The ONT Hath Murdered Sleep

Heidely-Ho, Moroninos! Say, did you know that Dolly Parton and Edgar Allen Poe share a birthday?

Dolly Poe.jpg

Oh, Canada. Oh, No, No, No

Canada distress.jpg

Jesse Kelly said the other day, just a year ago Justin Trudeau was your average, not-too-bright, run-of-the-mill, coexist liberal. Now Canada is getting it's police state on. As Jesse said, it happens fast. Then there's this:

Go to Canada's official website, Canada.ca.
Select English, scroll down and click on “About government”. Then click on “Treaties, laws and regulations”, then on the next page click on “Canadian Charter of Rights and Freedoms”.

Huh.

It's gone. It's been that way for about a week, which seems too long for it to be a simple website coding mistake. I mean, it may be, but if it's not......Is Canada trying to scrub their version of the Bill of Rights from the internet?

Organ Donor

Orlando motorcyclist run over, killed after performing stunt on I-95

My wife and I call people like this “organ donors”. Last year I was driving home on I-70 when 3 guys on rice rockets went screaming past me doing at least 125 per. They passed between my car and the car in the next lane, cut over into the right breakdown lane to pass a truck in front of me, and then shot back across 4 lanes of traffic. I was talking on the phone to my wife when this happened, and she asked “What was that?” “Bunch of organ donors just went by”. She knew exactly what I meant.

How To Make Alexthechick Stroke Out

Police seize $39,500 from man at Sky Harbor who was attempting to buy a truck for his business

He's broken no laws, is accused of no crime, and yet the police still won't give him his money back. I mentioned AtC in the heading, but she's not alone. CAF is a blight on this “free” country. Stories like this make me stroke out too. And yes, I realize that our current version was enacted under the Reagan administration. It's still unconstitutional. Reagan was a good president. He wasn't perfect, he made mistakes. This and letting Tip O'Neil roll him on immigration and spending are three of his biggest.

88 They (banks)don't care about withdrawals so much. They know where that came from. They might ask what you're going to do with it.

It's cash deposits that invite scrutiny. Where did this come from? Even that is "know your customer". A grocery store owner is going to deposit lots of cash. They won't bat an eyelash. It isn't illegal to use cash.

"Legal Tender" just means they have to take it for debts. Like taxes. If you owe somebody money, they have to take it. But a business or seller doesn't. Because a debt hasn't been incurred yet. They can refuse cash, refuse credit cards, require cash and refuse credit, whatever. "Wampum Only."

Is Canada trying to scrub their version of the Bill of Rights from the internet?

___________

Look up "Notwithstanding Clause" sometime.

In Europe, your rights are a gift of the government, which makes it clear they can be taken away any time.

In the Anglo countries, your rights are yours until the government decides to take them away.

In theory, in the US your rights are yours and can't be taken away. But that's changed in the last year and is going to change more in the future.

Oh, I can think of two more. Not bombing Iran for taking our hostages, and not bombing the home base of the people responsible for the Marine bombing in Beirut. Both of those inactions set the table to where we were in the Middle East, before Trump's Abraham Accords.

Sometimes, and some get paid out of the backpay if awarded. You are going to want to research one very carefully as some do little more than file the exact same paperwork you can do on your own in terms of trying to "win" the case.

The last time we talked to an SSDI attorney was four years ago, after he got out of the military, and he told us that Pooky had done the wrong thing by working immediately after his discharge. But we had almost no money thanks to the AF screwing us over and we needed food on the table, so yeah, Pooky did the "wrong thing" by getting a job.

Aside from mean drunks (are there mean ope users?), drunk drivers, and all the other stupid sh!t people do because they're stinkin' drunk, there's cirrhosis and all kinds of other health problems. But it would be even worse if alcohol (your favorite drug) were illegal like opes are. That's right, probably the predominant effect of making any popular drug illegal is to make the situation worse in every way. Besides, do you want how you live your life determined by standards applicable to people you consider losers?

I know one or two people who were approved first time, but it was one of those Mack Truck level of documentation of disability things. And not everyone has to spend money, nor does spending money necessarily improve your chances. Some disability specialists take bulk cases and don't put in much effort figuring they they can collect of the ones that do win and they can spend their time on other things.

I like some of those, I have a huge Invicta aviator watch with some of the dials made out to look like flight instruments. And some extremely thin Skagen titanium watches. Those all have large dials with good contrast. But if I wear my crappy multifocal contacts instead of glasses I can't even read those well. I like simple classic styles I can switch out day-to-day.

But it has to be functional I'm not into wearing jewelry. So if I can't see my watches anymore then what's the use.

276 We filed for SSI for our mentally impaired son when he was around 21. Filled everything out, sent it in. Denied. Got an appeal date. Took him to the appeal. The SS caseworker assigned to us took one look at him, rolled her eyes and filled out additional paperwork and it was granted. I guess they just wanted to be sure he's disabled but the documentation, you know, from birth, just wasn't convincing.

This reminds me of a sad story. Met a lady who had an adult son in a group home. Company running said group home found out she had not filed for guardianship of her son, so they did. She was then having to fight them in the legal system to get guardianship so that she could even see her son again. Never did hear the outcome on that one.

Lesson learned, file first.

283 Darrell in July 1987 we pretty much eliminated the Iranian surface navy, such as it was, at least most of its major combatants - if that makes you feel better. Part of our smart and effective strategy to deny Iran the option of "horizontal escalation" of their stalemated war with Iraq. Tehran wanted to take the fight to Iraq's Gulf Arab backers, who also happened to be part of our explicit/de facto protectorate for strategic reasons (oil).

Nope. Reflagged the Kuwaiti tankers (first component). Eventually Iran got desperate enough that they pretended to want a direct fight, and then stumbled into one (not sure if anyone knows whether Iranian ship that fired on US aircraft was authorized to do so). Bad move. We proceeded to take out many of their units.

Anyway, our strategery was successful.

Yes, I read some time ago that they pretty much deny all claims at first and pretty much accept all claims on appeal.
I remember Rush Limbaugh talking about this when Bill Clinton was president, that Social Security started accepting most anyone on appeal, in order to shift welfare money going through the federal bureaucracy so it would be permanent, since welfare was then being considered for cuts.

One contrast - the heads of the various religious sects are there in a row. Camera mostly shows the Orthodox one ("primate"?), but also an Orthodox Jew, and a few others including a guy in a colorful wild get-up I can't ID. Don't think it's any version of Muslim cleric, but might be. Putin specifically saluted them and their support during the epidemic, too.

341 Look up "Notwithstanding Clause" sometime.

In Europe, your rights are a gift of the government, which makes it clear they can be taken away any time.

In the Anglo countries, your rights are yours until the government decides to take them away.

In theory, in the US your rights are yours and can't be taken away. But that's changed in the last year and is going to change more in the future.
Posted by: Hadrian the Seventh at April 22, 2021 09:28 PM (mht8P)

The "notwithstanding clause" was intended more as Provinces' Rights deal, meaning, in theory, that a Province could opt out of some particular Federal legislation, and could work for individual liberty as well as it could against it, depending upon circumstances. AFAIK, it has never been successfully used, because of chickenshit Premiers.

Did not know that he was disabled. My second oldest daughter is on SSDI. She is capable of being a super detail oriented person and went into that mode. If you are not, may I recommend that you guys find a lawyer [preferably one you know and trust] and have him handle it. They try to make you fail and have to start over.

On another train of thought, just thought I would mention something. We don't talk here. In fact I rarely talk to most of the horde. But I have always admired you for something. If you are a parent, your first priority is to take care of your kid. I remember reading about you taking a fall [down some stairs?]while carrying your baby and buggering yourself up for quite a while but protecting your kid. You did good. You should be [and probably are already are] proud of yourself.

But - if our desire for good relations is taken as weakness, and .... themselves burns the bridges, they should know, Russia's response will be asymmetric, quick, and harsh".

Not all that land in Siberia is necessarily arable. The part that is heavily forested (the Taiga) probably has soil that is classified as "gray wooded", and it is not much good for growing crops. Plenty of central and northern Alberta has such soil, and is not farmed, even though the latitude would permit an adequate growing season. But it grows trees, and they have their uses.

Though, honestly, in Russia's case, it's likely more of such spending would actually be legit infrastructure than in the sad clownshow that is now the US. He outlined in particular a project to extend good highways from beyond St. Petersburg-Moscow on to Kazan and Ekaterinburg (Sverdlovsk, in the Soviet period - Urals).

Yes, though there is an income cap and it isn't overly high (bit over $1000 a month maybe?) -which makes sense as the tax payers don't want to be on the hook for paying the health benefits and a monthly check that makes SSDI more rewarding than their job.

Posted by: Bete at April 23, 2021 12:47 AM (Ojki1)

394 One other thing: you don't necessarily have to have mountains for mineral wealth. Old, ground-flat mountains like the Canadian Shield can hold immense ore deposits, and even the Mississippi valley had a huge lead-zince industry.

PookysGirl:

Back in the mid 90s I was an attorney on a lot of SSDI claims. You almost always get turned down initially, and on reconsideration at the next level up. Generally speaking you will end up going before an administrative law judge for a hearing before benefits are granted. I no longer practice law and things I am sure have changed since I did, but if you want some more detailed pointers on the process, please email me at:

I don't know if the meteorite theory for the Sudbury Basin is fully accepted. There's reason to believe a meteor that large would carry enough kinetic energy to be completely vaporized, which is probably the fate of the Chicxulub impacter. They got very, very little iron out of Meteor Crater, remember. And the nickel and iron in nickel-iron meteorites is all in the form of actual metal; little or no oxides and sulfides. The nickel at Sudbury is nearly all sulfide minerals. Where did all the sulfur come from?

407 ssdi is never (almost) granted first time. Age education work history skillset are all considered along with the disability. Younger skilled educated people hav a higher bar to clear. Document everything about the disability. Having medical records and documentation is vital. Get a good Dr on your side that agrees with the decision that working is impossible. After being denied a 2nd time (or a third) admin law judge will make a ruling.

Posted by: USNtakim deplorable still. at April 23, 2021 01:31 AM (0OmEj)

409 Canada, in truth, has not been a free country for some time now. (With apologies to those, like our Canadian friends on this board, who actually want and appreciate freedom.) It's funny that some of them are at the border flashing SOS signals at the people south of the border. And as for the "Canadian Charter of Rights and Freedoms"? It's focus is more on what Americans want for this country - group rights. (Nothing makes Americans more angry than the idea that there is something that exists called "the individual", and American society is extremely hostile to the idea that individuals exist with individual rights and individual liberties. Time was when Americans believed individuals were endowed with inalienable rights from our Creator. Now, they believe rights come from what group you belong to, and from that point they are determined by the State.)

I mentioned this earlier today. The Toronto Police Service is patting themselves on the back for taking these old, antiquated but VERY dangerous guns off the street there, so therefore Toronto should be the safest city in the world, right? (So why do the Toronto cops still have guns, huh?) I was last there in 2019 and it couldn't have changed much...what led their local news in the morning? Shootings, shootings, shootings. Crimes involving firearms. So much for their constant crowing about how much better they are because they got rid of guns. Oh, and as for how proud they are of not taking the responsibilty of paying for their own doctors and farming that out to the State? Well, it's taking a bigger and bigger bite out of their budget, and, mark my words, they WILL resolve this - by using organizations like the ON Consent and Capacity Board to withhold medical care from people and otherwise encourage euthanasia.

421 Probably too late to be helpful, but here it is anyway.
For Social Security Disability, the first decision is made by people with guidelines to follow.
If denied, the appeal is called a Reconsideration. A new decision is made by somebody else, but using the same guidelines.
If the Recon is denied, the next appeal is a Hearing. An Administrative Law Judge makes the decision. The Judge has wider latitude than the first two decision-makers had. If you go to a hearing, the judge will require you to have an attorney.
This is how things were 15 years ago, but things change.
People can be approved at the first filing. I saw it, and I am one of them. For me, damage from a brain tumor surgery was bad enough to qualify the first time.

423 If you live in NYC or DC, the diplomatic immunity thing is real to you. The diplomat plates are super obvious, at least they used to be. I know back in the day a diplomat pretty much could do what they wanted. They certainly didn't have to obey traffic laws. I think the worst that could happen is they could be expelled. But if you did that, it was likely some of yours would be expelled as payback.

Posted by: My life is insanity at April 23, 2021 03:07 AM

That is odd. We didn't consider cases old until 90 days. A decision in a couple weeks would normally be because the applicant did not supply requested evidence.

At the hearing level, there can be huge case backlogs that take many months to clear.

Your husband should have gotten a letter explaining why he was denied. If he wants to see more, he can ask to review the file at the closest office. The office will approve that unless there is a reason requiring a representative instead. The file has to be reviewed in the office, it cannot be sent out for review.

431 Guy I went to high school with was riding his motorcycle in NoVa years ago and was hit by a (South) Korean diplomat. Messed up his ankle pretty good. The dip didn't bother to identify himself as such and his $25,000 minimum insurance policy wasn't enough, so the guy hired my father and sued in Fairfax Co. circuit court (not knowing about the dip status). The dip didn't answer the complaint -- why bother? (Jesse Helms eventually had him kicked out PNG, heh.) Anyways, I researched the matter for my father (I was in law school) and it turns out to be a fascinating area of law which I'll summarize next post.

He rec'd a letter stating he didn't qualify. (Seizures due to non-cancerous brain tumor). Apparently the seizures didn't happen often enough for their standards. Of course not- the meds are taking care of that. However, because of the meds, he can no longer work at his long time profession (commercial truck driver) but they said he 'could' do something else.

Was told he could reapply if anything changes.

436 Hey there, Quint!

Posted by: My life is insanity at April 23, 2021 03:29 AM (03DC2)

437 Decades ago, Congress required all dips to carry insurance and also created a direct right of action against the dip's policy rather than against the dip (obviously) and abrogated diplomatic immunity as a defense by the dip's insco (obviously). It didn't do anything WRT the plaintiff's UM/UIM policy which would theoretically provide additional $. (Always get as much UM/UIM as you can.) In some states, it didn't matter because you sue your own carrier if you need to. But VA was different and your own UM/UIM carrier could raise any defense that the defendant could; it was verboten to mention "insurance" at trial, which meant UM/UIM was useless if hit by a dip. I wrote my law school thesis on a way around this though my former classmate didn't pursue it. During my research, I found a quote from a State Dept. official responding to insurance carriers who were concerned that if the jury knew an insurance carrier was being sued directly, they'd inflate awards. The official's response was (this was 1976-ish), paraphrasing: "Anyone in this day who doesn't think there's insurance in a car accident trial is divorced from reality and doesn't belong in the jury box."

439 Interestingly, Putin is proposing an epidemic-related economic intervention of direct support to families with children. A needs-based, focused response. Funny how not having a reserve currency and limitless fake money capacity forces one to make more intelligent policy choices.

Sigh.

Posted by: rhomboid at April 22, 2021 11:41 PM (OTzUX)

We COULD, I don't know, vote for people who don't spend us into oblivion. But Americans are too fucking lazy to be bothered. Instead of simply voting for people who can balance budgets, let's blame the stupidities of government on reserve currency status. That is far easier.

Okay, yes, a person can be denied because even if they cannot due their usual job he can do something else. A person at the SSA office will not be much help. He will say, we don't make the disability rules and we aren't an employment agency. You want the appeal papers?

Anyway, for such instances you have to appeal and get your case to a law judge because the judge isn't bound by the rules. Approvals at the Hearing level certainly happen.

It really helps to get an evaluation by a health professional who knows how it's done.

In my case, I saw a guy who said, I know what they are looking for, and he dotted the i's and crossed the t's.

We need a govt program to get deprived individuals more access to sex (insert other slang here if you want).

That is how we deal with crime isn't it, as an access problem and not a behavioral one.
Posted by: Bete at April 22, 2021 09:44 PM

Good news: government "sex therapists" paid for under socialist medicine.
Bad news: while allowed to identify sexual preference, trans-persons are recognized by government as their identified gender. If you don't fuck your assigned therapist, you lose medical coverage AND are charged with hate crime.
