Mistakes Were Made: Ted Cruz Obliterates the FBI For Willful, Deliberate Forging of Evidence, Frauds on the Court, and Framing An Innocent Man Serving as a Source for the CIA as a Traitor

Acrually, he just repeated what was in the report, which Sean Davis and Mollie Hemingway already wrote about a day or two ago.

But we know that most people in the media do not read, ever, and so Ted Cruz's televised interrogation is probably the first time they've heard these facts.

Cruz noted two deliberate frauds -- perjuries -- obstructions of justice -- perpetrated on the FISA court.

The first was that the FBI actually had contacted Steele's primary source -- who they call the "primary sub-source," because Steele, who knew nothing about anything, was considered the source itself -- and that primary sub-source completely repudiated all the claims that Steele had claimed he'd made, telling the FBI that the Steele was exaggerating some of the things he said, making up other things, and in other cases passing off things said in jest or as barroom rumor-mongering and speculation as "verified information."

Rather than inform the FISA court that Steele's "dossier" had been completely repudiated by the very source Steele himself claimed knew where all the bodies were buried, the FBI instead told the court that the primary sub-source had been "verified as honest and reliable."

Why did they say that? Well, apparently, they took his saying "all of that is bullshit" as an indicator of honesty and reliability, and reported he was such to the court.

But they forgot to tell the court that the thing he had been verified as "honest and reliable" about was calling the Steele dossier a parcel of lies. Instead, the FBI led the court to believe that he was "honest and reliable" about the things Steele claimed he'd said, which he himself denounced as either said in jest, or as gross speculation, or as simply untrue.

This is obviously the kind of fraud that people go to jail for.

Not DOJ employees, though!

But that was just his first point. The second point was this: Carter Page probably, at some point, told one of the spies assigned to him that he actually was a source for a US intelligence agency. I've heard the CIA, but no one is confirming that, and maybe it's the Naval Intelligence Service or something.

Why is this important? Well, if he's actually an asset for the CIA, that makes it pretty understandable why he's talking to Russians -- CIA assets often talk to Russians. That's what the CIA asks them to do.

And this is patriotic service, not Treason, as the FBI would then characterize it.

Realizing that they had a major problem on their hands if this were true -- because they're golden evidence that "Page has been seen talking to Russians" is not at all incriminating if he's a CIA (or NIS, etc.) asset -- the FBI or DOJ wrote to the intelligence agency and asked, "Is Carter Page a source for your organization?"

And that intelligence agency said: "Carter page is a source" for our organization.

So that's a big problem. If Carter Page is a CIA/NIS asset, then they can't use his contact with Russians as evidence for a FISA warrant against him.

So what's the DOJ/FBI response?

Well, a lawyer there -- Kevin Clinesmith -- deliberately changes the response of the organization from "Carter Page is a source" to "Carter Page is not a source," and sends this forged, fraudulent evidence along to the court as part of the FISA application.

This is CRIMINAL. They were specifically told by the agency involved that Page was a source and therefore had a very good and legal reason to have contact with Russians, but this guy forged the email, altering it to say he was not a source and so reported to the court that Page had no good reason to talk to Russians.

And here's the kicker:

He still works for the FBI!

Because of course he does.

Because Christopher "Straight-Shooter" Wray.

The 476-page report from Department of Justice Inspector General Michael Horowitz found that the FBI falsely claimed to the FISA Court not only that Carter Page was a Russian agent, but also falsely claimed that an unnamed intelligence agency had told the FBI that Page was "not a source" in their efforts to surveil and curtail Russian intelligence efforts.

Ahead of an application to renew the spy warrant in 2017, a top FBI lawyer doctored evidence from the unnamed agency which confirmed that contrary to FBI claims that he was a Russian spy, Page had in fact assisted the United States in its efforts to counter Russian operations. An e-mail from the agency that clearly stated Page was "a source" for them was doctored by Kevin Clinesmith, a top FBI national security lawyer, to give the opposite impression to the federal spy court.

"The [Office of General Counsel] Attorney altered and sent the e-mail to a [supervisory special agent], who thereafter relied on it to swear out the third FISA application," the IG report notes. Upon learning that a top FBI lawyer doctored evidence against a former Trump campaign affiliate to justify spying on him, the IG referred the attorney to DOJ for criminal prosecution.

Text messages from that same lawyer after the 2016 election revealed that he was an anti-Trump activist. "Viva la Resistance!" he texted on November 22, 2016, while in the midst of investigating Trump. He would later be terminated from the Mueller probe for conduct which a previous IG report said "brought discredit" to the FBI. Of FBI documents he approved authorizing spying on Trump campaign, Clinesmith wrote "[M]y god damned name is all over the legal documents investigating his staff."

"[W]ho knows if that breaks to him what he is going to do," Clinesmith continued, apparently worried about the ramifications of his illicit behavior against the Trump campaign.

Below, Ted Cruz asks Horowitz about this second point.

Which Horowitz says does not indicate "bias."

If the warrant authorizing surveillance was fraudulently, corruptly, criminally procured, what does that make the subsequent surveillance?

It makes it illegal spying.

No but seriously: National Review is covering this to the same extent CNN and MSNBC are. In other words, they're embargoing a story that hurts their Orange Man Bad feelings.

As regards the incredible corruption disclosed by Horowitz and the dramatic confirmation of his report on live TV: Meh, not so important.

Always remember who it was in the alleged "conservative" media who swore up and down for the absolute, unquestionable integrity of their Deep State friends and sources, as well as for the truthfulness of their ally Adam Schiff.

And remember the people who were open to doubting the alleged LG Paladins of the Deep State.

This would be the one I would watch for an indictment on. Not much gray area there.

But I think he is biased and dumb.

He didn't do this on his own accord. But he may not have proof that he did it on his own accord.

The Dilbert interview linked on the sidebar was OK, but he is too full of himself and has a nasty habit of arguing in bad faith.

1. He claims that incompetence explains everything. Well, sure people stretch the truth to justify what they want in a big organization but (a) their boss stomps on that shit, and (b) this was not justifying a new copier, but investigating a political campaign. There are rules and people go to jail for not following them. This whole line of argument was weird since yes, you do expect some bias in someone trying to do a job (start an investigation) but you also expect bias on the other side and in fact you expect more incompetent and lazy people would not want the hassle of getting into a political investigation.

2. If the risk analysis means you investigate the slightest hint of foreign influence, well sure if you think Trump was a manchurian controlled by the Kremlin but that is nonsense. Did anyone outside the lefty fever swamp think that was even a 1% possibility? How would that even work since he has limited power as President and if he did anything stupid like try to give Alaska back to Russia he would have Congress to check that. And why not investigate Biden, Clinton, Clinton, Gore,.... for all their Chinese cash and deals. Was something overheard in a bar worthy of an investigation, but not all the hard facts surrounding dem. corruption?

3. He made it sound like there were only two option -- a bannanaa republic style coup, or FBI people doing an honest job. No one said it was a coup where they take over the Palace and have a team go to the state radio station and make an announcement. But he said that since they were not having meetings on the sly and organizing each step to make it happen it was not a coup and so they were just doing their jobs (incompetently and with some (maybe) bias).

Well, when people talk of coup they mean the investigation and prosecution was aimed at removing Trump from office for no legitimate reason. That is what they were doing, and that is a coup. If they were investigating him for actual crimes (or things they thought were actual crimes,) then sure maybe they would have done the same with other candidates or Presidents. But they were making it all up because they did not like the guy. This was a coup attempt.

As for the crimes evinced in the report, that's up to the US Attorney's office in DC (I imagine, maybe Eastern District of Virginia), to prosecute or not.

He definitely WAS a FBI source. In, I believe, May of 2016 he helped the FBI arrest a Russian agent in the US.

So, I'm imagining, in the FBI's mind when he entered the Trump campaign it was an 'AH HA' moment and easy way for the FBI to surveil "him and anyone that came in contact with him", i.e. Trump campaign staff. I don't think he was in cahoots with the FBI though.

No, it only applies in criminal prosecutions. Impeachment is constitutionally a separate animal entirely. It is a process that is beyond court review as a "political question."

THat's why the House can make up bullshit rules like "Rs get 2 minutes for witnesses" and such. There is no due process, only the bare bones of procedure in the Constitution. That's why the Senate has to convict by 2/3.

It's meant for truly treasonous or tyrannical presidents to be removed from office. Not penny-ante crap like this. That's why Johnson's impeachment failed. Everyone in DC hated him, but actually throwing him out of office was still a bridge too far.

The amazing thing about this recent turn of events is that the conservatives and the liberals have completely reversed their view of government over your time of service.

40 year ago, Hollywood was making conspiracy movies that had the CIA and FBI as bad guys, and liberals ate them up. The entire time, conservatives were sticking up for the establishment. It used to be that way but the conservative (police-friendly) Rehnquist court largely hollowed out the doctrine by creating so many exceptions to it that, as they say, the exceptions swallowed the rule.

If they were accidents, there should have been variance of direction from the baseline. In other words, if perfectly distributed, half of the errors should have favored Trump and the other should have gone against him.

In this case, there were 17 "errors." Every single one of them went against Trump. It is, therefore, very unlikely that these were "errors." I think in this case if I remember my college math (and I probably don't) it would be 0.5 (odds of an error going against Trump) raised to the power of 17 to find the odds of this many consecutive "errors" in the same direction actually being accidental.

That is something like 0.00077%

Odds of hitting the CO state lottery are worse than that by a wide margin.

But neither is likely.

If they were accidents, there should have been variance of direction from the baseline. In other words, if perfectly distributed, half of the errors should have favored Trump and the other should have gone against him.

In this case, there were 17 "errors." Every single one of them went against Trump. It is, therefore, very unlikely that these were "errors." I think in this case if I remember my college math (and I probably don't) it would be 0.5 (odds of an error going against Trump) raised to the power of 17 to find the odds of this many consecutive "errors" in the same direction actually being accidental.

That is something like 0.00077%

Odds of hitting the CO state lottery are worse than that by a wide margin.

But neither is likely.

Which why I keep syaing to start releasing these things without a summary. Make people read the report, and not the summary that is written to provide a spin the evidence doesn't support.

Understand fellow morons, that nothing the House or Senate do in an impeachment process can be unconstitutional, so long as the House indicts and the Senate convicts by 2/3. Nothing. They literally set their own rules as they see fit.

No Supreme Court imaginable would get in the middle of that. It's like when Hitler asked how many divisions the Pope had. In reality there is a 0% chance that teh Senate will convict Trump. Period.

If we had such a division in this country between legislative and executive branches that they removed the president because of personal distaste for him or his policies, we would want a new election anyway.

I'm sure he tells himself he's being neutral and aboveboard, and that's his job, but at some point, and we are there, the evidence is so overwhelming that not to draw the obvious inferences becomes aiding and abetting. I don't think Horowitz is necessarily trying to protect people, but that's certainly how it comes across, and in a situation like this, that's deadly.

There's a kind of bias that is subtle and quieter than most, in which you make choices between two possibilities, always in one direction until the cumultive effect is overwhelming. Each step is mild enough: which adjective do I use, how do I portray this, which conclusion should I reach? But its still bias.

Refusing to specifically and clearly note wrongdoing and bias when its obviously there isn't some kind of job restriction, its a choice.

Yes.

Horowitz was very constrained because he's an Internal Affairs guy and can only go so far. I dig it. Going as far as he could, he found a lot of bad shit. I dig that, too.

But he then concludes in his summary - the part written essentially for the press to go spin - that there was a process control problem at the FBI and recommended training and better directorial oversight.

I don't dig that. Not even a little bit.

Well as far as father of psychology goes the field has gone through a series of quacks who have reinvented it each generation(and consequently aren't based in his theories). The phrenologists and other quacks predate him on that front. Saying he invented therapy seems fair.
