind its sanctimonious prattle about "affordable health care" and raise taxes in order to fund it. In other words, he has outed Obama. (Not that there's anything wrong with that!)

226 Roberts undoubtedly knew it was going to be upheld 5-4 in the initial vote of justices after oral argument. By switching sides, he assured that HE would write the opinion, not someone in the liberal group (Kennedy included). It also permitted him to narrowly uphold the law on tax grounds, as others have noted.

The anger on the right should be directed at Kennedy, and those Republican senators who voted to confirm Sotomayor and Kagan.

229 Here's a fundamental difference between the right and the left. To the left, courts decide if something is constitutional or not. The court ruled for them, so its constitutional.

To the right, something is constitutional on its own merits, reason, and based on the founding fathers' writings and thoughts on the matter. How the court rules is irrelevant: if they rule differently than the constitution states, they're just wrong. If they rule properly, they're right. They don't decide constitutionality, only how the government perceives it.
