Ron DeathSantis: I'll Sign a Blanket Clemency For Anyone Being Charged with Mask-Crimes by Local Karen Governments

Quick point, first of all: I'm going to join the leftist lunatics in calling him "DeathSantis" because I like to think of him as murdering them and killing their dreams.

Second point: Some might analogize the state government-local government relationship to the federal government-state government relationship, and think that there is some kind of "federalism" problem here, with the state overriding local government.

There's not. The Constitution creates a federal scheme in which the federal government has some powers, and the rest belong to the states.

There is no such competition of sovereigns between state government and local government. All powers that a state has are entrusted to the state government. The only reason local governments have power is because the state government has voluntarily devolved some of it power to them.

And it could take that away if it wanted.

DeathSantis says he will use his own power to simply grant pardons to anyone being hassled over mask mandates and other lockdown violations, because fuck those Karens.

Florida business owners Mike and Jillian Carnevale joined "The Ingraham Angle" Wednesday after being arrested multiple times for not enforcing a mask mandate. Gov. Ron DeSantis also joined the show to grant the couple clemency.

RON DESANTIS: It's a total overreach, Laura. This is exactly what we ordered against last summer many, many months ago, and so I was actually just recently briefed on this case, and we looked at it and so I'm glad you have Mike and Jillian on, and I'm also glad to be on to be able to say that effective tomorrow morning, I'm going to sign a reprieve under my constitutional authority. So that will delay the case for 60 days against both of them, and then when our clemency board meets in the coming weeks, we'll issue pardons not only for Mike and Jillian, but for any Floridian that may have outstanding infractions for things like masks and social distancing.

...

The fact is it's not even right to be wearing masks when you're exercising. The World Health Organization advises against it. It's not healthy for people to be doing that in the first place, so it was a bad restriction, but these things with health should be advisory, they should not be punitive, and so we are happy to use our constitutional authority. I think they've been treated poorly and fortunately, they got a governor that cares.

This is the man.

Lived in Florida for 4 years. Many nice places to live. Not Jacksonville. Pcola is problematic due to garbage people bleed in from Alabama. The central horse farm area gives easy access to either coast and nice beaches, Orlando (shudder, although has some fun stuff), and a reasonable drive to the lower Keys.

It would have been a better timed announcement when he reopened Florida...at that point, he said everything was recommendation, not requirement...

So, he get's a single for this announcement (if only b/c he will push other govs the right way), but not a home run.

Still love him for the ticket in 2024, but he's gotta keep earning it.

No argument from me, that's for sure. Other than Donald Trump, DeSantis is the only one. Can we all do a collective shudder had that naked man found passed out in a pool of his own, and another's, body fluids become governor? We'd have exactly one: Trump. I am very impressed with DeSantis. He's making all other R governors look pretty pitiful by comparison.

Just because I happen to be in favor of his judgment here doesn't mean I support it being imposed in this manner.

122 My guess is that far too many of GOP officials became reliant of corporate and fatcat donors who DO NOT reflect the base but rather the influence peddling wing of campaign consultants, policy consultants, communications consultants, etc. They peddle pablum because their salary comes from those corporate and fatcat donors. In other words, it is a lot like Conservative Media TM as an institution or conservative think tanks--they are essentially puppets that speak whatever their puppetmaster who pays them wants.

The few outspoken members generally rely on small donations and individuals and have their own fundraising inhouse rather than relying on the GOPe collective candidate management systems (campaign, communications, and financial services consultants). Dems are the same way btw which is why the New Turks sought to outflank the Dem establishment. The only difference is that GOPe are open in their disparagement of the base while Dem establishment mouth support their base publicly but try to knife people representing the base in private. See Yang and his recent 24 hr mea culpa expressing support for Israel for an example.

164 102 CRT, federalism is an intervening layer of semi sovereign states below the national government.

What you are expressing is subsidiarity. That means that almost all decisions should be made at the lowest level possible.

Effectively, the Tenth Amendment rules out subsidiarity as local government have no reserved powers or even status under the Constitution and its amendments with the sole exception of DC and territories which are ultimately responsible to the national government directly.

Losing on a principled basis like federalism is just useless. Like stare decisis, it is a one-way ratchet that ensures you can never get your way politically but somehow never limits your opponents in any way.

246 139 Axeman and Rock,

The whole incorporation debate is not meaningful as Scotus more or less used that doctrine (illegitimately in my opinion due to stare decisis), to arbitrarily pick and choose which of the Bill of Rights applies to the states. Under the original conception, in the Constitution, it protects the privileges and immunities of US citizenry from states and this was repeated in the 14th Amendment but eviscerated in the Slaughterhouse Case.

The original Bill of Rights was aimed to prevent the federal government from overwhelming the states and subjugating its citizens. The failed confederacy gave Congress the impetus to reiterate that states were bound by the national Bill of Rights as privileges and immunities as defined by the Bill of Rights and common law (right to travel for example which comes from the Magna Carta) to overturn both Dred Scott and Barron v. Baltimore decisions by Scotus. Later, when deprivation of rights by states became obvious, Scotus declined to overturn Slaughterhouse but instead used the due process clause to first protect property from states and then other rights ad hoc.

The problem with Biden is that he's the perfect Sin Eater for the Left. He's sundowning at a record pace, so he has no idea that he's going down in history as the one guy (I can't bring myself to write 'president') in the last century that will be worse than Carter. Harris, if it gets to that point, may have enough pride (if not the smarts) to not let it get quite so bad, as she'd have to live with the results - at least I hope so. A faceless series of bureaucrats behind Biden don't care if they run the country into a ditch, because the FICUS is the face of the decline.

318 In a striking move to send the country back toward pre-pandemic life, the Centers for Disease Control and Prevention on Thursday eased indoor mask-wearing guidance for fully vaccinated people, allowing them to safely stop wearing masks inside in most places.

The new guidance still calls for wearing masks in crowded indoor settings like buses, planes, hospitals, prisons and homeless shelters, but will help clear the way for reopening workplaces, schools, and other venues -- even removing the need for masks or social distancing for those who are fully vaccinated.

The CDC will also no longer recommend that fully vaccinated people wear masks outdoors in crowds. The announcement comes as the CDC and the Biden administration have faced pressure to ease restrictions on fully vaccinated people -- people who are two weeks past their last required COVID-19 vaccine dose -- in part to highlight the benefits of getting the shot.

Specifically, Marbury has the court opinion recognizing that Marbury has been injured and that the writ of mandamus was the proper remedy for his injury. However, the court held that Scotus did not have jurisdiction to hear the case because the law granting that jurisdiction (Judiciary Act of 1789, Section 13) unconstitutionally extended the court's original jurisdiction which is cast in stone by the language in Article III, Section 2.

It's frickin better than the vaccine, precisely because of the "variants" (your immune system got the whole shebang to recognize, as opposed to a particular spike that may or may not mutate).

And the BS story about "we don't know how long antibodies will last" is a frickin side show. Studies have already shown robust memory cell response. QED it is expected antibody rates will diminish but long term ability to ramp up antibodies in the face of new exposure will likely last years.

No, Pelosi doesn't become VP. She would be next in line for the presidency should something happen to Harris, but, most likely, Harris would nominate someone to be VP that Congress would vote on.

If that were to happen, the nominee would be some old Democrat with no ambitions towards the presidency, like a former governor of Montana or something. Someone inoffensive enough to sail through the voting process.

You can't lump in the Covid infected/recovered with the "non vaccinated." Should by any standard be considered at least (and probably more immune than vaccinateds)

But more imporantly, the moral hazard of someone "getting infected" or someone "passing on" a virus unwittingly should not be entirely on the "vulnerable." That is, if you are "vulnerable" (old, sick, fat, unlucky, whatever) and get the virus now, it's your own damn issue because you had every opportunity to be vaccinated. "154 million vaccinated - The number of people who have received at least one dose of the vaccine,
covering 55.0% of the eligible population, 12 and older
and 46.4% of the total population."

Before the change to 12 and older, we were at 58% of the population with their 1st shot, and about 43% fully vaccinated.

Biden winning did help to ensure that we would have a shot at vaccine herd immunity, b/c the left was never gonna vaccinate with a "Trump" vaccine. Now, we've had both sides willing to vaccinate for the common good, and that has gotten us to a good level, with all future vaccinations only helping further.

Having had the virus, I also have had a strong T-Cell response. The T-cells live in your lymph nodes and bone marrow for a long time. Maybe for the rest of your life. If you get another corona virus attack, the T-cells will attack the virus first, and stimulate new anti-body production.
The vaccines make your body recognize the spiked protein coat of the virus and create antibodies, but do not generate a strong (or any, debatable) T-cell response.
The viral response from being infected also generates T-cells and antibodies that attack the nucleocapsid part of the virus, the actual viral RNA which is injected into cells to infect them.

436 Rockets from Lebanon = potentially huge deal.

However, from first report, these are small/short-range rockets and probably from Paleostinian Islamic Jihad in Lebanon, not Hezbollah. Which makes a big difference, at least as to how ominous it would be.

Hezbollah/Lebanon rocket threat THE biggest issue for Israel. If that starts, it'll be a real war.

The viral response from being infected also generates T-cells and antibodies that attack the nucleocapsid part of the virus, the actual viral RNA which is injected into cells to infect them.

505 National Lampoon ran a hilarious comic book parody

This was just after Agnew resigned. The Commerce Secretary was giving
advice to Nixon to stonewall the courts (expecting he'd be forced to
resign), and to nominate Kissinger as Sec State - foreign-born so not
eligible. Sec Commerce had a plan to get the Speaker and all the others
out of the way. Pretty funny.

507 I'm going to cherry pick this from the previous post, since it's on topic:

"But Fauci lies a lot. Remember when masks provided no benefit to people? Remember he then admitted he lied about that so that grubby civilians wouldn't buy up masks?"

He wasn't lying - they don't, generally - and preventing a run on masks was actually the right call; it's why PDT took that position as well. They're lying NOW, in pushing for them and in claiming the previous position was a lie - first, to create precisely the PPE shortages that responsible parties sought to avoid, and secondly because it became politically advantageous to raise the policy as a lightning rod and hijab-like mcguffin.

Their lies are a layer or two deeper than you give them credit for, and all the more effective for it. See also: CDC's constant stream of contradictory bullshit.

And here is something a lot of you are not going to want to hear: the GOP is quite happy to use the mask issue to pander to their base while glossing over their near-complete, and deliberate, uselessness on more important issues like forced closures and lockdowns. Did you really think these people changed their spots overnight? Seriously?

You're not going to hear this from the MSM, but it's common knowledge in institutions with populations hard hit (read: nursing and retirement facilities) -

Natural immunity conferred by catching COVID lasts as little as 3 months. This does not mean we can't reach herd immunity, it just means the goalposts for doing so are configured a bit differently than, say, something like chicken pox.

But the important takeaway is that the vaccines aren't really all that much better - mostly pissing into the wind. The discovery that the virus's blood clotting mechanism stems from the same spike proteins they're using for vaccination makes recurring seasonal shots insane.

During FDR's decline, the WH chief of staff, Jimmy Byrnes and Adm Leahy basically ran the US presidency. Leahy took the foreign policy and military lead and Byrnes took the domestic policy lead until ten days before FDR died.

560 I think what people commonly don't get about COVID and the topic of vaccinations is that it's directly comparable to the Europeans exposing North and South Americans to strains of the common cold/flu.

Vaccines for those range from not reliable (flu) to useless (colds, so far - note that some cold strains are in the coronavirus family), and people catch them a ton *now* without keeling over. Two things happen with a new population being exposed: those susceptible get their shit pushed in with a few big waves, and the new virus boomerangs around a while until it hits an equilibrium in terms of new strains appearing and natural immunity fading.

That's exactly what's happening now, regardless of what any government is trying to do about it. We're going to drop to a lower level of cases that are maintained by parts of the population rotating in and out of (temporary) natural immunity, punctuated by occasional mutations.

564 Have you read Amy Thompson's The Color of Distance? I really like the alien's political system. A lot. We should try that one here.
Nacly Dog,

I will have to look that one up. Thanks. In my opinion, there is no perfect system and for a system to persist, a political system must fit with the ideas of the people and culture for who it is intended. In our case, the problem was not so much the Constitution but that the people and culture of the US changed as to be opposed to many of the core tenets of the Constitution.

How and why that occurred would take a massive study but my take is large scale war, industrialization, the rise of massive national media giants, and the urbanization of America created the situation where legislators became separated from the body of people from which they came, bureaucrats due to Civil Service and tenure became untouchable, and post WWII America extended its corporations and military world wide.

The American people accepted all of this because they became fabulously wealthy by world standards and as John Fogerty put it, Five Year Plans and New Deals, wrapped in Golden Chains, meant signing over governance to elites who became corrupt.

565 So sure, let Raimondo live. Maybe he was in the bathroom when the event happened.

Designated Survivor would have been a much better show if Kiefer Sullivan's character had been an imbecile blog troll stepping into the presidency instead of someone who actually had a [lefty] brain.

Actually, now that I think of it, that's what Biden is: Raimondo.

Kamala Harris played by Maggie Q?

566 Here in Daytona Beach, which is Ron's old congressional district CD-6, we know he's always been like this .. a no-bullshit man who left the House of BS after 3 terms. Trump met him, saw what he needed to see, endorsed him for governor in 2018.

DeSantis barely (33k votes out +8 million cast) won over grifter/drug addict/man-whore Andrew Gillum, a near death experience for Florida. His 2022 reelection is the key for all patriots in 2024.

567 They're vaccinated. What do they care? They 'can't get sick' now, right? Isn't that how vaccines are supposed to work?

When a society loses its values and morality, the number of Sadists increase. People inherently enjoy hurting other people, and now with society urging sadistic behavior those who once had a veneer of civility have chosen fleeing vanity over humanity.

Its Lord of the Flies now

Amen to that. What a disappointment.

570 DeSantis is on one hell of a roll right now. Guy hasn't missed a beat and is enraging all the right people. God be with him.

571 Bingo! I'm glad someone finally got the state/local relationship right. States are sovereign.

Local government units are not, and can be established or dissolved at the pleasure of the legislature. See Dillon Rule for further details:
