NSC Official Tom Morrison, Who Listened In on Ukraine Call: Nothing I Heard Was Illegal or Suspicious

Weird that Adam Schiff didn't leak this, and that the fake news media isn't reporting it.

A top National Security Council (NSC) official who listened to President Donald Trump’s July 25 phone call with Ukrainian President Volodymr Zelensky testified to Congress today that he did not believe Trump had discussed anything illegal during the conversation.

"I want to be clear, I was not concerned that anything illegal was discussed," former NSC Senior Director for European Affairs Tim Morrison testified today, according to a record of his remarks obtained by The Federalist.

Let me break a little news myself:

A source with knowledge of the testimony in these fake impeachment hearings tells me that there were four professional transcribers who were listening in on the call, for purposes of preparing a written transcript. The four people wrote down what they each heard, then brought their transcriptions together, harmonized them, and decided as a group what the best transcript of the call was.

(This was not told to me, but I imagine that Vindman was the one complaining that the transcript had been put into the top-secret classification, and I'm going to guess it was placed there because people got tired of him having access to it and proposing to add things to it that no one else heard.)

That's standard protocol. Apparently they don't tape these recordings. That's why they have people transcribing the calls in real time.

They all agreed on the transcript that Trump released.

Now, they specifically refute Vindman's claim that there were Secret Messages during that phone call that were not included in the transcript. Vindman kept attempting to change the transcript, or add his notes of whatever auditory hallucination his Deep State pals told him that he heard, and the four transcribers kept rejecting them, saying "that wasn't said" or "none of us heard that" or the like.

All four of them denied this.

All four.

One, two, three, four.

Tell me:

Are four random civil servant transcribers all part of the Trump campaign? Has Trump "gotten" to them all?

Is Bill Barr blackmailing them?

Or is the grandstanding leaker Vindman perhaps a bit... confused?

Bolton's Guy? Tom Servo says that Morrison's testimony might be an indicator of what Bolton will say, and will not say.

I take for granted that I was in that world for a few years so what seems like common sense to me isn't actually common. There are usually a room full of people elsewhere, often multiple rooms full of people, listening in to these calls. And that's just on the US side. What a "high crime" or "misdemeanor" in this context means isn't exactly precise, although the founding fathers did actually write about it in the federalist and anti-federalist papers. But at the bare minimum, they mean criminal. And if no crime can be found just "well it was hinky" or "he didn't handle things properly" does not qualify.

The House can vote to send an Impeachment to the Senate for anything they want, even an ugly tie, because there is no enforcement mechanism to stop them from doing so. The Senate is supposed to take it more seriously and evaluate whether or not there was a crime.

The wording of high crimes and misdemeanors is a limiting factor in the Constitution itself AND THAT IS SUPREME OVER THE HOUSE'S OWN RULES. The lesser cannot overrule the text of the Constitution itself.

Thus, if the conduct in question is not a crime then it is unconstitutional for the House to do it. Now, effectively, the Supreme Court has not weighed in on impeachment because of the political question doctrine but that does not mean that it cannot either. See for example, Powell v. McCormack where the Supreme Court ruled that that Congress had the power to expel someone but not to "exclude" them from a seat which the House and Senate had done for one hundred years prior.

Past procedure and practices governing impeachments have also indicated a similar result. Perhaps the impeachment of Associate Justice Chase for his judicial temperament due to differing political views comes closest to the mark and it failed in the Senate as it should have. Every president that has been impeached has been because they allegedly committed a crime--Tenure of Office Act, Perjury in a court proceeding, and Obstruction of Justice among other things. No such crime has been alleged here so far.

For those trying to argue that it is political, the answer is that it is the body of the legislature acting in a quasi judicial fashion and that key constitutional protections are not excluded from judicial review--see Nixon v. U.S. which suggests in obiter dictum that impeachment procedures regarding the President or Vice President would have a higher bar than that of impeaching a district court judge (the Nixon in the case) that was already sitting in prison convicted of crimes.

The split is between "lawful" or "constitutional" and "political reality".

In lawful terms, I agree with one side. Impeachment really should be focused on an actual illegal act. An act in direct contravention of an established law of the United States government. "High" is the determination of the House, not "high crimes and misdemeanors".

However, the political reality side of the argument goes in the exact opposite direction. If a president is unpopular enough that the House will impeach and the Senate will convict on a spurious charge (like a bad tie), then that's that. The impeached and convicted president will take a lawsuit to SCOTUS challenging the results, saying that it's unconstitutional because have a bad tie isn't a "high crime or misdemeanor", but at that point, the specific charge isn't important. The mood of the nation is so soured on the president that SCOTUS, the third co-equal branch, won't sacrifice it's ability to function in the federal government by making such an unpopular move as to reinstate a convicted president.

That's my read, at least.

A good example, which I'm sure you've run across, is the Supreme Court's reaction to the suspension of Habeus Corpus in Maryland by Lincoln, in 1863. Yes, the Supreme Court found that was an Unconstitutional act and overturned it - but only after the War was over and Lincoln had already been dead for 2 years.

So the "pressure" is assumed/unversal and the alleged objective entirely proper.

But none of this applies when impeachment charges now include japes and tomfoolery.

Blackstone defines the British practice which it a clue that the framers used to how this language of the Constitution is to be interpreted.

High misdemeanor refers to the parliamentary judgment against Simon deBereford who was an accomplice in the high treason of Roger earl of Mortimer, a peer can be prosecuted for any crime which in essence would a felony considering that peers had the powers of low justice. See v. 4, Chapter 19, p. 256-258.

This emphasizes it is to be a solemn quasi judicial proceeding rather a political stunt.
