New York Times "Reporters" Kate Kelly and Robin Pogrebin Keep Digging, Keep Lying

Below, some interesting claims:

Kate Kelly tries to minimize Leland Keyser's rejection of Blasey's story by claiming "she still doesn't remember for sure."

Blasey claimed Leland was at the party and a witness to the events leading up to the fictitious assault.

Um, Leland has said she doesn't remember it. Period. She also says that there are aspects of the claim that strike her as hard to believe.

Kate Kelly is recasting this rejection of the story -- saying there was no party, that she never met Kavanaugh (which she would have had to do if she were at a party with him), and she would not have just let Blasey leave without leaving with her or trying to make sure she had a way home -- as Keyser just failing to be sure one way or the other.

In other words, Kate Kelly is claiming the standard for a dispositive memory here is that Keyser would have to say, "I specifically remember that party and I specifically remember it not happening."

You can't prove a negative, of course. But that's what Kelly is claiming would be the only definitive memory worth crediting here, that Keyser does remember the party not happening.

You can't remember something not happening. If it didn't happen, you don't remember it. You cannot affirmatively remember a non-event which did not occur in the time-space continuum.

But that's this "reporter's" way of explaining away a crucial witness saying that this didn't happen.

Next, Robin Pogrebin is asked why she is blaming Fox for their error. She says she's not blaming Fox -- she merely retweeted a Vox article (what a great and trustworthy source!) that blamed Fox.

An absurd evasion.

Next, Pogrebin and Kelly are asked why they failed to disclose that the man they heard (indirectly -- this is double-hearsay, hearing from someone who heard from someone) this story from was Bill Clinton's lawyer during the Whitewater investigation, specifically fighting against Kavanaugh, who was a Whitewater lawyer.

They claim that just because he has a vendetta against Kavanaugh doesn't mean he can't be trusted. They ask, rhetorically, if Kavanaugh's own bias should be noted, to which the guy interviewing them says "Yes, it's germane." But they claim they it's just entirely irrelevant that this guy is a longtime Clinton partisan and a specific enemy of Brett Kavanaugh's.

They claim they reported the important stuff, like that he's a "good government" guy.

Here's a rule: If you're making up absurd excuses why something isn't relevant to someone's credibility, it's almost certainly relevant, and you're just a partisan looking to hide critical information from readers (or would-be customers -- they are obscuring key details in order to sell books).

Prosecutors do this a lot -- they don't disclose exculpatory information to the defense, which they are required by law to disclose, by inventing convoluted theories about why the exculpatory information is either just "irrelevant" or actually inculpatory.

These are lies. If you're fighting hard to keep information away from your opponent or an impartial trier of facts, then that information is keenly relevant and you know goddamn well it is. Otherwise you'd just turn it over, thinking not much of it either way.

These are viciously partisan liars who spent months writing a dry-hole book with no new information (except for Leland Keyser coming forward to say she thinks Blasey is a liar) and so they're repackaging old information -- shit that was repeatedly rejected for publication by other news outlets, for being without any real sourcing -- and then they hide the stuff that proves just how weak and unpublishable this shit is.

This is the problem that's so scary. Most tv journalists aren't bright to begin with. And they live in such an echo chamber that they just regurgitate whatever news the NYT or AP feed them.

In some ways, the single biggest way conservatives could fight the lying leftist media is for some conservative bazillionnairre to buy AP, and 'fix' them. Right now, every radio station ... every local TV station ...every medium sized (and smaller newspaper) ... blindly regurgitates their BS propaganda every day.And these thousands of outlets have far more impact than the national evening newscasts.

Couple of neighbors just went by in their kayak.

Praying the water doesn't get into the garage. Much $ damage will ensue.

The house here sits 4 ft 9 in above ground level, so there's no threat of flooding, this time around.

But back in '08, Hurricane Harvey's storm surge actually put three inches of salt water into the house. Which meant that the garage was inundated with five ft. of water.

For now, all the vehicles are safe, as the water would have to come up another foot to cause damage.

But this is more rain than even a duck can enjoy.

And seriously, it's BAD for Galveston Bay and it's systems. This will kill all of the oyster beds, which were only barely beginning to recover from Hurricane Harvey's freshwater floods, only two years ago. It'll kill a lot of saltwater fish, too.

Ah well, neighbor passin' by in the kayak, again.

It could have been "John Doe" with the same outcome. They didn't fight all that hard against Gorsuch because they probably figured, "He's replacing Scalia, who was basically a fire-breather. We will do no worse and might do better regardless of the pick."

But the Left thrives - and dies - by the Supreme Court. They own it. It's theirs. It's been the bedrock of all they do for generations. Any actual conservative (Kavanaugh appears that he might be - time will tell) replacing the squishy Kennedy is a unpalatable risk. Ditto when RBG kicks the bucket - her replacement will be a nightmare scenario because it could actually shift the court.

This isn't - and never was - about Kavanaugh. He's a victim of this, but any nominee would be. The next nominee will be. This is about the Left's will to power being potentially encumbered. Nothing more, nothing less.

I'm just surprised it happened this quickly. The law is blatantly unconstitutional and violates prior Supreme Court Rulings, and California legislators were told this before the law was passed and they did it anyways. So, they can appeal all they want, won't matter.

It's a good case to remember WHY we allow Judicial Review; although in some cases it gets overused, there are cases just like this one where a legislature passes a blatantly unconstitutional law, *knows* what they doing, and just goes ahead and does it because they want to. If we didn't have judicial review, we wouldn't have a Constitution anymore.

AR-15 patent rights expired long ago. That's why anyone can manufacture the components. It's the same with the Ruger 10/22: Lots of outfits currently make 10/22 receivers, barrels, and trigger assemblies that are indistinguishable from, and interchangeable with, the Ruger-made parts.

Colt is not competing well in that space because they are too expensive. I have mutual friends with Shane and have seen quite a bit of his work on the Philly circuit. I find him hilarious, but taste in humor is one of those things you can't really argue about because it's just too subjective.

He's pretty moderate politically, not a big Trump fan but not a liberal either. A big portion of the Philly comedy circuit is the worst type of woke SJW comics, and they've resented him all along. Some of them were behind taking him down.

321 It feels good to say it, but for the umpteenth time, Kavanaugh can't sue, he won't sue, and he shouldn't sue. American Law is written in such a way as to make it virtually impossible for any public figure to win a libel suit.

You need to note that these two never actually "lied" in their claims, everything they said was technically true - Max Stier really did say those things. What they did was unethical and reprehensible because they left out all of the many things that indicate that Max Stier was lying, but there's no law against not saying something when you're not under oath. It's dirty, but legal.

And likewise, Max Stier didn't break any laws, because A) you can't "prove" him wrong (because no one else remembers anything) and B) he said it privately and then refused to say it under oath, and so he was never legally responsible for publicizing it. And the people who publicized will say that they never knew he was lying.

That's the two step that American publishers use to evade any liability for what they say, no matter how outrageous, and under American Law, it is all perfectly legal.

360 You know, the more I think about this, the BIGGEST MIRACLE re: Kavanaugh is that Leland Keyser didn't cave to the mob and say something to ruin him.
She's a lifelong member of the Swamp.

Once married to an ultra partisan Democratic Hack, Bob Beckel.
Seems to be hurting financially and could probably use the money that would have flowed to her out of gratitude for derailing Kavanaugh.
And is supposedly a little frail and had to withstand hours of threats/harrassment/bitching about how she 'had to stop this Kavanaugh guy from getting nominated'.
But she didn't cave, and stood her ground. Pretty damn impressive, I'd say. Not sure anyone is giving her enough credit for being an honest person, in a filthy dishonest town.
