The Morning Report - 5/22/20

Good morning, kids. Friday, and another grim milestone of yet another day of America held hostage.

Some good news as we head into the Memorial Day weekend. A Michigan County Court Judge has smacked down Wretched Whitmer's illegal order to forcibly shut Owosso barber Karl Manke's business. Underboss AG Dana Nessel said the decision would be immediately appealed, but as of now his shop is open for business. I would assume that the decision applies to all businesses, not just Manke's nor just barbershops (legal eagles in the audience please weigh in on this). That said, I don't know the makeup of the state's Supreme Court but if a significant swathe of businesses decide to open, a Supreme Court decision to reverse the lower court could touch off a firestorm.

Meanwhile, real science, growing evidence and the will of the people be damned, the dead-ender denizens of the Democrat collective gubernatorial fuhrerbunker are still hell bent on destroying their economies as a means of defeating President Trump at the ballot box - or the mailbox. It's a fools errand and the consequences of their actions may not be what they expect come November and into the future. Along with the smack down of Whitmer, Illinois fat-berg JB Pritzker sensing political blowback has withdrawn his emergency decree criminalizing business owners although a GOP lawmaker was forcibly removed from the state legislature for refusing to wear the useless, idiotic facemask. Let's face it; the only use they have is to keep the public terrorized into believing that they will either die or spread death if they go without it; a not so subtle reminder to obey or die.

Trump totally gets this, which is why he refuses to wear one in public and did not relent while heading to the embattled state of Michigan on a visit to a Ford plant. This drew a puerile response from AG Nessel who shrieked that Trump was no longer welcome to visit the state. Paraphrasing Democrat hero and role model Josef Stalin, "how many divisions does Dana Nessel have?" Michigan remains the focus because of a horrifying attack by a 20-year-old nursing home employee - no doubt Democrat and an SEIU member - who was caught on video beating a defenseless, bed-ridden elderly patient. The metaphor is self-evident: Democrat-Socialism and America or tyranny and liberty. Meh, those are redundant. Naturally, when the President called attention to this atrocity, Evita Whitmer instead attacked Trump for defiling her royal majesty by not wearing a facemask at the Ford plant.

Meanwhile, as Tom Wolf spouts the idiotic line of no freedom until there's world peace or a vaccine, and Wilhelm Klink DeBolshevik suddenly finds walls and fences quite effective when it comes to denying New Yorkers the freedom to go for a swim, Florida's governor Ron DeSantis is coming up looking like a champ. His decision to open the state caused him to be blood-libeled as a heartless mass-murderer, but weeks later, with essentially no spike in deaths or infections, you get crickets from the Democrat-Media Complex. And he's having none of it. From a political standpoint, I think this bodes well both for Trump's second term (please G-d) and for the post-Trump environment. This three-month (and counting) fiasco has seen vicious attacks on conservatives and Republican political leaders and like DeSantis, more of them are no longer bending over and taking it the way that Dubya used to do. We still have a long way to go in transforming the GOP-e into more of a Trumpian party, but the phony pandemic lockdown might be the spark that ignites that transformation, or at the least kicks it into overdrive.

With the coming of Trump in 2016 came one of the most significant changes in the course of American, as well as world history. Hence the attempt to sabotage the election and overthrow the victor that continues to this day. The "pandemic" such as it is opportunism in service to that end. No matter what happens come November, we cannot go on as before and we will not go on as before. I think we are approaching one of those moments that Winston Churchill so eloquently described on the eve of the Battle of Britain almost exactly 80 years ago:

...But if we fail, then the whole world, including the United States, including all that we have known and cared for, will sink into the abyss of a new dark age made more sinister, and perhaps more protracted, by the lights of perverted science.     55 Keep this in mind. One of our local supermarkets included in their announcement that not all people have to wear a mask. Some people have a "medical condition" that keeps them from wearing one.

    Google "medical conditions for not wearing a mask".

    Also, I believe the even the deplorable WHO still doesn't recommend you wear a mask unless you have COVID19 or are caring for someone who does.

    Also, many pediatricians recommend that children do NOT wear masks.

    Always an exception to the rule. Just sayin.

    114 Up in Maine we're still in lockdown in our 4 coastal counties. Just got notice that there are 57 new confirmed cases at a memory care facility a mile and a half from my house.

    The lockdown doesn't seem to have actually slowed the spread of the disease up here. All it's done is piss people off while taking resources away from protecting the assisted living communities in the state. It's been brutal on these places up here. The Veterans home in the next town over lost 5 of our nation's heroes in one day. And our milquetoast governor still insists on this lockdown farce even though it clearly isn't affecting the numbers.

    Had a meeting on a project site yesterday, outdoors in bright sunshine with about 5 people. Four were contractors, I'm an engineer, none of us are the warm and cuddly type so we naturally social distance. Masks were mandatory so I said fine get me one. I was going to tweak them at the end of the meeting by asking where their official bio-hazard disposal container was, but in this case the contractor is my client (mask rule was from project owner) and I didn't want to piss them off.

    Yes, he can seek revenge.

    Not only was Sullivan ordered, not invited, to respond, they cited the criminal justice code (which disallows amici) and Fokker which is precedent for the exec branch dropping a case and that's IT!

    The order from the higher court was in English:

    "When the govt drops a case it's over, you can't use amici in a criminal case. Now explain to us what the ever living fuck you THOUGHT you were doing, you nutball."


    His choices are to write his own brief AGAINST the higher court's own precedent in Fokker and the statute while looking insane. Or he can dismiss the case before june 1 and say, "sorry, my bad."

    He's off the case regardless, because once he writes that brief he becomes a litigant and can't be the judge.

    Let's assume the study happened *and* that it is accurate. I doubt both - particularly the latter - as time-to-lockdown and time-of-lift have *no* (get it?) correlation with infection, hospitalization or death rates. But let's throw you a bone on this one.

    NY, PA, NY, MI, IL governor *actions* - not inaction, but actual orders - resulted in at least 5,000 additional deaths among their nursing home populations. So, at the minimum, the actions of five governors are responsible for 15% of the total you mention here. And that took deliberate, conscious choice - not "inaction."

    The Left needs to be very careful if they go down this road.

    Yes. And recognizing that ordering sick people with a contagious illness that is extremely deadly to weak old people (which most nursing home populations are) back to nursing homes is insane. You don't even really need to study what's going on to realize that risk. I am glad he did, and FL's overall results have been very good, but for this issue you don't need to be a genius.     I wonder how W. Europe is going to handle this aspect, if at all. I didn't see paper towels in even one public restroom (office or restaurant or gas station, etc.) I have ever used in Britain or Ireland or Germany or Holland. It's all air dryers, usually the fancy ones you put your hands into like the Dyson.

    In Eastern Europe (small experience, only Bulgaria), it's either air dryers or nothing, but still no paper towels.

    I was going to buy that also, but I held off. I don't really find the 365 to have any EDC snag issues. Not sure if I would like "sighless". That seems like more of an EDC adaptation than the potential snag hazard. I did go for the GG upgraded grip module after one of the armorers at SIG recommended it.

    People don't realize how huge the arrest of Bryan for Felony Murder yesterday was. The Prosecution has now signaled that they are going "all in" on this case. I expect Bryan to now cut a deal in exchange for probation; he was the least involved of the three. All he has to do is say, in Court, "yeah we were trying to capture and hold him" and the McMichaels each do 15 - 20 years, guaranteed. I've posted elsewhere how the case and the charges are structured.

    The Prosecution added "Criminal attempt to commit false imprisonment" to the charges yesterday, which tells us their entire strategy. Looks unbeatable to me, especially if Bryan agrees to testify for the prosecution.

    Under Georgia State Law, someone has to witness the crime personally to qualify for citizens arrest, and it must take place at the scene of the crime. "Hot Pursuit" can only apply if they followed him continuously from the scene of the crime which they had personally witnessed.

    The perps themselves have already admitted these conditions did not apply; they had no legal right to make a "citizens arrest" under these circumstances, according to Georgia State Law. Which makes what they did Aggravated Assault. (or as introduced yesterday, Criminal Attempt to commit False Imprisonment)

    It is fantasy stuff, just like 2016 when some polls were claiming Hillary would turnout more voters than Obama did.

    To its credit - The Gallup id poll has been consistent in showing the gap between those who id as Republicans and Democrats is statistically even on average over the last year.

    So then it comes down to voter enthusiasm for each party, and independents. Both of which favor Trump and the GOP at this point. Biden is not going to turn out Democrats, and to replace him would be equally decisive. Better yet the more the swing state democrat governors keep things shut down the more it will GOTV for our side.

    Now watch the mail in ballots blow up in the Democrats faces unless they do some serious ballot harvesting and cheating, because old people always mail back stuff, and young people don't even know the USPS even exists.

    Note: I am still against mail in ballots because we know the Dems are using them to cheat, however, it would be funny if the Democrats blow that one too. We assume they are competent, like the old fashioned Democrats who knew how to cheat efficiently and not get caught.

    405 396 The nursing home holocaust continues. Doing Duck Duck Go searches I found 12,956 Covid-19 nursing home deaths in NY, NJ, PA,MI, and CA. All of these blue states had mandatory "take Covid-19 patients orders for their nursing homes." The MI totals of 1464 deaths were from only 4 counties in the state that a reporter was able to track down.
    So how many deaths does it take before somebody in the legal system notices?

    Clinton running in 92 was a great personal political move. He took advantage of a weak Dem field in which maybe some stronger candidates held off because Bush looked unbeatable in 90.

    425 On the Michigan barber story, the judge took the position that the State did not put forward evidence directly linking the barber's hair cutting and operation of his shop to an increased risk of coronavirus infection by his customers. The judge said the decision to stop the State was a "close call," so unfortunately, it may be a simple matter for the State to provide a study or something to create the missing link. On the other hand, so little is really known about the transmission of coronavirus (e.g., how long does it really live on surfaces, how long does it live in droplets in the air, what "viral load" exposure is needed to have a significant risk of infection) that the barber may have counter-arguments to show the States' shutdown of his business is unreasonably restrictive. In other words there must be a way for the barber to operate with safety precautions without totally shutting him down. I think the draconian restrictions the State is attempting to impose is an overreach. Any restrictions must be narrowly tailored to both ensure a reasonable level of public safety while allowing a business to operate. If grocery stores can operate, I don't see why a barber can't (even if he has to wear a hazmat suit).
