Court Dismisses Absurd Emoluments Clause Lawsuit Against Trump

The Trump organization (not Trump) getting paid fair market value for hotel rooms is an illegal "emolument," you see, but the Clintons raking in millions for foreign governments -- when Hillary Clinton is Secretary of State -- isn't.

Okay.*

President was sued by Democratic attorneys general of Maryland and D.C.

Claimed he was violating the Constitution by accepting hotel business from foreign countries

Three-judge appeals court panel ruled that the AGs lacked jurisdiction to sue; all three were Republican appointees

They didn't rule on the merits of the case, but the Trump Organization writes annual checks to the Treasury to disgorge its foreign government profits

Trump took a victory lap and proclaimed the case was a product of the 'Deep State'; one more lawsuit continues, filed by hundreds of Democratic lawmakers

* Just a quick point for those who say the Clintons didn't personally benefit from the Foundation:

Well, one, they also collected personal political donations.

But two, what do you do with money? You buy convenience and status.

The Clinton Foundation supplied Hillary, Bill, and Chelsea with:

1) Private offices is luxe buidlings

2) Full-time staffs of assistants and drivers -- I think two of them had a Foundation-paid staff of five, and one had six on the staff.

3) Transportation and hotel costs for what is, essentially, their business.

Now, if I were running something resembling a successful business, I'd like to pay a staff too. And I'd like an assistant. And a researcher. And a driver.

And a luxe office. And all hotel and transport costs paid.

And someone to pretend he's me and post for me all day. But I digress.

If I had a "charitable donation" and said, "But I'm not taking money, all I'm taking is a series of paid benefits and full-time personnel which only rich people or CEOs at major corporations can afford," what would everyone say?

You think people might notice that my benefits from this alleged charity are things that all people want but which usually costs $500,000+ per year (or more) so they just can't afford it?

If I started a "charity" that didn't pay me money but did pay for my food and mortgage and all other expenses -- including personal assistants, a scheduler, a driver, and why not, a maid, too -- um, that is paying me money, albeit in an ever-so-slightly disguised manner.

"Not personally benefiting?" No, of course not. Not unless you count a full-time staff of five or six personal servants to be a "benefit."

Which, by the way -- everyone does.

38 What a HORRIBLE article on the case that is from the Daily Mail! It completely misunderstands what the case was about, it completely misunderstands what an "Emolument" is, and it completely misunderstands the ruling! One of the most incompetent articles I've seen in a long long time.

Short version - this was an absolute, completely and total Victory for Trump and his legal team, and the lower court was bitch-slapped in a way you almost never see. The 4th circuit panel didn't just say that the plaintiffs had no standing, they told the lower courts and the AG's for both Maryland and D.C. that they were incompetent idiots for ever having let the case get this far.

And usually, you will see an appeals court politely send back a case to the lower court for "consideration in light of this ruling" - Not Here! The Court ORDERED the case to be immediately dismissed With Prejudice - which means that this case is DEAD and it may NOT be refiled. They threw this case down on the dirt and spiked the ball on top of it.

It's simpler than that: he's ending their grift.

The "thought leaders" are now irrelevant. No one cares what they say or write. That goes right to their bottom line.

No one on the left likes them. The left doesn't want converts, it wants to make examples.

For a time, they are being tolerated so that they can be used in "Republicans for Biden" or whoever ends up winning, but if Trump wins again, they'll be unimportant.

I doubt they'll be unemployed, but being nobody will hurt them plenty.

Amazingly, he's already been able to appoint about 1/4 of the Judiciary - butt that means a large part still oppose him, and Robert's doesn't have the nerve to do what's necessary. I mean the obvious answer to the 2nd Circuit Judge is to make an emergency appeal to the SCOTUS over it, since it involves a direct precedent, but we shall see.

NPR is run by idiots. This ruling today laid out clearly why the entire legal theory these emoluments cases rest on is idiotic.

An example - one case is being brought by some Congressmen. Language in the ruling today pointed out that wording like this in the Constitution is an area left for Congress to deal with, if it wants to, and only them. Meaning that, if you're a Congressman, well get a bill together and pass it, that's your job. Don't think you can go off running to some court to do what you're incapable of doing yourself.

That in fact is why *all* of the Court actions that the Congressional Democrats are trying to initiate are doomed to failure.

In fact, the Appeals Court examined all of the claims made so far, very clearly showed why the lower court had gotten them disastrously wrong, why the lower court Judge had made ridiculous rulings so far, why the Maryland and D.C. Attorney Generals had put together a purely political case where they couldn't even say what kind of relief they were asking for - and then, at the end, they ruled that since there was clearly no Standing for them to even file this suit, that was the most obvious reason to throw it out. BUT the case was fatally flawed in every other area, too.

271 I spent an evening in 2015 digging through the 2010-2012 Form 990s on the Clinton pyramid scheme - and it is an incredible pyramid scheme - to try and figure out exactly how much of the money they were bringing in went to them, how much to funding their government in waiting, and how much, if any, really to charitable purposes. I got tired of digging after three layers down, but suffice to say at every level they siphoned cash off not just for Bill and Hillary to travel, but to travel private. No emoluments issues here, I assure you...
