Of Course: Bail for Lancaster, PA BLM Rioters Reduced from $1 Million to $50-100,000

They had been held in jail for four days.

There was no rioting while they were in jail.

Wonder why.


The bail for people arrested in relation to the Lancaster, Pennsylvania, rioting Sunday evening is set at $1,000,000, according to the Lancaster Bureau of Police.

...

Several buildings sustained damage and rioters threw "water bottles, glass bottles, rocks, bricks, gallon jugs liquid and parts of plastic road barricades at Officers," police said.

Officers deployed tear gas and several arrests were made both Sunday and Monday in connection with the rioting, with bail set at $1,000,000. Some people arrested have not yet had bail set, according to a press release from the police department.

"The police sent letters on each person and requested a high bail due to the multiple charges and the seriousness of everything," the clerk said.

Now prosecutors have gotten the judge to reduce bail for the violent rioters.

Most of them will now be right back out on the streets.

Gee, I wonder if they'll rejoin the riots.

Previously, Matt Walsh had written that it was easy for Lancaster to stop the riots. All it took was... a political desire to stop the riots.

Something lacking in the Democrat party, from the most openly pro-antifa city council member up to Kamala the Cop and her junior partner Sundown Joe.

Well, that political will to stop the riots is now gone.

I guess Lancaster will burn tonight or this weekend.

Bail is merely a mechanism to ensure you show up for your court date. Remember that presumption of innocence until proven guilty? I do.

Of course, violating the conditions of your bail SHOULD require a revocation of bail and jailing until a new (and much higher, if any) bail is set.

This is where the no bail advocates fall flat on their faces, and endanger us all.

Excessive bail keeps possibly innocent people in jail, period. And I don't know about you, but I kinda like my freedom from being jailed without a trial, with no way out. That can easily creep into Third World Banana Republic style shit too easily.

We laboriously built this Chesterson's Fence, maybe we don't just tear it down without understanding why it is there? My $.02.

This is too simplistic. Often the guilty for these petty crimes suffer no more penalty than a small fine, or a few hours of community service. In that case, the process is the main penalty.

If there are organizations saying they will post bail, and pay legal fees for anyone arrested during these riots, then I say No bail.

Fire hoses used to be a "chesterton fence" as well. We can't just tear down the fences that restrain the rioters, and not the ones that help them.

Federal law provides for pre-trial detention, altho bail is the norm.

States don't have that. "Reasonable" bail is the requirement. These Lancaster defendants, going by the info in the news, aren't being turned loose on a signature bond (recognizance bond). I'm sure they're aware that their bonds will be jerked Unless they comply with the CONDITIONS of their bond, the foremost of which is, "obey all laws."

I don't think this situation calls for outrage-- yet.

If they're dumb enough to get re-arrested, then they will be held pending trial. Lancaster County is rural. It's not Philadelphia. I expect these refs will be monitored by pre-trial release officers.

Satisfying though it might be, you just can't expect state defs to be held without bond on the charges that were issued.

But to address a couple of your points -- This 'bail fund' is not infinite. Bail bondsmen do NOT have to write a bail bond, or can charge more than the customary 10%, if they judge THEIR risk as too high.

189 I don't know how bail works, but I thought if you post a bond (or property) you only have to pay a small fraction. Of course, if you skip you have to pay the full amount.

Anyway, that is how I thought it worked. So if the backers have a fund, they can post $50,000 bail all day long and not even notice.

They risk nothing since these people are not going to skip, and if they do it is only 50k. 1M means that they can not post a lot of these bonds, and they will not do it for anyone who is a risk. So 1M bail is only just nullifying the soros legal fund, and maybe the only way to do that.

I've told this story here before, I was in a courtroom (I'm not a lawyer) with a guy who in his life had spent more than a decade incarcerated. This day he feared he would be locked up by the judge, but due to some efforts on the part of his treatment providers, the judge decided it was worth dropping the case so he could get the help he needed (drug stuff).

As we were leaving we saw a young female who had just come from the cashier's winder. She was furious. She had to pay something like a $500 fine, and she was saying something about how she had not been told that instead of a fine, she could spend about a week in jail.

Said something like "I could have saved myself a lot of money, just staying in jail."

The guy I was with, looked at her, shook his head and said to me "she has no idea what she's talking about. If you can pay the fine instead of being locked up, you pay the fine. Every time."

Yeah, no one thinks I am weak-kneed about this, but that amount of bond (and the associated risk for the bail bondsmen) is sort of in the range of normal. The exception would be the arsonists, who normally would have to post more than a $500,00 bond if the property damage was north of that figure. That is a little low. But turn around and arrest their asses again, and the judge can revoke those previous bonds or increase the amounts.

This is what I am saying - If you have a fund, and lawyers, you don't need a bail bondsman, and I don't think they are using them. They are posting the bond through the fund. That means they lose nothing if the person doesn't skip. (not the 10% bondsman fee.)

But I also stated that I do not know how they are doing it, I just assume. I also do not know how things work in these states.

The problem with this - beside felony arson to known occupied buildings - even businesses - is 200K, not 50K, is the fact that it is known that well funded groups are bailing these arsonists out, putting them back out on the street, and they are committing arson again. If a judge is cognizant of that fact, there is no reason to set bail at the usual limits - in fact, a judge could actually suggest they be held without bail for a certain length of time until he or she is convinced that such felony offenders are not going to right out and torch the local Pizza Hut.

This was a real invitation for the Feds to swoop these idiots up and charge them in federal court...why this is being handled in local court is a mystery. Once the 2nd judge let them all out on the low end bail limit, the DOJ should have immediately charged everyone of them with felony arson, which they committed, and had them arrested and held, without bail, until a federal judge could be convinced they weren't going to go right back out and commit multiple felonies.

338 336 I'm more concerned about the PA Supreme Court ruling that unpostmarked ballots can be accepted up to 3 days after the election. They just fully opened the gateway to massive fraud.

344 So I said this would happen when I saw the original bail.
That bail was a message. They've spent almost a week in jail, which is a week longer than their comrades in Portland who got their picture made and were sent back out to rejoin the riot.
These people were given a taste. I'm sure for most of them it was the first time in their life that doing something stupid had consequences.
And they still have a court date and there will be more consequences, including a possible felony conviction that don't wash off.
I saw a story yesterday about one of the girls calling her dad from jail in tears. He was whining about how the bail was "excessive." Too much for Daddy to buy her out of trouble this time.
No, I don't think most of them will be back out there nor do I think the rioting will resume. The cops would be looking for them this time and there would be no bail.
