Hopefully who ever asked for the restraining order is going back to court to have people arrested and hopefully these workers know that this gives the judge in the case to assume that that data would have proved they are as crooked as Trump says they are (spoliation rules are a bitch).

I mean the real truth of the matter is what any professional IT environment is either running fully "in the cloud" (azure or AWS), or has multiple redundancy in their physical servers, including virtual servers on other machines off site. And if they're doing their own storage, and not cloud storage, it's across multiple SAN's where the hard drives are set up in whatever RAID configuration is appropriate for their application.

Plus, they have regular data back ups to off site disaster recovery SAN's.

So, while it is theoretically possible for something catastrophic to go wrong where data is lost, it is very unlikely and would involve a lot of stars aligning in the most unfortunate ways imaginable.

If I've learned anything from the events of the last few years, it's that it's very common with technology being used by politicians or FBI for servers to "crash," and all of the data to be accidentally wiped, and the hard drives to be accidentally crushed and thrown out.

Funny how that never, never just 'happened' in my 40 year career that I was aware of. Oh yes, once we lost all the data but that was due to the "DISP=(OLD,DELETE,DELETE)" parm. He was out the next day.

I've been doing this crap for almost 40 years as well, back when the big servers used giant reels of tape. In all that time, I'm aware of 1 server crash we had, and even then we were back up and running in a few hours. This was early 2000's. I also lost a personal hard drive, a crappy Maxxtor that crashed hard - but it was brand new and probably had more to do with a faulty SCSI port.

Any IT guy would never accidentally wipe a drive. You have to go through great effort to do that shit. That's like saying accidentally changed the spark plugs. The guy wouldn't last 10 minutes on most jobs if he was that much of a fuck up.

Yeah, had plenty of drives start to go bad, but I've found whenever there's a "crash" it's on somebody's laptop, and a lot of reasons for those failures. Not a freaking server that's screwed into a rack. Total fucking bullshit for stupid people and politicians (but I repeat myself).

individual hard drives go bad all the time.

But no big deal, since every company on the planet is either using Amazon or Microsoft's SAN's or their own, where the drives are configured in RAID 5 or RAID 10 or whatever.

At the most basic level, in RAID 5 you can have 3 hard drives that the data is written across, and if any one of those drives fail, you pop in a new drive, and it can back-fill the info on the drive that failed. Really mind blowing technology.

And, of course, you have nightly off-site back ups. Used to be with tapes, now it's mostly dumped over the internet to a disaster recovery site.

Or, as I said, most IT environments are transitioning to outsourcing this shit to third parties like Amazon and Microsoft. And for them to "lose" your data would require an asteroid strike that takes out multiple of their data centers.

Depends on the state. Well, and the judge in question.

In my (very limited) experience, most judges are *very* hesitant to use no knock warrants, since by their very nature they're designed to catch someone off guard, who has no idea what's going on, and are thus much more dangerous for both the cops and the person the warrant is issued for.

Mostly used in drug cases where the cops convince a judge that the suspect could flush the drugs and/or shoot them through the door if they do their typical "knock and announce."

I tried to be polite, but he kept going, so I decided diplomacy wasn't working. Against all sage advice, I bitched out the cop, and explained to him that unless he could prove I was committing a crime, the route I chose to drive to work was absolutely none of his business.

yeah, it became popular as a method to take down what are pretty small time crack dealers, during that big crack down on drugs in the '90s.

I honestly am not in favor of no knock raids at all. If the person is that dangerous, stake out of his house and wait for him to leave and grab him when he's in the drive through at McDonalds or walking his dog or whatever.

And I guess flushing a baggie of crack down the toilet before you get in to the house is a risk you have to take.

Far better then the alternative.

At one point when social workers came into Vogue they tried to go out on their own to "help" people in their own way, without the police. He advised them not to do it, that some people were evil and would kill you in an instant. They insisted on doing it their way. The stories he told me about how two of them were killed still haunt me.

I don't want to rain on everyones parade here, but I really can't foresee a situation where SCOTUS overturns certified election results by a state.

They have many ways of punting the case, including not granting cert to the petitioners.

They can call it a "political question," which means they don't get involved.

Or, they can hear the case on its merits, and decide "well, doesn't sound good. States should probably work to fix it. But the voters of PA (or wherever) elected the legislature that put this system in place, and this isn't our wheelhouse."

I'd say there's a 90% chance SCOTUS goes with one of those 3 options.

7% they go with another option that has the same end results, and maybe a 3% chance they actually overturn election results based on an equal protection argument.

By March, at least a third of the people here will be right back to their various themes of "If we don't vote, we let them win", with some "Come on guys, we have to take the Republican Party by voting for Republicans" mixed in. Along with a recurring ramrod straight speech about how somebody ain't giving up on the country after decades and generations of service - and everybody will applaud and wave the state approved banners and chant "That's the spirit". The GOP knows that. Oh - they don't know the particulars about how this joint operates - but they understand the sentiment.

No matter how badly the GOP drags our asses through the mud, or how many times they pull back that football, they know plenty of rubes will keep lining up to do it all over again. Because to admit the system is rigged is just too much for many to contemplate, after living their entire lives projecting more than a bit of what they see as the good in themselves onto the various symbols and customs of the State. Many just can't turn their back on the State - no matter what the State does to them - because they've been conditioned far too long saying it's pledges, wearing it's various uniforms, and celebrating it's holidays. It's Pavlovian - and more than a little Soviet.


The GOP knows all this - and they know that, at worst - they're the junior partner in this shit show that most just can't do without. Or, the TL;DR version - Baby, where else are you gonna' go ?

That case in Florida recently, where a female deputy (and a male cop) fired on some poor yutes who made a wrong turn and accidentally drove at the cops who were searching for a stolen car, despite the male officer yelling multiple times for them to stop.

Oh, and doing a bit of further research, both young men were members of a group called the "cut throat committee" and had multiple firearms in the car, which may or may not have been stolen.

And that would seal the deal for the future, for any election, from dogcatcher to President, in every location with Democrat vote counters, election result certifiers, and judges. SCOTUS will legitimize a State Supreme Court being able to nullify election laws, removing legislators from city councilman to state legislator and senator, from the equation at the time of the election.

A Republican mayor or governor may or may not be able to remedy the situation, depending on how the city charter or state constitution is written.

So from what I've seen, Trumps legal team is arguing an equal protection case. Which would probably be my strategy, too.

Basically that every fake vote dilutes a real vote, and that different areas had different procedures for voters, depending on party registration.

The problem is that "political views" is not a protected class.

The only cases I know of that have succeeded with these kinds of cases involve blacks being "disenfranchised." And even then, the courts have been looking forward, not backwards (for example, in the future, poll taxes are illegal)

Could this strategy work? Yeah, maybe. But ... it's a long shot. Like a very long shot.

Because the thing of it is that the electoral college is what matters, and while the constitution says that states need to have a "republican form of government," it does not spell out how voting should be done. That is left to the states.

Which gets us back to your point -- SCOTUS would have to say that PA Supreme Court interpreted PA law wrong. Which, as you point out, is not something I am familiar with any federal court ever doing.

Not a cop, but a female bail bondsman lured a guy into her office, on the pretense that her son wanted to buy the guy's car. Apparently he told her he was leaving town by text, and she took that to mean he was going to run.

Anyhoo, long story short, when he objected to being cuffed, rather reasonably asking what she was trying to arrest him for, he tried to leave by the balcony, and she shot him in the back. Dead.

She was acquitted of all charges, even though she claimed he tried to do this and that, which the video CLEARLY showed he did not.

I think it really is as simple as the court doesn't want to be seen as political, as that could trigger a really bad constitutional crisis.

Remember, the Constitution does NOT give SCOTUS the ability to do judicial review.

They just kind of granted themselves that right with Marbury v. Madison.

And since the left controls all of our major institutions in this country, I'm sure there is a (legitimate) fear that they'd say "nah, you can't do that" to SCOTUS. And then what is SCOTUS to do?

Understood, and in this situation the guy was totally blindsided. He was having a nice conversation with her, with her son sitting right next to the guy. He even took off his shoe and started rubbing his foot or whatever.

Then she gets up, goes to close the door (which I assume locks from the inside), her son takes out the handcuffs, and he's basically saying "What the hell? What did I do? Why are you doing this?"

I guess I am trying to draw logical lines. I am an engineer - I look for things to make sense. A hodgepodge of borders (Denver/Boulder/Jeffco/Adams/Arapahoe/Broomfield, plus the tourist towns makes less sense. Include El Paso, but do you include Pueblo which voted for Biden?
Same logic with Utah. They are trending hard left. Let them go - it makes geographical sense. Maybe the LDS rises up and says no, but they supported Romney and they hate Trump. Good riddance.

We've had constitutional amendments that say you can't tell people who can vote based on gender or race, and that voting age is 18.

And of course you'd run in to 14th Amendment issues trying to restrict voting to only land owners.

But there isn't a Constitutional requirement (beyond those) and how the vote is conducted and who is eligible to vote.

SCOTUS would have to either find a 14A reason to invalidate a states vote, or would have to invent some kind of new rights.

Which happens all the time. (see: Brown v Board of Education or any other famous SCOTUS case in the last 100+ years).

This would either have to be a 14th amendment case, or a case where SCOTUS says "the PA supreme court misinterpreted PA law."

14th amendment is the only realistic approach I can think of, as federal courts, by their rules of interpretation, DEFER to state courts on state law. (see Erie doctrine)

It sounds to me like at least SOME of the Republican legislators are warming up to the idea of overriding their crooked elections. The AZ guys tonight sounded like they were about ready to vote to do that, right then and there - and get some grand juries convened to throw some people in the slammer at the same time.

On the other hand, people say stuff for the cameras, then go off and do nothing. These guys sound like they REALLY "get it" though, so we'll see if there's enough of that sentiment to carry the day.

One problem is that there's corruption WITHIN the Republican party a well. Obviously the GA governor, but it sounds like the AZ governor is pretty crooked too. You have to believe that the crookedness is present to some degree in the legislature as well.

Just remember: TRUMP IS REALLY GOOD AT THIS STUFF. He reaches out to politicians - even DEMOCRATS sometimes, and GETS STUFF DONE.

The more of these hearings that happen, the more the guys saying "voter fraud is rare, it's just that Trump is a sore loser" sound like Baghdad Bob, no matter what Twitter and Facebook say.

We act like this hasn't come up before. The Supreme Court punts on cases literally every session. Many of them. They either don't grant cert or they hide behind the "political question" doctrine.

It's been going on for over a hundred years.

They have made a huge effort to not invoke a constitutional crisis going back all the way to marbury v. madison.

I was one of them. A Flight 93 voter. Frankly, I would have been happy just to keep Hillary out of the White House and get the Supreme Court justice (who turned out to be Gorsuch). I thought PA legislature had some fucking backbone, nope. As usual the two top "GOP" leaders didn't even bother to take up the PETITION presented by the Patriots in the party. Which really doesn't make any sense to begin with. Why the legislature has to introduce fuck all anything to wield the power granted to them by the Constitution is something I'll never understand and I don't give a fuck anymore.

It's beyond clear that Patriots need a new party, but can that happen without mass violence? I don't think so. If the left secures this steal, the GOP have to know that fearing the media will become a fairy tale compared to the rage directed at them. I am forever tired of waiting to see how the GOPe can snatch defeat from victory.. with the exception of a few. How they don't recognize their immediate obsolescence if this goes south is morbidly humorous. So many opportunities to show us they care and with each opportunity, one by one they turned around and showed us their assholes. Well assholes, enjoy the trash heap because at least 70% of 80 million people HATE you with the heat of a thousand suns. That doesn't exactly turn into favorable votes. Voting... LOL good times!
