First-World Problems...Part Tiga Puluh Lima

What is the the world coming to when one can't even count on the structural integrity of a tea bag. This is not a complicated industrial machine; it's a damned permeable pouch with some very lightweight stuff inside. Yet the vast resources of the western world cannot design and manufacture a teabag that doesn't have a failure rate of less than a few percent!

This is quite simply unacceptable. Imagine other things in your daily life if they failed at that rate! Condoms, tires, surgical stitches, elevator cables, penicillin...where would we be if that were the case.

There ought to be a law!

Growing up in deepest darkest Africa, the only way we could get tea was after scraping up the discarded tea leaves the rich people scattered on the ground after drinking their tea. (They drank loose leaf tea.) It was considered a kindness to the starving masses.

29 I have a ceramic hot tea glass that has a foil strainer that sits on the top. I guess it's a bit like pour over drip coffee but not as complex. I never use tea bags anymore. I've found at my 29+ age that a lot of convenience ends up not being very convenient over the long term.

I think pretty much any of my basil tea comes pre-unsealed. Open up the little envelope, and powder is coming out in about 2/3 of the things. I think the Indians are too fucked up to notice or care. Monkey stole the grandkid this morning after all.

42 There is an art to making a good cup of tea. The water has to be the perfect temperature - not quite boiling and the teabag has to steep for a very specific amount of time before being removed. Water temperature and tea bag steeping time varies depending on the tea leaves used - oolong, ceylon, etc.

I've had to replace the filler and stopper mechanisms in my toilets WAY too often. The one in the master now sometimes just doesn't open the valve at all, until it decides to. I put it in last summer.

One brand I like, Celestial Seasonings has maybe 1:20 bad bags, if that. Tulsi Basil tea on the other hand about 1:3 is leaking.

But if you're seriously into tea bulk is the way to fly. I have a cool little pot with a diffuser built in, works fine with most loose leaf and root/bark/flower type teas.

I actually bought a box of empty tea bags that I add loose Irish breakfast tea and a chai spice blend to. I have a diffuser as well, but the holes are too big to contain the spices if I want chai.

I have a toilet that's going to drive me to drink. Drink more.

The previous owners of my house cut the hole for the down pipe nearly as big as the diameter of the toilet base ring. Why? I have no idea. Then they glued the ring down to the flooring. Probably because there wasn't enough material left to fasten it down properly, just a tiny edge.

So, the ring broke and the toilet isn't actually fastened to the floor. There's not enough flooring left to put a new ring down properly. So, I will have to put in a new floor somehow in that spot. I'd like to do it without removing tile because I think that would scrap the whole floor.

There's not really any question that there are intolerably high levels of China-centric corruption throughout the federal government, big tech, the media, and the corporations behind Biden and the Democrats. I don't find it implausible at all that patriots, given a chance to expose them, would open fire on them to get at the evidence.

You can't, at this point and perhaps ever, prove which ballots were illegally cast, but you can demonstrate that the lower bound of the number of illegally cast ballots is bigger than Biden's margin of 'victory'. We, here, can be reasonably certain that illegally cast ballots were nearly all for Democrats (as most Republican politicians don't care enough to make the effort to cheat), but a court, in order to function as we generally expect them to, has to be artificially stupid.


The President's legal team is looking to merge the state cases at SCOTUS and get one remedy decertifying all those results and instructing the respective state legislatures to select electors. That remedy has nothing to do with Senate races.

In PA, specifically, there are major issues with mail-in ballots that may lead to a remedy of throwing out all mail-in ballots. So if the runoffs were in PA, the candidates would have an immediate case to have the general election results recalculated to see if the runoff was even necessary. I'm not sure if something like that is in play in GA.

The other Senate race, Warnock (D) lead with 33%, followed by Loeffler (R) at 26% and Doug Collins(R) at 20%.

The fraud alleged is large enough that it might have impacted Perdue's race, though not so large that it would've affected the other race because the other race had its votes split amongst a lot of candidates. Is there something unclear about that?

The number of ballots under question isn't the same as the total ballots case.

For a statewide election if no candidate gets 50%, then it goes to a runoff between the top 2 candidates. This does NOT apply to the president. You'd think it would, but it doesn't.

The pardoning of Flynn has been portrayed as PDTs "last resort" but I don't see it that way. PDT freed up Flynn and Powell. Notice Powell is now posting things she could only see from the executive capacity (Trump).

537 If the counties that physically possess the machines are not parties to the suit OR parties to a subpoena duces tecum (a way to get physical evidence possessed/held/controlled by 3rd party), then the court cannot order them to do anything. The court could order the state to do something, such as secure the machines from the county, but the state would have to act against the county if the county didn't voluntarily hand the machines over.

Rules of spoliation of evidence are good and all that, but, hey, what are the rules of spoliation of evidence that apply to this lawsuit? Federal procedural law, so federal evidence law? Not my specialty. I do know something about local government law -- for instance that California is very different from Virginia -- last I checked (1995, on the bar exam), in Virginia, cities and towns are independent from the counties in which they are located to a much greater degree than California. So it's not just so easy to start name-dropping auto subsidiaries.

Look at page 103 (the penultimate page). Both Powell and Wood are counsel of record. What I'm saying is that if the order does not command the county to hand over the machines and if the county is the one in possession/custody/control, then if the defendants have no way to force the county to hand them over, other than by threatening them, then the order is not enforceable. I would have sued the county(ies) involved too, but that's just my experience litigating in CA.

543 The GA Supremes recently discussed spoliation in Phillips v. Harmon in 2015. Of course, the politicians in robes could decide completely differently this time around.

The Georgia Supreme Court has now held that as long as litigation, i.e. a lawsuit, is "reasonably foreseeable" a person or company has an affirmative duty to save documents, etc.

"Logically, the duty to preserve relevant evidence must be viewed from the perspective of the party with control of the evidence and is triggered not only when litigation is pending but when it is reasonably foreseeable to that party. In Virginia, cities are not located in counties and are independent of counties. Towns are not outside of counties and are not independent of the counties they are in. Regardless, Virginia law says that if you should have known evidence should be preserved because a lawsuit has either been filed or is foreseeable, you can be punished for spoliation if you destroy that evidence.

Even if threats have to be involved, if the state can seize the machines (and they can) then the order would have been enforceable even if the counties currently have physical custody of the machines.

554 Well, cities in Va are not politically within counties - which i learned studying for the Va bar, not something i learned growing up there (you'd think) - but they certainly are within them geographically. That is something we don't have in CA. Point being, in litigation like this, what law applies is pretty important.
