"Sources:" Trump Backing Down on Citizenship Question, Will Drop Fight to Restore It
But: Other Sources Say He'll Use an Executive Order?

This, alas, is true:

#twoweeks. Take it from someone who knows.

Whoops: While those "sources" says Trump is dropping the fight, other sources seem to dispute that.

And I should have wondered -- maybe Trump is only dropping the effort to get the question on the census via one route, but intends to use an executive order to put it on.

3 ...Yet demographic questions have bee asked in every census since 1790.and questions about citizenship have been asked nearly as long. Like the District Court, we decline respondents invitation to measure the constitutionality of the citizenship question by a standard that would seem to render every census since 1790 unconstitutional...

In light of the early understanding of and long practice under the Enumeration Clause, we conclude it permits Congress, and by extension the Secretary to inquire about citizenship on the census questionnaire. We need not, and do not, decide the constitutionality of any other question that Congress or the Secretary might decide to include in the census."

- SCOTUS, Department of Commerce v. New York

I thought that the original decision was worth repeating in part. Mostly because I am tired of the lies being propagated by media's self anointed experts who have never read it and are printing pure, unmitigated bullshit.

It doesn't bother me. This is symbolic, anyways.

a) people will lie about their status on the census
and
b) so what? Even if they tell the truth about their citizenship status, it changes nothing, except maybe telling ICE where to focus their deportation efforts. But you don't need a census to know where illegals live.

Yeah - I don't consider this to be a very important issue on its face.

But, I think the Courts being completely lawless is a big, very important issue. Trump really needs to rub their nose in it, and put them in their place.

So, while I don't much care about the census, I think it's an ideal time to do it. The American people will not be upset, the Congress won't have the stones to impeach/convict, and the Courts will be subdued, so Trump can actually get some shit done going forward.

Right, that's the ruling. In other words, Commerce's lawyers fucked it up (on accident or on purpose).

I think the APA *will* be a problem though, since the 571 rule making (or whatever, I forget the sections of the APA) requires notice and comment periods and an entire process that typically takes a pretty long time, and I think they're on a pretty strict deadline for printing the census.

There's no reason they can't go back later and do the rule making the right way and not fuck it up, and get it included on subsequent census forms though if people really care that much about the question.

It does tension well. Good set ups and lots of background detail.

But it doesn't feel like horror in the way In the Mouth of Madness does. It's almost more of a random crime story with a slight touch of the supernatural (in the first movie) around how unkillable Michael Myers is.

That latter feature gets ramped up quite a bit more in the inferior sequels.

It's not stupid, its how the laws are written.

Would you really want the FBI to have unfettered access to everyones tax returns, for example?

Do you really think it would encourage people to be truthful? Also, what would that look like in practice? "sorry, IRS, I have a 5th amendment right against self incrimination, so I can't file a tax return this year."

94 I would absolutely be for President Trump ignoring President Roberts and simply including the question.

If that doesn't happen then there needs to be a concerted boycott of the census by Republicans in all blue states to try to make up for the overcount of foreigners used to divvy up our electoral votes.

In either case, I don't want to hear a damned word from Democrats about how they are against disenfranchisement ever again. They will have stolen something on the order of 20-30 electoral votes and the Supreme Court will have helped them do it.

95 There is a certain school within the White House who believes that a certain amount of acceptable losses, clearly traceable to Democrat partisan politics and their supporters in the judiciary, will piss off and further motivate the base to vote. This is probably one of those.

I hold out that Trump will have options as to what he will be stating at the presser, and won't decide until the mic comes on.

That is only important if governments are determined by elections and honest vote counts. It is looking more and more like our government is going to be determined in the future by other means. Just saying.

None, it would have no impact.

That's the thing that so many people are missing here -- Read the second section of the 14th amendment.

"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State."

They chose to use the word "persons" in the first part, and "citizens" in the other.

It's pretty clear that the number of PERSONS is what matters for apportioning seats, not the number of CITIZENS.

Whether we like it or not, short of a constitutional amendment, how many people are citizens v how many are here illegally or otherwise doesn't matter when it comes to apportioning seats.

I don't know.

Considering how many sequels and how many rip offs that followed Halloween, my judgement might be outside the mean. But I feel Mouth of Madness hit it's goal better than Halloween did.

I agree that The Endless did the time loop horror better than Mouth of Madness did. But the stakes are higher in Mouth of Madness. The end of the world, the Old Ones coming to drive us all mad like in Call of Cthulhu.

Carpenter shows that madness, shows its spread, shows a skeptic forced to accept that reality...is not solid. There's a better plot and a better character arc, not to mention being true to the meaning of horror...that everything is NOT going to be all right.

Lori Strode survives Halloween, Michael is stopped, if not captured. It's more a thriller or a drama than a work of horror, ironically.

Yes, I know, we listened to that song and dance from the GOP for decades, but for once there's a singer and dancer who's actually starting to shift the needle in the right direction. I'm willing to have a little bit of faith and patience for that.

116 86 He should just release an EO directing the Citizenship question to be on the census. Print the census and see if Roberts wants to recall the court to reassess. My guess is Roberts won't call his bluff.
Posted by: Puddin Head at July 11, 2019 03:16 PM (2LelM)

The question before the court wasn't whether or not the question could be on the census. Everyone agrees it COULD be on the census.

The question was whether the ridiculous rule making process under the APA was followed.

Which the court said it wasn't. There's all kinds of case law on this stuff, but basically the court said "you need to have a better reason as to why you're asking the question on the census then the one you proffered. So start over, but with a better reason, and you're good."
---------------------------
That's my point. It wasn't a decision. Roberts agreed that this is legal but wants more info. Print the Census and tell Roberts he's welcomed to come to the WH for a lesson on who is actually fucking elected and who is fucking appointed.

172 They chose to use the word "persons" in the first part, and "citizens" in the other.

It's pretty clear that the number of PERSONS is what matters for apportioning seats, not the number of CITIZENS.

Whether we like it or not, short of a constitutional amendment, how many people are citizens v how many are here illegally or otherwise doesn't matter when it comes to apportioning seats.

Posted by: Harry Paratestes at July 11, 2019 03:25 PM (GBteo)

And illegals clearly do NOT count for any apportionment. NONE. Legal aliens are another story but illegals clearly have no count since they have no right to be here, at all, and should rightfully be thrown out on their asses the minute they are found.

Presumably, but idk.

SCOTUS has accepted the premise that this needs to go through the rule making process. I'm not sure if commerce tried to argue differently or that the revocation of the question previously was not done in accordance to the law.

In other words, that ship almost definitely already sailed.

Do you fight on multiple fronts or not?

Do you encircle an enemy in a strong defensive position rather than make a frontal assault.

As much as people say Trump is just winging it. I don't think he is winging it. I think he's got a plan, which he has had to adjust here and there, but mostly he's still on track. I didn't give him much chance for winning the election although I saw the possibility - longest shot but only shot- and voted for him. 183 161 I agree that The Endless did the time loop horror better than Mouth of Madness did.

Not the language in the second section laying out how reps are to be apportioned.

I don't know why people are even arguing this point, I'm just saying that there's nothing legally we can do short of passing a constitutional amendment changing the 14A that says illegals arent counted for apportionment purposes.

It's shitty that that's how it is, but that's how the 14A was written (by Republicans, keep in mind, trying to anticipate the kind of shady games they knew the Dems would play with the recently freed slaves and whether or not those people would be considered citizens or not). It made sense at the time, now it kind of sucks, but unfortunately we just have to live with it.

Posted by: JackStraw at July 11, 2019 03:33 PM (K/2j/)

It was a treaty thing, which is why we specified indians not taxed. They were /are mini sovereign nations inside the US, and thus not subject to US laws, essentially. It's super complicated, I don't really know exactly how it works, but that's why the "Indians not taxed" is in the original constitution and the 14th A.

259 I don't know why people are even arguing this point, I'm just saying that there's nothing legally we can do short of passing a constitutional amendment changing the 14A that says illegals arent counted for apportionment purposes.

Posted by: Harry Paratestes at July 11, 2019 03:34 PM (GBteo)

And tourists. What language do you need to put in to make sure that tourists aren't counted, because in your definition tourists are definitely counted, being "persons" and all?

274 As I've mentioned on long-ago threads:

I've never received, seen or filled out a census form, ever in my life.

In fact, until recently, I had always thought that the census was more of an estimate: they look at the number of dwellings (houses, apartments, etc.) then try to figure out how many people live in each of the dwellings. But the govt. never actually contacted the individuals directly, except to do a "random sampling" (like with polling) to gather averages from which they could extrapolate the full data.

But no, I've been told: They actually claim to contact each and every individual in the nation.

Well, that's news to me, since I've been alive for {29} years, and I've never had any interaction with the census dept or a census taker or whoever it might be.

This might be related to the fact that I've also never had any interaction with the Social Security dept either. Never gotten a letter, or any form of communication, nor ever had a "Social Security card," or anything at all.

I happen to know my Social Security number by heart, but don't remember how I came to know what it was.

In fact, to my knowledge, I've never received any communication from the Federal govt. at all, ever. I mail in my taxes every year, but have never heard back from them for any reason.

I suspect they may not know I exist, or I fell through the cracks somehow.

284 I don't think SCOTUS was even addressing the reason the question was to be added to the census. They were saying that they did not believe the administration was giving its true reasons for wanting it on. They never even considered whether those reasons were valid. Typical Roberts trying to gin up the result he wants by making an ass of himself.

The ruling hinges completely on their questioning the motivations of the Administration. In which case it seems to me to be perfectly valid for the administration to question the motivations of the court and ignore the ruling. This is the sort of horseshit they would never pull on a leftist administration which lies straight to their face. They have ALWAYS in the past accepted whatever the stated motivation is and ruled based on that. They will ALWAYS in the future rule based on the stated motivation. It is not their job to play mind reader.

This is just another Orange Man Bad rule meant to deny us the ability to see that our votes lead to the same power being exercised on our behalf that is exercised by every other administration. It is just another means of overturning the election results.

Posted by: ThePrimordialOrderedPair at July 11, 2019 03:31 PM (bOCwl)

Yes, I looked it up. You can read the rules printed in the federal register, but the long and short of it is:

If someone has a permanent address where they spend the majority of the year that is OUTSIDE the US, they are not counted unless they are "long term visitors" (been here I think it was 4 months or longer, think foreign college students, for example), in which case they are counted.

Homeless people are counted at where they are on the day of the census, otherwise everyone else is counted where they spend six months plus a day a year.

Tell her that store-bought eggs ARE'NT fertilized, and thus one is basically just eating a placenta and a (literal) egg, not a living animal.

Unless one sees a tiny red spot in the egg yolk; THEN you know it ha been fertilized.

Seeing a red spot used to happen more frequently, but now it's very rare, because of the way the chickens are kept -- zero contact with fertile males.

302 You know, Harry, this sort of ridiculous linguistic bullshit (and it is nothing short of asinine bullshit) is why people hate lawyers and don't trust them.

Also, how do you know the "year" in the Constitution is the Christian year - the Gregorian year, specifically? It doesn't define that anywhere. How do you know that?

Sheesh.
Posted by: ThePrimordialOrderedPair at July 11, 2019 03:37 PM (bOCwl)

I'm not saying I agree with the outcome, just that this is what the law says.

And the "linguistics bullshit" you so hate is kind of the entire foundation of western civilization -- you know, the rule of law.

Or would you prefer judges who say "ah, fuck it, I don't like the law, so I'm just going to change it to say what it should say?" Because usually the right rails against judges who seemingly do that.

Posted by: Harry Paratestes at July 11, 2019 03:45 PM (GBteo)

303 Yes, I looked it up.

Posted by: Harry Paratestes at July 11, 2019 03:41 PM (GBteo)

All that is in the Constitution? You must have a different copy than I have.

No ... I know where you are citing it from. What you just proved is that you can't just take the word "persons" in the Constitution and argue from that. THank you for proving my point. Now, just admit to it.

Illegals have no right to be here, therefore they have no right to fill out a census. This ain't rocket surgery.

I mean, honestly, I'm just explaining to non-lawyers what the law says. If you don't like what the law says, you can change it.

But as is stands -- there is not a court in the country who will agree that "persons" means anything other than "persons." And if we did somehow find a judge willing to go through the kind of pretzel logic required to change the definition of the word "persons," we probably wouldn't want him to be a judge, and he would definitely get overturned and smacked down on appeal.

But sure, shoot the messenger.

Posted by: ThePrimordialOrderedPair at July 11, 2019 03:53 PM (bOCwl)

If you have the time and money, feel free to hire a lawyer and try to argue that "year" used in the US constitution refers to something other than the gregorian calendar years.

If you lose, then we'll have case law establishing what "year" means. If you win, then we'll all have to live under a new definition of "year."

I'm really not sure what point you're trying to make here.

Typically when there is an ambiguity, judges look first to the statute itself to see if there is definitions, then previous case law, then the legislative history, then, if really desperate, law dictionaries, english language dictionaries, old treatises, and whatever other sources they can find.

When there's no real, legitimate disagreement (like what a "year" means) it doesn't come up.

They can, they just need to follow the APA procedures to get it on the census.

The problem is that there's a hard deadline on when the census needs to be printed and mailed out, and it's unclear whether or not there is enough time between now and then for any rule change to go in to affect in time for this census.

Don't harsh on Harry or on lawyers and judges for this, POP. Language isn't like math, so that's why we have a legal system to define precisely what these fuzzy words mean. Once that consensus is reached by the USSC, then that is what the word means.

Either we have a system of defined concepts (with an ultimate arbitrator) or we don't. That's what Rule of Law means. "Persons" includes illegals unless and until we get a constitutional amendment to clarify or a different Court (as the final arbiter)

Harry Paratestes,

I've herd it argued that since the Census is not a law passed by congress, but an authority/requirement given to the Executive branch... the APA procedures don't apply. Thus the path via executive order.

Regardless if the questions get on or not... we can still go for a misinformation campaign to make illegals still afraid to take survey. Make up some bullshit that a machine learning algorithm is being used to identify if you are an illegal or not.

Posted by: imp at July 11, 2019 04:05 PM (uKiy5)

Thank you. And correct, this is a huge part of the function of our judicial system.

Because no country can function outside a framework of laws. And there are always going to be some ambiguities in the law, as it's impossible to imagine every possible scenario when drafting laws, and that's what courts are for -- to clarify the laws to the best of their ability (and/or say "Congress, this is unreadable, you fucked up. Re-write the law.")

Now, you can argue that the Civil Law systems used in most of Europe and Asia function better than the common law system we use in the UK, US, Canada, etc., since judges have much less power to clarify / interpret laws then they do in the US. There are pros and cons to both systems, and both seem to work fairly well.

Any formal action taken by a Cabinet Agency requires APA measures, typically. I can't see why the census would be different. It's not a matter of legislative delegation is the only difference with the census forms. But agency action triggers APA notice and rulemaking procedures unless it's a quasi-judicial action.
