Supreme Court Rules 7-2 That The Little Sisters of the Poor Charity Does Not Have to Provide Contraceptives to Employees

I suppose that this counts as a "win," in today's debased, garbage-fire age.

The Supreme Court ruled Wednesday that the Trump administration acted within its authority when it expanded exemptions to the Affordable Care Act’s (ACA) requirement for employers to provide insurance coverage that includes contraception -- in a victory for Little Sisters of the Poor, the Catholic group that has been at the center of the national debate over the mandate.


The court ruled 7-2 in favor of the Trump administration and the Catholic charity that cares for the elderly in two related disputes against Pennsylvania, which sued over the validity of a rule from the Trump administration that allowed religious-affiliated groups and some for-profit companies to opt-out of providing contraception coverage to employees.

The majority opinion, written by Justice Clarence Thomas, ruled that the Trump administration's challenged rulemaking was aboveboard, and hailed the work of the Little Sisters of the Poor.

Yes, this is a win, but here's my problem: This was a win that required 1, a very sympathetic plaintiff, with 2, very good and free (I'd imagine) legal representation, and 3, the intervention of a sympathetic presidential administration.

What hope do the rest of us have?

38 Ostensibly this is a conflict between State and Church, when I think we all know now that this is really a conflict between the State Sanctioned Religion and a Church of the Old Religion which has fallen into disfavor. Think about why you'd insist upon nuns dispensing free contraception in the first place, and how exceedingly narrow an accommodation you could draw such that bona fide religious institutions engaging in charitable work would be exempt, and why it is that you wouldn't grant even such a modest exception. The State Religion wants to break the vestiges of the Old Religion by forcing the latter to violate its precepts openly in order to continue in existence. Can you name an enumerated, in-the-text Constitutional right that is as absolutely guaranteed as the penumbral right to an abortion? (well, perhaps a "gay" marriage) We've just been through a months long period when the State Religion shut down Churches of the Old Religion, prohibited all manner of elective surgical procedures (including my sister in law's radical double mastectomy and chemotherapy), but simultaneously ensured that abortions would be available on demand for this period.

Unrestricted and free abortion is more important to Ginsburg than anything else. No that's not quite right; she says taxpayer-paid and unrestricted abortion is more important than everything else. I hadn't appreciated her position fully until now.

The purpose of the Constitution - which I am pretty sure the SCOTUS is supposed to uphold - is to "secure rights to the nth degree." What an evil bitch.

The first amendment is already basically dead, and she wants to finish it off. There is almost nothing left of it as it is.
- Freedom of religion: nope, dead. Can't go to Church, have to bake the cake.
- Freedom of speech: nope, dead. You'll be kicked out of school, have your livelihood destroyed and be ruined if you say the wrong thing (and increasingly, if you fail to say the right thing)
- Freedom of assembly: nope, dead. Public health.
- Petition for redress: alive, but pointless. The elected officials have no power and those with the power answer to no one.
- Freedom of the press: only if you're part of the captive system.

She's just finishing what they started, I guess.

She's in some movies -- smaller projects than what she was in during her heyday. A particularly weird one was in 2017 -- The Killing of a Sacred Deer -- I do NOT recommend it. Greek director who says it is based on the ancient Greek tragedy "Iphigenia at Aulis" by Euripides, but it's just weird.

She's was also in the HBO mini series "Big Little Lies" (Season 1 was great; Season 2 basically sucked -- but she looked GORGEOUS).

She has another HBO mini series coming up -- "The Undoing," which is going to be released in the fall of this year.

I'm a fan so I'll definitely be watching "The Undoing."

I sorta treated lawnmowers like they were disposable equipment. Love not needing one anymore...

From what I recall, it's about the motor, not the label on the machine itself. Honda makes good engines. So looking for a mower with a Honda engine, including.. well, Hondas, is not a bad way to go.

They have declared that only John Deere can repair their products, and if anyone else does then its a violation of the warantee and deals with farmers. They went so far as to put a chip and GPS tracker in their equipment. You can't even try to repair it yourself.

It goes beyond that. They software-keyed numerous parts so you can't move a part from one machine to another to make a repair. A couple of outfits figured out how to reverse-engineer it (cleanroom style) to make used parts possible to use for repairs. Deere sued them into the ground for the effort.

That level of customer hostility took them off my list. I am not a farmer and will never need their big equipment, but I won't even buy a lawnmower from them. I don't want to do business with a company that views my status as their cash cow as more important than serviceability of major equipment.

The stance Deere took is "you bought the equipment and own the hardware, your only a licensee for the software, so we control the software and our rules must be followed or you are in violation, even though it restricts what you are permitted to do with the hardware."

The whole scenario begs for adjudication. I can't use the equipment without their software, and I can't load someone else's software onto it to work around their limitations. The software is truly integral to the hardware, and the hardware has no value without it. So by their argument, Deere's EULA prohibits me from extracting value from the hardware I own because of the software they own.

What really gripes me about all of that is that he pretended that he was saying something new. This was a HUGE topic of discussion in the 30's and 40's under FDR - the Socialist Left viciously criticized the "Negative Liberties" of the US Constutition, and wanted a Bill of Positive Liberties, based on the Soviet Marxist Constitution. They lost that fight, and America stayed America, not Marxist.

"Negative Liberties" - Limitations on Government Power, things the Government MAY NOT do.

"Positive Liberties" - things the Government HAS to do for you, thus by implication granting any Government full totalitarian power to justify enforcing those things.

More proof that the Left has not had a single original idea in over 90 years.

They have declared that only John Deere can repair their products, and if anyone else does then its a violation of the warantee and deals with farmers. They went so far as to put a chip and GPS tracker in their equipment. You can't even try to repair it yourself.

That is slavery, and we all agree that slavery is wrong.

Or, at least most of us agree that slavery is wrong. Some of us are still worshipping a slave owner/trader named Muhammad, and many are still turning a blind eye to the slavery still being practiced in many parts of the world.

330 The whole scenario begs for adjudication. I can't use the equipment without their software, and I can't load someone else's software onto it to work around their limitations. The software is truly integral to the hardware, and the hardware has no value without it. So by their argument, Deere's EULA prohibits me from extracting value from the hardware I own because of the software they own.

Starting with Brown v. Board of Ed, which was the product of a very deliberate strategy quarterbacked by Thurgood Marshall (say what you want about his dotage at SCOTUS, but he was a brilliant litigator in his prime), all the other major social movements where the Supremes moved the needle had these elements in them, and the respective movements on the Left - culminating with the gay marriage movement - successfully replicated that model.

Do we have a right to force others to clean water that wasn't corrupted by that group? No, definitely not.

Do we have a right to force others to clean up their shit when they dirty the water? Yes, I think so. You don't get to externalize your waste to innocent parties.

Of course, even this principle has its limits. I don't agree that the Hershey's plant has to scrub all of the chocolate smell out of their output and I don't believe that chemically pure water can't be dumped in streams simply because it's labeled as waste of an industrial process by the EPA.

Yes.. A "right" costs nothing from anyone else. I have the right to speak. It costs you nothing. You don't have to listen.

If you're talking about the provisioning of products or services, those have costs and cannot be rights. In our system, rights are guaranteed by the state. If you have a "right" to medical care, then the state has an *obligation* to provide it. But they can't. Some other citizen has to provide it. What if not enough people want to be doctors? The draft isn't out of the question.

So-called "positive rights" are a form of slavery. Probably not today, but it will become that eventually with perfect predictability.

Hondas are awesome. Tough as nails as far as lawn equipment goes. Yeah, you pay for it upfront, but the repair bills almost disappear. They are also well-designed.

Used them many years ago in a landscape business. (Still use them now.) They simply wouldn't break. Parts wore due to expected wear-n-tear, but the main components were diamond. They had good warranties, but that never came into play. The commercial products just didn't break down.

Regardless of the source of the moral impulse which I personally believe comes from the Lord, I once spent a year doing research by reading death penalty cases. The Supreme Court during death penalty sentencing allows almost ANY mitigating factor to be presented to the jury to stave off a sentence of execution. I found that even the sorriest individuals can and have done some kind things which kind of fits in with the whole New Testament theme of personal redemption is always possible if a person seeks it.

There were two religious freedom decisions today. The Little Sisters One was on contraception.

The other one, and the one I'm talking about, is if religious organizations are bound by employment discrimination laws.

They were both 7-2 decisions. Which, gonna be honest here, I thought would be 5-4 the other way so shows what I know.

When somebody is released from prison after years or decades due to being falsely accused and convicted, how much of the time is it a matter of law enforcement misbehavior as opposed to random accident? About always.

Anybody ever seen a bar association try to disbar a prosecutor who's busted screwing a case?

500 I like the Craftsman "commercial grade" push mower I bought. FWD (which I prefer) and 8.5 ftlbs (about 5.5 actual HP). It runs at a slightly higher RPM, and kicks the grass' ass.

You make a good point, about the front-wheel drive. Very useful for mowing under hedges and shrubbery. Let the power drive pull the mower under the hedge, and then bear down on the handles to lift the drive wheels off the ground, and pull it back for another pass. With rear wheel drive, you have to disengage the wheel drive to roll it backwards.

Back in the 60's and 70's, MTD was well-known as the builder of the cheap-ass department store brands of mowers, and also sold under their own name. And their stuff was uniformly junk, too.

It looks like they have upped their game considerably. Cub Cadet and Troy-bilt sell solid products.

505 I have to dissent on Honda mowers. Bought a self propelled walk behind about 7 years ago. The engine as everyone says is great, but it does a terrible job of cutting leaving uncut grass all over the place. (And yes I keep the blades razor sharp.) Seems like the deck doesn't generate enough suction to pull the grass up enough to cut cleanly. It only cuts tolerably well if I set the cut height much lower than it should be for healthy grass, and also walk very slowly. After I bought mine I started seeing similar complaints online. Maybe they have improved the design since then but I strongly recommend not buying unless you can get a trial period.
