So, last night I finally watched the fantastic PBS show about Clarence Thomas.

They actually did an excellent job.

Please do yourself a favor and watch it. I think it may be on line for a few weeks over at PBS.

I only thought I had great respect for the man. I was wrong, it is now much, much higher. I teared up a couple of times. What a true patriot.


One thing: during the lying Anita Hill slander, they highlighed a particularly rancid and detestable article that came out in the WaPo, smearing Thomas at the height of the Senate hearings.

1) You can be a "publisher", in which case you have full control over (and full responsibility for) for what you publish. For example, a newspaper.

Note that the privileges and responsibilities are commensurate.

A newspaper could refuse to print anything, but if they printed libel, they could be sued.

The phone company was required to provide service to anyone with the money, and had no control over what was said. For instance, if someone planned a crime over the phone, the phone company was not responsible.

Twatter, et al, want full control and no responsibility, which is a recipe for abuse (likewise no control and full responsibility).

If we went back to the sane model of publishers and common carriers, the Twatters and Facebooks would probably opt to be common carriers (i.e., no censorship). If they opted to be publishers, and control what was being said, the lawsuits from the millions of copyright violations that take place on their platforms every single day would soon bankrupt them.

This was a good first step - they had the option of dismissing the filing without comment. And Judge Sullivan is gonna have to do some pretty fancy tap dancing to explain what he's done here, I imagine he's going to have Weissman writing all weekend to try and come up with an explanation.

An federal appeals court Thursday accepted Michael Flynn's request to have the district judge overseeing his case removed and has ordered that judge to explain why he has gone to such great lengths to avoid the Justice Department's request to dismiss the case.

A special three-judge panel has been appointed to review the matter. A June 1 deadline has been set to respond to the request. The Justice Department has reportedly also been invited to weigh in on the matter.


So what does this mean as far as Flynn goes? Is it going to a new judge now to rubber-stamp this, or is it waiting for June 1 for Sullivan to offer up a mealy-mouthed rationalization?

I was a big Morning Joe fan back then. Trump called in three times a week and they put him on the air. Other campaigns complained that they gave Trump too much air time and MJ would say here's our phone number. If you want your candidate on the air have him or her call in.

Trump provided content. None of the Dems or Reps called in because they were afraid of the gaffes. So Trump got heard three or four times a week.

The Federal Court System if very rigid and hierarchical. No one can just "ignore" an order from above, that'd be one of the few grounds for immediate "retirement". (If he ignored an order from above, everyone else could ignore his orders to show up in his courtroom)

Likewise, a fast hearing does him no good. The reason he set the next hearing off until July is that Sullivan's whole game now is to try and drag this out until after November, when he hopes a President Biden will reinstate the Prosecution.

Back in the late 80's I'd take all my employees out after a big job as a reward. Our book keeper had gotten a deal at the local comedy club in Mountain View, so the gang went on down Saturday night. One comedian absolutely killed, there's no way in hell he could do any of it today. That's right, it was Keenan. He did a bit called "Black Man" a super hero. Nobody was safe.


After we left the club on the way home on El Camino Real (like 2am and nobody on road) a little car pulls along side, and Keenan is screaming out the window, lost! We directed him to the 101. Something like 2 years later, everybody was watching ILC, and damned if that guy wasn't on TV now!
