The Morning Rant

talking ape.jpg
"Wednesday's "expert testimony" from some law profs in front of the House Judiciary Committee can be summed up like this:

Prof. Noah Feldman: "Orange man bad!"
Prof. Michael Gerhardt: "Orange man bad!"
Prof. Pamela Karlan: "Orange man bad! And my womb is barren. As in Barron Trump. Ha ha. Get it? But serious you guys, orange man bad!"
Prof. Jonathan Turley: "Orange man bad, maybe, but not impeachable."
Prof. Pamela Karlan: "I would like to say 'orange man bad' again."

"This is their best case? A bunch of professors who didn't actually witness anything? One of the reasons why they don't get laughed out of public life is because of the compliant, supine media. With nothing to keep them in shape, the Democrats have gotten all fat and flabby, and they really do think no one can see their shoddy merchandise for what it is. And then they get indignant when the shoddiness of their merchandise gets pointed out.

"I think the Republicans on the committee did a good job exposing these "witnesses", especially Karlan, as pretty much being Democratic activists, and not the Olympianly detached and neutral legal experts that the Democrats were attempting to pass them off as.

"This leads me to wonder how these impeachment proceedings would go if they took place during the time of Nixon's impeachment, the mid 70s. There would be no internet, no CNN, no C-SPAN, and there would only be the WaPo, the NY Times, and the 3 "alphabet" TV networks (ABC, NBC, CBS).

"All the Democrats would have to do is bar all TV cameras and limit coverage to only allow newspaper reporters, who could spin this story any way they wished.

"My guess is that they would present the profs as neutral experts, just like the Democrats would like. Republican challenges to this narrative would simply be ignored. All the big newspapers were liberal, even back then, except for the editorial page of the Wall Street Journal. But the Democratic narrative would be pushed out to millions of Americans via TV news every night.

"I think the main game-changer here was the advent of C-SPAN. I think Americans need to know how their government that they pay taxes for functions, and C-SPAN provides that service well.

"My conclusion is that C-SPAN is a national treasure."

Karma's A Bitch: Cancel-Culture Enthusiast Gets Cancelled:

I'm not altogether happy about this. Yes, this psychopathic rage-monkey woman reaped what she sewed, the evil that she sought for another fell upon her, she fell into the pit she dug for another, the hand grenade went off in her own hand, etc., and that's a good thing. She's basically a terrorist who got blown up by her own IED. But I really don't like the idea of calling up somebody's employer to get her fired for reasons completely unrelated to job performance. I don't like cancel culture, and there's no good end to it. But I'm not a pacifist; I don't think we should back down in the face of such aggressive bullying. Cancel me? Cancel you, bitch.

Part of the problem is the merchants and proprietors of the shops where these incidents typically occur. Where was the manager of the Starbucks when this unhinged lunatic cut loose? That's the question I ask whenever I hear about these public meltdowns. The crazy woman should've been firmly escorted off the premises by security or by the local police, and told her business was no longer welcome. But this would require courage to treat a progressive whacko the same as a drunk or unruly customer, and in deep blue Palo Alto, CA, perhaps that kind of courage is in short supply.

Wednesday's Celebs: Leslie Parrish was the love interest in Manchurian Candidate (1962), which, in my opinion, is one of the best movies ever filmed. That's why I greatly resented the 2004 remake, and refused to see it, as it could only be inferior. But I won't hold it against Liev Schrieber for being in it, because actors gotta eat, same as everybody else.

16 Price transparency is an absolutely vital step on the path of fixing our medical system. Enforcing antitrust law to do away with opaque "how you pay determines what you pay" policies (which are illegal) would be a great combination.

Those two alone would basically fix the problem. There's always more to do, but transparent and consistent pricing with no chicanery, and a menu of all services available on-demand and conspicuously posted on their websites would get competition back into play in a damn hurry.

49 "Prof. Jonathan Turley: "Orange man bad, maybe, but not impeachable."

Turley was somewhat praised by "conservative" voices for being the sane one, but even he said Trump's conversation was wrong, just not impeachable. There was nothing wrong ... a coup run out of Ukraine is wrong ... Biden, Kerry, McCain ... many others taking millions in graft out of Ukraine (and China, Saudi Arabia, etc.) is WRONG.

Stopping the graft machine that sells America piecemeal is essential ... and Trump is the one to do it, even as our intel community runs their silent/covert coup against him (and US).

Turley's statement was also fully partisan ... it is not wrong to stop the DC Graft machine ... Turley voted Hillary, Queen of graft (and murder?, and God knows what else). Turley is no hero, he just refused to fully join the coup, so he could remain standing after it failed.

67 I realize that actual logical discussion of the substance of an issue is now deemed archaic and boring - all that matters are ad hominem matters and arguments from authority and every other item in the fallacy menu - but did any of the GOP, or Turley, make the only really relevant point in all of this - that exercise of constitutional executive authority cannot be made impeachable without basically voiding the fundamentals of the constitution?

Rudy alludes to this fundamental question in his twatters today, but I see it almost nowhere.

I get that Turley is not an unhinged lightweight like these other freaks, but don't get the impression he was very aggressive about the fundamental fallacy at play. President's exercise of plenary foreign affairs authority, whether it "benefits" him politically or not, cannot be impeachable, or Article II is pretty much void.

68 A bunch of professors who didn't actually witness anything?
---
That also happens in courts every day. It's called "expert witness".

But, no it wasn't that either--except for Turley. And that new tidbit that the founders would have been really mad at a president naming their son a homophone of a nobility rank a decade before serving in office, and that would constitute a mindset that he would want to convey a nobility title on said son, and that mindset would be impeachable without any accompanying action.

The bias they showed BEFORE the testimony, where 3 out of 4 were calling for Trump's impeachment for OTHER stuff he supposedly did, shows that their 'opinions' were tainted.

And if there had been an actual defense attorney there who had time to research said witnesses, then that would have come out in court.

159 I was trying to think the other day what an honest Impeachment effort would look like

Posted by: RoyalOil
---
I'm guessing there would first be a crime. And not just an action interpreted to be criminal. An action that falls in the middle of 20-80% mark of what any educated person would consider to be criminal actions.

Not arguing that possible information that you might get that might possibly help your campaign against somebody you *might* run against, eventually constitutes a "thing of value" and violates the FEC rules on foreign donations to a campaign, even though

My understanding from reading Andrew McCarthy
1. "Information" has been challenged as a "thing of value" before and has been definitively found as not applying.
2. Elton John's benefit concert for money going directly into DNC coffers was ruled as not a "thing of value" by judges.
3. FEC is civil law and just calls for restitution.

And understanding from my own reading of the FEC statute is that there is no reason in hell to equivocate valuable information as a "donation of a thing of value". But equivocators gonna equivocate.

And that's why they are dangerous to the Rule of Law. Because they will equivocate their "opponent's" rights away.

164 67, The Lawfare group and those sympathetic to it have effectively misused law to attack legitimate constitutional powers of things they do not agree with. Perry's receipt of a ridiculous criminal complaint over his threatened veto of funding for Travis County keeping a deranged drunken prosecutor on its staff that had demonstrated her abuse of power in office comes to mind. The trial judge likewise collaborated in the farce requiring the Texas Court of Criminal Appeals to stomp on it with fire eventually. However, it removed Perry from being able to run for president which was its purpose.

The process of lawfare is simple, use the court system and sympathetic judges and jurisdictions to thwart any government actions over and over again. This is somewhat similar to environmental groups using this technique to basically stymie things like the construction of the pipeline of Canadian oil or development of Artic oil resources.

Essentially, this approach should be stomped by higher courts as under the doctrine of collateral estoppel. A bunch of summary reversals would also be in order for decisions of rogue district court judges as the Court did in the massive resistance to integration days.

Those letters were then adopted by gangs and white supremicists. The cadet that proposed using them back in the 90's had no idea that "God Forgives, Brother's Don't" was tied to these groups. The Army is falling all over itself in horror that these four letters were on a logo...

246 whig, did you watch Barr's talk to the Federalist gathering recently?

Anyway, as expected, nothing about actions to remedy the very well known [to many] problems he ID'd WRT judicial usurpation.

Barr's implicit [by default, and no mention of any action] approach relies on ...... the judicial branch to fix .... the judicial branch. Big topic, but I think that personnel changes [only action under way now] is not enough, and only emphasizes the problem - the constitutional unraveling. Installing actual judges [with some concept of their constitutional role] and hoping for the best is a dodgy short-term strategy, and a dumb long-term one.

He also failed to ID a central factor in the trend he decried - Congress' near total abdication of its role to oversee and define the ambit of the courts it created. A related thing he ignored, and which actually fuzzes up his main theme about erosion of executive power, was Congress ceding power to the administrative state.

I really like, in the Bernie video, how the guy running the show, simply says the order of people speaking and the chick on the right says "Don't tell me what to do!"

302 Saying Trump can't ask Ukraine to investigate the graft (that sold out America) because it might benefit him (by finding Biden's crimes) ... is absurd.

It is like saying Trump can't campaign for President, because it might raise his name recognition, and that might help his Trump Enterprise related business.

The other related craziness ... the laws were crafted by these grifters to let the children make millions on these boards, or for foundations to collect 100s of millions ... "legally". There is one off quid pro quo, where the benefit is personal and the cost is to America. Yet they are all fine with that sleight of hand, but then try to squeeze Trump when there was no such arrangement.

Same would go for all the book deals and after office jobs (like Ryan and whatever corporate board he jumps on, high pay, no show, thanks for your years of selling out America for us).

I've known a number of foreign-born people with difficult-for-Americans names to adopt more familiar pronunciations. In college, I had a Chinese lab instructor named Sherman Hsu; I'm guessing that "Sherman" was a reasonably close analog to his actual name. And I worked with a Persian fellow whose name was "Kamyar" and went by "Tom".

I do a fair amount of purchasing of electronics parts from China for work, and EVERY sales contact there has an Anglicized first name that they use for work with foreigners. In at least one case, a company I've worked with for over 10 years, I'm convinced that one salesperson's name is actually shared by several sales people, because of the English writing styles in emails. It's actually code for "Cur's Assigned Sales Contact".

The Chinese seem to grab their English names out of a hat- often an old hat so their English name doesn't match the generation they're in. A friend of mine, Shou Ming, is David, which fits. But others are Albert, Sylvia, Philip- names that are too 'old' for them.

320 He also failed to ID a central factor in the trend he decried - Congress' near total abdication of its role to oversee and define the ambit of the courts it created. A related thing he ignored, and which actually fuzzes up his main theme about erosion of executive power, was Congress ceding power to the administrative state.
Posted by: rhomboid at December 06, 2019 12:01 PM (El6T/)

I agree with you about the problem, and I would go further and say that because of the total abdication of Congress on these matters, the Executive Branch has been hamstrung and can do very little to push back on its own. The better play is to simply do anything you can to put your own people in charge of the Judiciary, since it has now become the only real legislature in actual practice.

And I understand recognizing that Congress has become so dysfunctional that it's not even worth mentioning how it needs to reform itself - it won't happen, ever.

Our Government now has Two branches - the Judiciary and the Bureaucracy, which have together taken on all legislative and executive functions. The best we can ever hope for in our lifetimes is to put enough of our people in them to have at least some control over them.

Even the GOP thinks Orange Man Bad. So despite the fact Turley is a decent guy, he doesn't deserve all this applause. There are thousands of lawyers and millions of Americans who can make the case with less equivocation and equal skill.

The alarming part is, maybe the Democrats are right. Maybe American law really is debased to the point only a tiny minority will be listened to, and the rest of America can just wait to be allotted their chores. 353 I'm guessing that "Sherman" was a reasonably close analog to his actual name.

The Chinese seem to grab their English names out of a hat- often an old hat so their English name doesn't match the generation they're in. A friend of mine, Shou Ming, is David, which fits. But others are Albert, Sylvia, Philip- names that are too 'old' for them.

It could also be that it was a name he could pronounce accurately - he had a very heavy accent, and pronounced the word "funnel" as "fur-nel".

I see it all the time. I used to work with one closely and on our second meeting, I asked him if he would mind telling me what his real name was and if I should call him that. We then spent a few minutes making sure I pronounced it properly. I think names are important, and don't want to call people something way off unless I am physically incapable of saying it properly.

We got along well after that - he went out of his way to help me, moreso than his other colleagues.

A little bit goes a long way on that front.

Well look at how the modern idea is to shame the Congress as "terrorists" when they try to use the Power of the Purse, explicitly given as one of the main powers the Constitution and Federalist Papers, because they proposed not funding anything.

I had a co-worker, who I have an affable relationship with but a large diversion in politics complain that the Congress threat to not fund Obamacare was "violating the law". I smiled and told him 1) no it isn't. 2) Power of he Purse. And I normally leave it as a Fun Fact what the framers actually said.

It's curious this day and age though. I had to do extensive research into Hitler, in order to gird myself into the Hitler commandeering lies rife in rhetorical politics. And likewise, you have to read the Federalist Papers and founders letters yourself or contemporary politics will surely *lie* to you about them.

417 246 rhomboid,
No, Barr's apparently hypocritical speech at the Federalist Society was enough for me to stomach given the widespread misconduct at the FBI and DOJ that has been revealed with Barr doing nothing apparently. Hopeful people argue that Durham will come but to do the cleaning of Augean stables that the DOJ law enforcement community has become, urgent immediate public actions are needed.

DA for DC, Liu for example needs to be fired pronto for failures in the Awan case among others. The SDNY personnel need to be dispersed throughout the country and/or dismissed from service through their misconduct. Berman needs to fired for failing to curb them as well.

The idea of protecting institutions when they have already ruined themselves is a fools dream or a cynical pose to prevent de-corruption efforts. The FBI, DOJ, IC, mass media, congressional leadership, the Courts, have all revealed themselves as self interested bodies that permit large contingents of corrupt individuals without a fear of any penalty.

Notice, that the only thing that has kept Trump in power from these vultures has been that he saw to it that the economy was kept strong as his primary objective and enough people saw that he actually was trying against sometimes heroic odds to protect the country and keep his promises. A 95 percent approval rating from Republicans indicate that at least rank and file Republicans get it.

I have come to the conclusion, apart from Trump and a few others on the right, most of the right's leaders are gaseous windbags that say the right thing and then do nothing. See Ryan, Romney, McCain, CJ Roberts, McCarthy, etc., these folks deploy words as does an octopus does when it sprays ink to conceal itself. I suspect that most of the Rightie establishment is in it for the grift rather than from principles.

McConnell is probably closest to an unsavory LBJ style majority leader or Roscoe Conkling type if you go back far enough. That type can be useful to someone like Trump if your objectives coincide like judicial confirmations but not so much on curbing the excessive appetites of the swamp. Burr's continued chairing of the Intel committee is leverage against Trump to prevent draining the Swamp for example. A McConnell type would rather reign in hell than lose power in Heaven.

I really dislike the current atmosphere as it interferes with my research which is constitutional protections of rights as I find myself regularly being distracted by examples of the deterioration of the rule of law in the present. We are rapidly displacing a generally applicable law to that of aristocratic privilege overriding the black letter and intent of the laws.

Reading about the fall of the Florentine Republic as well as the Roman, you see the same actions by self-interested "elites" that are on display today. Eventually a tyrant of some sort comes to basically liquidate the elites as the general public comes to prefer one tyrant over a multitude of petty ones from the elites. Sometimes it happens repeatedly as in Florence where the elites try to claw back their power and the people resort to tyrants to prevent that restoration.

Lawrence Harvey who played the Barack Obama character in a movie with Frank Sinatra.

Harvey has something in common with France's ex-husband Robert Culp--they both murdered someone on Columbo and wait for it....got caught.

Actually Culp murdered someone every third week on Columbo. Him and Jack Cassidy.

420 416, Essentially the whole post war system was based on exploiting Americans for the benefits of the world via persistent trade deficits so that they would not turn commie.

Inclusion of Mexico and then China into that bloc essentially destroyed the system. The financial industry benefitted as skimming the top of transfers between countries and repatriating the money via investments of the foreigners into the U.S. economy. Politicians became selected on the basis of their openness to globalization by funding. However, this resulted in the decay of the U.S. Main street based economy via production.

421 stopping the graft machine that is selling off the United States a piece at a time is why Trump is H8ED and must be impeached. the royal class (politicians and their support orgs (inc bureucrats)) must be fed. the only other alternative is to push 95% of all US citizens back into serfdom, and we can not while they have all those GUNS.

the 2004 remake of "Candidate" was not bad!

It's fun to watch both of them back-to-back.
