AG Barr: I Think I've Figured Out a Way to Put the Citizenship Question Back on the Census

Via Matt Vespa at Townhall, the Post and Courrier reported that Barr told the press, "I think over the next day or two you'll see what approach we're taking and I think it does provide a pathway for getting the question on the census."

I do too, make no mistake about that. It's just that I read a few articles when the ruling came down that made me think it wouldn't necessarily be a bad thing to leave the question off. I just can't remember the arguments though, because I'm not that smart.

Election fraud would be easy to fix. Not to completely eliminate, but to make it a non-factor. If I were the governor of a state, this would be the law I would propose to whatever rat's nest was my statehouse:
1) Voter registration is suspended for one day. On that day, all voter rolls are immediately destroyed.
2) Voter registration ends 60 days before election.
3) Proof of residence and citizenship must be shown to register.
4) Voting must be done in person. Absentee ballots are available, and must be requested at least three months before the election.
5) After the vote is certified by the Secretary of State, go to step 1.

There's scarcely any point to having a question on there about one's legal status, as the illegals will simply lie, anyway. If they answer "no" to the citizenship question, they haven't lied. If they answer "yes", then they have just committed another felony to ensure their deportation.

Just make it clear that the Census is not meant to be part of the investigative toolbox for ICE. But lying on a Census form will be used as a felony, if they do it.

I think that would be a hard sell to SCOTUS. I'm actually in the camp that the Constitution says "persons" and not citizens. Yes, I know that the founders would have likely intended it to only be citizens because the idea of massive numbers of illegals wouldn't be something they could foresee... but I think that's stretching interpretation of the language as written too far.

That said, I think a case can be made that you still need to know where your citizens are, relative to the general population, through the need to ensure a republican form of government. Districts should be designed to best equalize the distribution of the total population, as well as the citizen population.

If a condition of the law is wrong, and it is not particularly stated as severable, then the whole law has to be remade.

That said, I think a case can be made that you still need to know where your citizens are, relative to the general population, through the need to ensure a republican form of government. Districts should be designed to best equalize the distribution of the total population, as well as the citizen population.

I am in the same camp, because we have to abide by the "plain meaning" as well, unless a cracker-jack originalist argument can be made for a different original understanding (see "well-regulated" and "militia" circa 18th-century).

The problem is that "persons" were forseeable meant for people allowed in the country. To some degree representatives represent their interests as well--as long as the people have chosen to tolerate their presence.

However, illegal presence argues against any representation tolerance or acceptence by the people of that presence. So you are really arguing against the reason that "persons" was chosen.

I think this is a sound argument, I do not think it stands well in the tradition of the court though--it runs up against the limitation of the standard of "precedence"--however manipulated by the ignoring of precedence by activist judges, no less.

Does the census want to count the guy who I don't know is living in my basement as part of my household? I never said he could live there. Why would I count him as "household"?

The basis is that if you go read the Amendment (you can google it, it's easy to find) the Amendment uses the word "Persons" in some places, and "Citizens" in others, and clearly they are intended to have related but different meanings.

For example, the very first line is: "All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Although it's clear from the context, later Court decisions have confirmed that "Persons" means any human being standing and breathing within the physical confines of the United States. "Citizens" are defined by the line quoted above.

I actually agree that it inhibits the "scientific" purpose of counting "persons" to ask a question which is going to make an illegal not want to answer the census.

However, I believe that burdens can't be created in 9 years--if Congress wants to change the law, then change the law. If we have a decades-long history of asking this question, then this has been an operating procedure for such little time.

Well, the language itself is, "Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed" from the 14th amendment.

The basis is that if you go read the Amendment (you can google it, it's easy to find) the Amendment uses the word "Persons" in some places, and "Citizens" in others, and clearly they are intended to have related but different meanings.

For example, the very first line is: "All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Although it's clear from the context, later Court decisions have confirmed that "Persons" means any human being standing and breathing within the physical confines of the United States. "Citizens" are defined by the line quoted above.

That definition on citizens does not apply to Indians. Per those same courts. For the obvious reason that Indians are subject to their respective tribes, even should they live in the USA.

It is absurd to suggest that we should have to include an invading army for purposes of representation. That would be a form of hyper literalism and selectively applied at that. Election fraud would be easy to fix. Not to completely eliminate, but to make it a non-factor. If I were the governor of a state, this would be the law I would propose to whatever rat's nest was my statehouse:
1) Voter registration is suspended for one day. On that day, all voter rolls are immediately destroyed.
2) Voter registration ends 60 days before election.
3) Proof of residence and citizenship must be shown to register.
4) Voting must be done in person. Absentee ballots are available, and must be requested at least three months before the election.
5) After the vote is certified by the Secretary of State, go to step 1.

In WA state, virtually every thing they do invites voter fraud.

After the registration process I described, the ballots are mailed out about 3-4 weeks before the election. All mail, no in person voting (except a couple of local spots for show), and the ballots must be postmarked by 8pm election night. So many aren't even received for another couple of days. Many people speak up and tell the press they received 2 ballots, old address and new address, or married vs single name, or other reason. The Sec of State flutters, the Leftie press says "see! no corruption!", and nothing is done to address the root causes.

The Left even have voting parties, bring your ballot and we will vote together! Cookies and coffee are served! It is like effing kindergarten.


Voting in many states is hopelessly corrupt.

Until the desire to fix it exists, the single most powerful tool in human history to stop violent overthrows of governments continues to be dulled like running a knife against concrete.

Just don't claim you weren't warned when the box suddenly changes.

Wasn't the census largely done by mail even then (as it is now)? Census takers couldn't do their work, obviously, but weren't the forms by mail? I thought one of the reasons that Post Office is the *only* service guaranteed by the federal government was to help make sure the census happened.

No, but it did give us the legal Definition of "Persons", as mandated by the Supreme Court, for all legal disputes in the United Disputes.

Therefore that definition of "Persons" is mandatory for every Constitutional Case, no matter the subject matter, in every court in the US - even State Courts, since it is a civil rights matter.

If you want to change it, Amend the Constitution.

There was not pretty much. You would however be a subject of the US and not simultaneously whatever Crown you belonged to before. Everyone who is a subject of the same entity is part of that country.
A single person could be king of Austria and Spain, but a Spaniard is not an Austrian. The way the law applies to them would be different.

From 1787 to 1867, there were no rules at all for Citizenship -- it depended on the States, and in many states only White, Landowning Men could be citizens. Not slaves, not women, not children, since none of them were allowed to vote.

The entire concept was in the early stages, and I think there are serious flaws in the 14th, like Birthright Citizenship. Not necessary. "Person" is a construction of the courts, at a time in which the question of apportionment and representation may have had no applicability. "Persons" under Plyler was not adjudicated as to this clause, and although it arguably has persuasive weight, I think it can be and should be challenged as distinguishable, or overturned as a bad construction, for at least the reasons that I highlighted above, wherein "persons" was used to distinguish from former non-citizen slaves, for the purpose of apportionment and representation.
This is the only logical and rational reading of the term, "persons."

internet theory that is not recognized by a single court in the entire country. Even current US Code says if someone is born on US Soil, they are an automatic citizen. I would like to see it changed, but for now, it is what it is.

I don't want to seem too dismissive of the theory, but a lot of lay people don't realize that there are tens of thousands of legal "theories" about different things floating around, thousands more are written every year by law students working on papers. Until one of them is actually picked up by a Real Court and used in an Actual Decision, they don't have any more legal validity than posts like this on the net do.

I've come around to thinking that Congress, backed by the President, could go a very long ways towards redefining all of these things. They changed all the rules for Indians in 1924, and that didn't take an amendment.

Honestly I think it doesn't make any sense in the context of appointed judges. At least not in a way that is consistent with its origins. The legitimacy is derived from everyone agreeing on the wiseman or elder. Doesn't really apply if he's sent out by the king. There is a tacit recognition that the rulings are actually lawmaking, but what happens to consent of the governed?

Every 2 years. People who want to drive legally go through a similar process. When they want us to pay taxes, we go through a similar enough process. Government has no problem getting us legally on the books, when it has a vested interest in doing so.

I can't imagine what could be more important to the interest of government than that it be elected and appointed and overseen by a true and certifiable citizenry.
