9th Circuit Rules That There Is No Right to Carry a Weapon

Gird your loins. If this is accepted for review by the Supreme Court -- and the Supreme Court has shown itself to be extraordinarily cowardly in ducking ruling on big-ticket items -- we will find out if we really have a "conservative" court, or if the lawyers recommended by the Professional Class Karens of the Federalist Society are just from the Corporate Wing of the Uniparty.

I suspect the latter.


The 9th Circuit Court of Appeals upheld a Hawaii gun regulation, ruling Wednesday that states can restrict the right to openly carry a firearm in public.

The 7-4 decision said restrictions on carrying guns in public do not fall within the scope of what is protected by the Second Amendment.

"We have never assumed that individuals have an unfettered right to carry weapons in public spaces," the majority ruled. "Indeed, we can find no general right to carry arms into the public square for self defense."

"The en banc court held that the Second Amendment does not guarantee an unfettered, general right to openly carry arms in public for individual self-defense. Accordingly, Hawaii’s firearms-carry scheme is lawful."

The case was brought by George Young, who applied for a license twice in 2011 to carry a gun in public either openly or concealed and was denied both times because he didn't prove the "urgency or the need" to openly carry a firearm in public, the decision said. Instead, Young relied on his "general desire to carry a firearm for self-defense."

Under Hawaii's law, residents have to show the "urgency or the need" to carry a firearm in public and must be of good moral character and "engaged in the protection of life and property."

Judge Diarmuid F. O'Scannlain authored Wednesday’s dissent, calling the ruling "extreme."


"The Second Amendment to the United States Constitution guarantees 'the right of the people to keep and bear Arms'. Today, a majority of our court has decided that the Second Amendment does not mean what it says," the minority dissented. "Instead, the majority holds that while the Second Amendment may guarantee the right to keep a firearm for self-defense within one’s home, it provides no right whatsoever to bear-i.e., to carry -- that same firearm for self-defense in any other place."

"This holding is as unprecedented as it is extreme."

"We now become the first and only court of appeals to hold that public carry falls entirely outside the scope of the Amendment’s protections," O'Scannlain continued. "In so holding, the majority reduces the right to 'bear Arms' to a mere inkblot."

Technically they're not banning carrying a firearm. Only carrying it openly. They may get away with this one.

Frankly I've never been a fan of open carry for a number of reasons. That said I don't have any issue with those that do and can see their arguments as being valid.

The courts view that phrase keep and bear arms much differently that the layman does. Bearing arms covers a wide range of behavior thus it is was left up to the court to interpret which meaning is correct.

Just as taxing bullets to ridiculous numbers will probably be ruled as not infringing on the 2A even tho the EFFECT will also within the scope of interpretation.

I believe not many will register their firearms if it comes to a national registry. There are a couple states with registration laws that owners have not complied with.

Not entirely. It says that Congress is given the ability to redress rights an individual statement denies. It said nothing about auto-Judges.

But even applied to the states, it doesn't touch anything I wrote. "shall not be infringed" is much more broad a prohibition, and "School board" as "Congress" is still a strained reading.

Also, the reading of the 14th amendment flipped the *purpose* of the federal government making no religious decisions on its head. As the ACLU willingly demonstrated throughout the 20th century.

The flaw with the system is that the founders thought that []only the federal government would be so corruptible as to require a constitution to bind it. That they thought local and state government were so close to the citizens that they'd never be able to or likely to attempt to infringe on rights, because the people would fight for them.

Pro gun subs on Reddit may think this is Fudd-lore, but I've always thought a criminal who spotted me open carrying might choose to amble by and shoot me in the back of the head before I even knew I was in danger. I'd much rather look like a sheep and potentially catch a criminal off-guard.

Gun laws in the US are so hodge-podge and stupid. For a while, here in the WA, you could own and mount a suppressor to your gun, but if you fired a gun with a suppressor mounted, you'd committed a crime.

Actually for indoors it's an ok choice. You won't go deaf. There's some absolutely insane/cool target pistols that run .22, but they're kinda pricey. My suggestion if you're looking for a semi would be the Ruger SR22 or the Sig Sauer Mosquito. Both are super-modern do-it-all designs. Sig actually makes a 1911 chambered in .22, if you want to be fancy - but that's probably not the best all-rounder.

The thing you need to remember was that the people negotiating all this were politicians representing their states. They were worried about the new federal government clamping down on the states and taking over the prerogatives of the state governments. They very much wanted to retain these powers for themselves, not to tie their own hands. All the restrictions in the federal constitution and all that talk about limited, defined powers was about the new federal government.

I have a cute little Beretta Bobcat. My everyday carry is a 9mm S&W M&P Shield, but my Bobcat is on my CCW too. However, your everyday run of the mill .22 round will not cycle the gun. I use CCI mini mag and it runs like a dream. I could put 8 rounds into a bad guy's eye in the blink of that unfortunate eye.

You have to make LARGE donations to the Sheriff's re-election fund. That's how it works in most of CA.

Fresno County is a notable exception. It's rather like Texas when it comes to concealed carry, because Sheriff Mims isn't a shit-head. Which reminds me, I need to get started on my license. I feel nekkid without having one, like I did when I was in Texas.

It's not only difficult to find guns to buy, it's becoming difficult to buy spare parts for some older weapons. While you're waiting for guns to be in stock, I suggest buying spare parts for what you have, new or old. Especially springs and pins. There are lots and lots of parts sellers are on the Web, including some of the weapon manufacturers themselves.

Last time I was in Hawaii, my husband went out for a run- some native guy chased him thru a field . We told the hotel and police and they were like, "Oh, that's just XYZ. He's a little crazy".

That was common in VA back in the day. What it would be like now in a blue area is likely not good. But the thing about Virginia, and the thing they have or had even over Texas, is open carry was ALWAYS legal. They didn't have to pass a new law because it was already legal. as a long time ccw, I think that concern is very overrated. That is something people worry about who are new. The thing is, you figure out what works for you. You never take it lightly, but there is a point when your sidearm is no different than your keys or wallet when you are out and about.

In Orange County, CCW permits went to "shall issue" several years ago. But iirc, the sheriff who had decided that (who was an interim choice whose real job was a coroner) didn't run for reelection. I don't know what the current sheriff's stance is.

About 10 years or so ago, Orange County was thought to be pretty close to shall issue, but it turns out that the Sheriff was essentially selling the licenses for political contributions. He got busted for it and kicked out of office, IIRC.

I haven't kept up with things recently though, so I'm clueless on the current CCW situation there.

As a secondary choice, go with CCI MiniMags if you do have a semi-auto .22 carry pistol. They've been the only 'bet your life' reliable round....and they still occasionally have a dud.

I need to build me one. So hard to find off-roster in CA, and even then they're at least 2x street price and have been handicapped in some way. The fixed magazines are a joke. Gotta love people who have no idea how something works passing laws on it.

I managed to get an off-roster CZ Scorpion Carbine, but the FFL had to fix the stock so it wouldn't fold. Yep, boy as soon as I can fold that stock I'm compelled to run to a church or school and start shooting. Luckily, they left the magazines alone. I just need to figure out if there's a way to get the stock to fold again, nothing like having to buy a larger, more expensive case because some shit-brain in Sacramento has no idea about anything.

The only person who died was killed by police. I made the point that, unless you are very specific about what you label extremist, anyone can be considered one depending on who is doing the interpretation, and if I'm not safe from this, neither is anyone else. Hurm. Small .22?
A Ruger/Taurus/Smith&Wesson lightweight revolver. But those 2" barrels don't give you much penetration, even with 40 grain CCI MiniMags.

If you want a semi-auto, the S&W M&P Compact might be the most reliable with the most ammo types, it's still a bit big, though. Walther makes a smaller .22, it's a bit finicky about ammo though.
Beretta makes good .22 autos as well.

412 406 Just a quick heads up to the horde - all CWP are tracked at the federal level for a variety of reasons.

Same for hunting and fishing licenses.

Any state, city, county, etc can find the info on whether or not you have a gun.

Lots and lots and lots of businesses are interested in whether or not you are armed.

414 Handguns, rifles, and shotguns are around, you may not get your first choice or the cheapest but they are around. Used guns, not so much.

Budsgunshop is one place, classic arms is another, midwayusa, brownells, jgsales, cdnnsports, aimsurplus, are all places where you can find a 9mm handgun of some sort, shotguns, and rifles, even AR's.

Ammo though is expensive and made of unobtanium in all but the most standard of cartridges. .22 LR is running 25-30 cents per round if you can find it. Luckygunner has 225 rounds of .22lr for about $120. .22 Mag is around but you have to look for it. Centerfire, 9mm and 45 are around but as expensive as rifle rounds unless you go to steel case. .223, .308, and 7.62x39 are in stock and expect between 60 cents to over 1 buck per round. Others are more expensive and hit and miss.

All that was made up by the first Supreme Court and everyone's gone along since. They have no power. They have no say. All their rulings etc. are enforced by the various legal departments and police departments both Federal and State.

No way to enforce anything. And at the rate they're going that just may happen. It's what the sanctuary gun movements are all about. If the LE of a polity won't enforce illegal rulings/laws then there is no law.

I'd like us to all go back to the strict interpretation of the constitution and the first lawyer who stands up and starts in on penumbras and emanations gets strung up.

A long silence and then, "Did you hear that BOOM?"

We had railroad detectives on the doorstep the next day. Brother got shipped off to military school and things were much quieter in town after that.

I'd argue that you need to think about what kind of guns were available in the 18th century. Very few things well-suited for concealed carry. Open carry was pretty much the only way to bear arms back then, so I say it is protected by the 2nd Amendment. The Founding Fathers were indeed thinking about open carry when they wrote "shall not be infringed".

423 Couple this with Caniglia v. Strom (see Forbes.com article from yesterday) being heard by the Supremes and you have a perfect storm re: gun rights. It has the potential to allow warrantless search and seizure of legal firearms based on "community caretaking".

Basically, if cops decide that the community needs safeguarding against "insurrectionists" and "domestic terrorists" (you know, conservatives!) they would be allowed to conduct warrantless raid to seize your firearms.

I started suspecting, and saying, that over a year ago.
Too many things kept coming from the Federalist Society, "libertarian" things, that were far from conservative, yet nobody seemed willing to identify the Federalist Society as the source.
And now we will see if Roberts suborns enough of Kavanaugh, Gorsuch, and Barrett under the pretense of not offending the media or provoking the Democrats to pack the court to enable this rewrite of the 2nd Amendment.

I can see how some states would restrict open carry, but to have a judge prevent any carry is IMHO flaunting the US Constitution's 2nd Amendment.

But, such unilateral actions by predominantly Liberal Progressive judges would not surprise me.

433 I predict the Supremes will not touch this topic unless and until a Republican is president again -- for the same reason they recently turned down multiple good opportunities to mess with Roe v. Wade.
The reason is that Congress is looking for any excuse to set aside the filibuster rule in order to push through a bill that packs the Court. And a solid conservative ruling about either guns or abortions would give Congress that excuse. Thus if either subject does come before the Court in the next 3+ years, the court will have to go against its conscience and move the status quo leftward. With that in prospect, better not to have taken the case at all.
