Supreme Court Knocks Down Hawaiian Judge's Injunction Against Trump's "Public Charge" Rule Change;
Neil Gorsuch Slams Penny-Ante District Judges for Issuing Nationwide Injunctions, Legislating from the Bench
The"public charge" rule says that immigrants cannot be granted green cards unless they can show that they are self-sufficient and would not become public charges -- that is, dependents on the public fisc.
The old rule only looked at a few things to determine if someone would wind up a "public charge." The old rule absurdly did not examine whether the immigrant was currently on Medicaid, food stamps, or other forms of welfare. Doesn't that seem like the first thing you'd look at to determine if an immigrant would be (or already is) a "public charge"? Well, you would, unless, of course, it was your plan to socialize the United States by permitting in as many low-income, government dependent socialist-leaning immigrants as possible. Trump changed the rule to require examiningobvious evidence of someone's status as a "public charge," so of course the Sorosian Left went crazy and filed lawsuits everywhere.The policy in question would expand the government's ability to refuse green cards or visas for legal immigrants determined to be a "public charge," or dependent on public assistance. Those using or likely to use Medicaid, food stamps and other safety net programs would face greater scrutiny from immigration officials.
Should they not? District court judges -- the lowest judges in the federal system, ruling alone, rather than part of a panel of judges, from the bench -- have, as usual, claimed to have the power to issue nationwide or even "universal" or indeed "cosmic" injunctions against enforcement of the rule. Neil Gorsuch concurred with the judgement setting aside this claimed "universal" injunction, and then -- finally! -- ripped the Hawaiian judges presuming the authority to dictate the entire nation's laws from their dinky little bench.
His concurrence is here. Some choice language below:
Justice Neil Gorsuch in a blistering concurring opinion criticized federal judges who issue nationwide blocks on administration rules, potentially teeing up a wider challenge to the practice that has often stymied major parts of Trump's agenda and drawn scorn from Attorney General William Barr.
If some of this sounds familiar, it's because you've read about this unending game of district courts issuing nationwide, "global" injunctions and then Circuit Courts or even the Supreme Court staying those bullshit injunctions. Even the Ninth Circuit found the government was likely to win on the ultimate merits (which means that an injunction cannot be laid against them, as criterion one for an injunction in your favor is that you are likely to win on the ultimate merits. Now get ready for some Sauron-level snark from Justice Gorsuch, putting this dinky little New York district judge in his place for claiming to have Cosmic Power:
On October 10, 2018, the Department of Homeland Security began a rulemaking process to define the term "public charge" as it is used in the Nation’s immigration laws. Approximately 10 months and 266,000 comments later, the agency issued a final rule. Litigation swiftly followed, with a number of States, organizations, and individual plaintiffs variously alleging that the new definition violates the Constitution, the Administrative Procedure Act, and the immigration laws themselves. These plaintiffs have urged courts to enjoin the rule’s enforcement not only as it applies to them, or even to some definable group having something
to do with their claimed injury, but as it applies to anyone. These efforts have met with mixed results. The Northern District of California ordered the government not to enforce the new rule within a hodge-podge of jurisdictions--California, Oregon, Maine, Pennsylvania, and the District of Columbia. The Eastern District of Washington entered a similar order, but went much farther geographically, enjoining the government from enforcing its rule globally. But both of those orders were soon stayed by the Ninth Circuit which, in a 59-page opinion, determined the government was likely to succeed on the merits. Meanwhile, across the country, the District of Maryland entered its own universal
injunction, only to have that one stayed by the Fourth Circuit. And while all these developments were unfolding on the coasts, the Northern District of Illinois was busy fashioning its own injunction, this one limited to enforcement within the State of Illinois.
He says these arguments are "well-rehearsed" not as an insult to the goverment, but to the judges issuing these stays -- because these judges should have read the dozen prior rejections of these "global" injunctions. They are just forcing the government to return to court, in dozens of courts, to make the same legal arguments. Legal arguments that always win. Not that the Hawaiian judges care about the law. They're just legislating here.
If all of this is confusing, don't worry, because none of it matters much at this point. Despite the fluid state of things--some interim wins for the government over here,
some preliminary relief for plaintiffs over there-- we now have an injunction to rule them all: the one before us, in which a single judge in New York enjoined the government from applying the new definition to anyone, without regard to geography or participation in this or any other lawsuit. The Second Circuit declined to stay this particular universal injunction, and so now, after so many trips up and down and around the judicial map, the government brings its well-rehearsed arguments here.
I've never heard of a "cosmic" ruling. I think he's being sarcastic in mentioning the so-called "cosmic injunction," to ridicule these Hawaiian Judges' delusions of grandeur.
Today the Court (rightly) grants a stay, allowing the government to pursue (for now) its policy everywhere save Illinois. But, in light of all that's come before, it would be delusional to think that one stay today suffices to remedy the problem. The real problem here is the increasingly common practice of trial courts ordering relief that transcends the cases before them. Whether framed as injunctions of
"nationwide," "universal," or "cosmic" scope, these orders share the same basic flaw--they direct how the defendant must act toward persons who are not parties to the case.
This is a very important point, because Article III courts -- the independent judiciary specified in the Constitution, as opposed to Article II (executive) courts like courts martial -- are only permitted to rule on actual, real "cases and controversies." They cannot rule on abstract issues, render advisory opinions about how they might rule in the future, or rule about parties not before them.
Equitable remedies, like remedies in general, are meant to redress the injuries sustained by a particular plaintiff in a particular lawsuit. When a district court orders the government not to enforce a rule against the plaintiffs in the case before it, the court redresses the injury that gives rise to its jurisdiction in the first place. But when a court goes further than that, ordering the government to take (or not
take) some action with respect to those who are strangers to the suit, it is hard to see how the court could still be acting in the judicial role of resolving cases and controversies.
They just have no power to do so. Doing so violates their grant of power under Article III.
Thus, why so many Hawaiian Judges wind up ruling on these things -- leftwing plaintiffs are forum-shopping for the most leftwing, and indeed unethical, judges.
Injunctions like these thus raise serious questions about the scope of courts' equitable powers under Article III. [Citations omitted.]
It has become increasingly apparent that this Court must, at some point, confront these important objections to this increasingly widespread practice. As the brief and furious history of the regulation before us illustrates, the routine issuance of universal injunctions is patently unworkable, sowing chaos for litigants, the government, courts, and all those affected by these conflicting decisions. Rather than spending their time methodically developing arguments and evidence in cases limited to the parties at hand, both sides have been forced to rush from one preliminary injunction hearing to another, leaping from one emergency stay application to the next, each with potentially nationwide stakes, and all based on expedited briefing and little opportunity for the adversarial testing of evidence. This is not normal. Universal injunctions have little basis in traditional equitable practice. [Citation omitted.] Their use has proliferated only in very recent years.
... The rise of nationwide injunctions may just be a sign of our impatient times. But good judicial decisions are usually tempered by older virtues. Nor do the costs of nationwide injunctions end there. There are currently more than 1,000 active and senior district court judges, sitting across 94 judicial districts, and subject to review in 12 regional courts of appeal. Because plaintiffs generally are not bound by adverse decisions in cases to which they were not a party, there is a nearly boundless opportunity to shop for a friendly forum to secure a win nationwide.
What could the Supreme Court do? Well, one thing it could do -- and might eventually have to do -- is issue an order that no injunctions affecting immigration is to be granted any effect or dignity until it is confirmed by, say, an en banc review from the Circuit Court sitting in review. In other words, an automatic pre-emptive dismissal. I would say this is a shot across the bow, a last warning: Stop issuing "cosmic" injunctions, or we'll clip your wings forever. It is high time to end the Tyranny of the Hawaiian Judges. And now, I need a cigarette. Well, not a cigarette. But a nice strong vape.
And the stakes are asymmetric. If a single successful challenge is enough to stay the challenged rule across the country, the government's hope of implementing any new policy could face the long odds of a straight sweep, parlaying a 94- to-0 win in the district courts into a 12-to-0 victory in the courts of appeal. A single loss and the policy goes on ice— possibly for good, or just as possibly for some indeterminate period of time until another court jumps in to grant a stay. And all that can repeat, ad infinitum, until either one side gives up or this Court grants certiorari [that is, grants a review]. What in this gamesmanship and chaos can we be proud of?
I concur in the Court's decision to issue a stay. But I hope, too, that we might at an appropriate juncture take up some of the underlying equitable and constitutional questions raised by the rise of nationwide injunctions.
Princeton can use a man like Neil Gorsuch.

I had one case in which the applicant was sponsored by his family who were on welfare. I didn't issue the visa.
I got calls and letters from his congress critter, and I both spoke about, and sent him a cable referencing the exact Standardized Regulations for immigrant visa issuance, that in fact meant I could not issue the visa.
The immigration lawyer called me and said that this applicant HAD to come, because he was going to work to support the family. I told him that's not how this works, and I will be happy to contact the constituents of the congress critter and ask them how they feel about this situation.
I was not well liked at State.

I agree, it would take an order from the court limiting the reach of any lower court decision. One good reason the SCOTUS is likely to move to this is that right now, they are stuck having to whack 2 dozen moles every time a new administration policy comes out, when there are many other cases that they would prefer to spend their time on.

Not just federal judges. I've met some at the state and local levels, too. The good ones you'd never know were judges unless a friend referred to them as one. The bad, power-hungry ones never let you forget their title.
They're almost as bad as the (usually) black women who've received Ph.D.s in Education from some piss-poor excuse of a university and who insist on everyone referring to them as "Dr. So-and-so."

Yep, the law (saying that immigrants can't get green cards if they are public charges) is decades old and obviously common sense, and the Trump administration jumped through all the necessary administrative hoops (e.g., months-long period of public comments on the proposed new rule, etc.) to revise the rule to consider the many current types of welfare that immigrants can access.
Yet despite all that, and despite the fact that the U.S. has $22 trillion in public debt, is running yearly trillion dollar budget deficits, has hundreds of trillions more in unfunded liabilities, and spends hundreds of billions of dollars every year providing "free" public school education, ER treatment, food stamps, lawyers, translators, etc., to tens of millions of illegal aliens who swarm across our borders and violate our laws, the left is still apoplectic that Trump is trying to ensure that legal immigrants can't live indefinitely in the U.S. on the backs of U.S. taxpayers.
It's insane.

If there's a direct SCOTUS order on a matter, then any lesser court injunction can be safely ignored and treated as void. For example, the injunction against the policy in question here is now void.

Lower Courts are created by the Congress, they are not created by the Supremes.
Thus, the ONLY Court which should be able to 'Judge' the President's actions, are the Supremes themselves.
IMO NO lower Court, should be able to stop a Presidential order.
Then when you add in that all Lower Courts are created by the Congress, and then staffed by Judges confirmed by the Senate, it leads to the question of 'are they really independent?'
Could a Judge who is NOT enamored of the Power of the out of control Legislature, get the Job of Federal Judge?

I was a little bit of a debbie downer about this yesterday because all it does is basically affirm an existing law and it's for people who are already compliant. Legal immigrants can't get permanent residence if they're going to go -- stay? -- on welfare.
Meanwhile, millions are overstaying visas or crashing the border and getting all the free helpin's a state will give them.

There's one possible method of dealing with it that doesn't rquire a USSC ruling. If some local judge applies a nation-wide injunction, the government should force the case to come up in a more sympathetic district. AFAIK, there's no reason why a local judge in a different circuit can't say " The judge who issued the nation-wide injunction has no standing in this circuit. As such, it doesn't apply here. We can't find any issues with the law as written, and it will be in full force in this district."

Once the economy collapses, the argument goes, so many people will ALREADY be on welfare that they will demand a total restucturing of the economic system similar to the "iron rice bowl" under Mao in which everyone is automatically guaranteed free housing, food and health care, supplied "free" by the government. Thus, the economy would become a socialist/communist economy, without there being a bloody revolution to install it.
Obama openly embraced this strategy, opening up Food Stamps to all comers with no eligibility checks, and so on. But Trump appeared and up[set the apple cart by bringing out near Total Employment, which is the Worst-Cae Scenario for the Cloward-Piven strategy. So: How can they continue to push the US toward bankruptcy if we have total employment here? IMPORT COUNTLESS NEW WELFARE RECIPIENTS FROM THIRD-WORLD COUNTRIES, not because of empathy for them, but because we're trying to squander all our cash as pointlessly as possible.
Trump saw through this and tried to stop it. Communist judges tried to stop him. SCOTUS just stopped them from stopping him. Boom.

I was a jurist in a federal trial. The plaintiff's attorney was terrible, he was like Democrats at this impeachment farce and just kept repeating the same weak points over and over and over for four days.
After the trial and our deliberations which only took the 45 minutes we were given for lunch the judge invited the jury to his chambers where we all, including him, spent the next half hour laughing at the attorney. I'm sure it was unethical but holy shit did that lawyer suck.

I took a brief ethics class from Judge Ed Kincaid, a Federal District Court Judge in north Texas. There were about 200 people in the class, and as we filed in he had a roster and he made sure to shake everyone's hand and match a name to a face as we filed in. Took a while, we were surprised he wanted to do it.
After that, without ever looking at any of his rosters again, he addressed everyone by name when calling on them. He'd memorized all 200 names and faces in that one pass.
I have a decent memory, but something like that is so far above my abilities that I was gobsmacked.

I think the other thing is that Trump is pushing a paradigm shift on the purpose of immigration. The Left has successfully redefined immigration to be about us owing outsiders a better life. The whole 'give me your tired, your poor' / welfare version of immigration; we're here to take care of the least capable and neediest of the world.
Meanwhile Trump is restoring the idea that we offer outsiders an *opportunity to make a better life for themselves* and as such, we need to vet these people to (minimally) be capable of making a life for themselves. We want people that will help America be great, not those who need to be taken care of - what a concept.

He is not their boss. They are appointed and confirm for life tenure to be independent. They can be impeached, and it is a remedy for out of control judges that is not used often enough.
The SCOTUS need only issue clear guidance as to when, in limited circumstances, a nationwide junction is appropriate. It looks like they punted here, in favor of a weaksauce, "Please stop."

For me, the best was Jose Andres, a Spanish brand, made by the celebrity chef of the same name.
Various British brands scored high as well. Amazingly, the Tesco house brand (considered totally generic in the UK) scored very high.
In the US, I think Kettle was about at the top, taste-wise. I also liked Tim's Cascade chips.

Seriously, lower court judges are bound by precedent, and precedent issues from opinions by a majority of the Supreme Court. Chief Justice Roberts cannot issue any dictats to lower courts about deciding cases, and several circuits have precedent allowing these nationwide injunctions. It's been an issue since GW Bush, really, and wasn't unheard of with Obama either. It's a universal problem that the entire Court will have to weigh in on at a later date.

I cannot believe they're worried about being prosecuted for violating executive privilege laws or agreements if they publicly say PDT abused his power, and can back up their assertions. It is a story of Neo falling into madness and slowly coming out of it, back into the world as it appeared to be in The Matrix. It isn't exactly the same and he has trouble coping at first before falling back into the rhythm of things.
In the third act, he gets a voicemail from his doctor, telling him he needs to come in for a checkup after his accident. He then has a series of flashbacks in which he remembers that we has in an automobile accident and comatose for several weeks.
He goes to see the doctor and on the doctor's desk is a snow globe of the "real world" from the Matrix - dark, foreboding, robo-squid, etc. - and the brass plaque on the base of the globe says, "The Matrix."
And then play theme from Saint Elsewhere over the end credits.

Anyone who is approaching levels of 29 to start thinking about Medicare should set up a trust and move all their assets into the trust because there is a five year look back period where Medicare can claw back anything put into the trust.

My hope is one more appointment in the Alito/Thomas/Gorsuch mode will anchor Roberts (Kavanaugh too if necessary) to an Originalist majority. My impression of Roberts is that he doesn't like being in the minority.
A second appointment would keep such a majority solidly intact.

Anyone who is approaching levels of 29 to start thinking about Medicare should set up a trust and move all their assets into the trust because there is a five year look back period where Medicare can claw back anything put into the trust.

Grandma had dementia and Mom kept pushing for grandpa and grandma to do this. G+G had spent a lot of money over the years supporting my aunt and uncle and cousins, and mom pointed out that Medicare would look at this and could demand that clawback. It ruined a lot of relationships in the family.
When grandma started having microstrokes in late 2017 and had to go into hospice care this became an issue for us. Mom didn't go back often to see her because things were so ugly between mom and my aunt/grandpa.

This impeachment theory is really not different than the immigration BS that came up earlier in the administration.
At that time, Hawaiian judges said that banning certain immigrants was illegal, not because the act was illegal, but because Trump was a racist and wanted to do it for racist reasons. They were judging his actions based on what was in his mind. This is same with the impeachment, where they say probing corruption may be good, but Trump was doing it for selfish reasons.
This is really an advanced (progressive?) legal theory -- that people can be judged, and laws written, and people convicted, not based on their actions but on their thoughts. So doing something legal can become illegal if you have wrong-think.
Just saying.
It's an extension of "hate speech" where there at least you can say it is incitement, or maybe harms another even though that is it's own BS theory. Speech is protected, PERIOD. But the left got away with that, and now they extend it to executive orders, and now foreign policy.

Trump proposes Palestinian state with capital in east Jerusalem

President Trump on Tuesday outlined a surprisingly serious peace plan to resolve the Israeli-Palestinian conflict.
Analysts expected a plan heavily weighted toward Israeli interests and thus likely to receive unequivocal Palestinian rejection. But this isn't that. Trump's proposal has issues, but it does chart a four-year path toward a two-state solution.
Supported by Israeli Prime Minister Benjamin Netanyahu and his primary challenger in March elections, Benny Gantz, it calls for a freeze on Israeli settlement construction in the West Bank. That is a significant concession that will aggravate the Israeli hard-right. Muslims would also be assured of access to the al Aqsa Mosque under continuing Jordanian-led custodianship. And Trump is promising that Palestinian-controlled territory will double in size under this deal. A tunnel would also be built to connect Gaza with the West Bank. And, joining with a previously outlined plan, the Palestinians would receive up to $50 billion in economic investment. They would also gain access to Israeli port infrastructure.
On the Israeli side, the Jewish state will gain control over the Jordan River valley: a prerequisite of Israel's long-term security strategy. In return for land swaps, Israel would also receive sovereignty over major settlement blocs in the West Bank. This was always going to be a part of any deal, and everyone who cares to be honest knows it.

I don't consider myself a particularly stupid person, but I could not digest a ruling like this and then turn around and succinctly explain it so that readers would know the principles and stakes at hand. "Ace-splaining," as it were.
It is utterly beyond me. But I'm glad it's not beyond the Boss.

late 70s early to mid 80s
The influx of arabs and other middle easterns and what they referred themselves as.
Persians. Didn't seem to matter what country they were from. In college in early 80s there were arabs from all over the place (I know I know, Iranians ain't arabs). Lebanese that whose families were opposite sides of the greenline in Beirut were best friends over here. I ranians didn't mess with Iraqis and vice versa over here. Libyans were fine.
Syrians never got along with anybody but nobody cared. But I do recall Jordanians would flip flop between Palestinian, Jordanian and Persian depending on who they were talking to.
