Consider the powers of the Chief Justice; he can direct which justice will write the opinion, which gives him a lot of political pull inside the court, because every Justice has their own favorite topics that they want to be given. BUT he only has this power as long as he's part of the majority in any particular opinion. IF he is *not* part of a 5 member majority, then that power goes to the most Senior Member of that particular majority, and currently, that would be Clarence Thomas. if Roberts decides to stay on the left, he will have to hand almost all of his powers as Chief Justice over to Clarence Thomas. Instead, he tries to find the decision with the least overall legal impact, and which pushes the big issues back onto the legislature and the executive. My theory is that Roberts wants to avoid any Roe v Wade type big decisions that create political anger towards the court. Instead, he tries to find the decision with the least overall legal impact, and which pushes the big issues back onto the legislature and the executive. Hence "it's a tax" which dodged the big constitutional question in favor of a technical question, or the DACA and Census decisions which hinged on technical interpretations of the APA.

But Martha Coakley effed up her campaign and lost, so the chance for House and Senate Dems to work out a final bill and make a bunch of fixes was gone. Thus, budget reconciliation was used, which only requires a simple majority in the Senate to get a bill through. The law in MA was changed in 2004 to interim followed by a special election because of concern that Kerry would win and then Governor Romney would appoint a Republican to serve the remainder of Kerry's Senate term. My theory (and I'm not alone) is that RBG has been dead for some time, which is why Roberts changed the rules to allow her to work "from home." They were going to keep up the charade specifically for these election cases. Then, unexpectedly, the court clerk announced that she'd died. There was a mad scramble by the left, because they couldn't prove the announcement was wrong. The media didn't comment on the announcement for 10 hours or so. The college-educated ones do. Higher education is aware that, due to declining birthrates, they are going to face a big dropoff in enrollment within the next 10 years. Many colleges will go under. The Wuflu closings will hasten their decline. So are the activities of antifa. I'm sure many parents who did not pay attention before were horrified at the dreck coming out of their kids' mouths during the Floyd riots. We aren't winning the culture war. Trump is really last gasp traditional America. Between mass immigration (millions per year legally), schools, media, and entertainment, old America is about gone. The 18 and under cohort is close to or is majority-minority. Whites are the only thing keeping conservatism going. No other group votes majority Republican. We better figure out what sort of agreement we can arrange.

A huge number of Hispanic families are involved the small business community. Steve Cortes (among others) has been working on this area. In the AA community, his friendship with Kanye & Kim and working on issues with them has helped, and Trump has been reaching out to rappers (not my cuppa tea but whatever) and having some success. Young black men have been taking a look at him, because he's Donald Trump and has been known for decades as a rich guy who marries actresses and supermodels and has his own jet. Trump's brand is what they see, not the GOPe and their mealy mouthed sucking up to the chamber of commerce for lower corp tax rates and flooding the country with low priced labor that devalues the labor of black men. In regards to winning the culture war, it's not like we're importing feminists who support gay marriage and trannies. On the contrary, given the hispanic tilt, many of the imports are pretty socially conservative. Even California couldn't legalize gay marriage through a referendum. The left is reliant on duplicity and educating future generations to be leftist, not natural reproduction.
