Penalty Phase in Gibson Bakery/Oberlin Defamation Case Begins Today

I missed this story on Friday night -- Oberlin students, with the encouragement of Oberlin College (Lena Dunham's alma mater), defamed a fifth-generation family of bakers as "racists" for calling on the cops on students who later admitted their guilt.

A jury agreed with the bakers that the college had encouraged/facilitated the nasty defamation campaign that harmed their business -- and awarded them $11 million in purely compensatory damages.

That's a big chunk of change. And it gets worse for Oberlin.

For one thing, Oberlin's insurer might very well refuse to pay the $11 million, as insurers usually do not pay if the act which incurs liability is a deliberate act.

The insurer, Lexington, already made this clear in a motion filed with the court in this matter:

Lexington issued a Commercial Umbrella Liability policy that potentially provides coverage to defendants Oberlin College aka Oberlin College and Conservatory ("Oberlin") and Meredith Raimondo for certain damages in this action. Lexington seeks intervention in this action for the limited purpose of submitting interrogatories to the jury in order to determine facts at issue in this action that would impact coverage under its policy.

The Lexington policy does not provide coverage for "bodily injury" or "property damage" intentionally caused by defendants.

Now, to be honest, I don't know if damage to a business' reputation and financial health can fairly be called "property damage," which is a term with a longstanding, well-understood meaning.

But they continue:

While the Lexington policy potentially provides coverage in relation to "personal and advertising injury," defined to include defamation and/or disparagement in certain circumstances, the Lexington policy excludes any such coverage if "personal and advertising injury" is caused "with the knowledge that the act would violate the rights of another... ," or if the insured published material it knew to be false.

So they're pursuing a denial of claim based on two theories, one a little stronger than the other. And a third claim, too: That Oberlin did not cooperate with the insurer as far as participating in the defense in the lawsuit.

Here's a possible bit of further bad news: Professor Jacobsen at Legal Insurrection notes that Oberlin put out a press statement blasting the jury in the case right before that same jury is to make a decision on how much the punitive damages against Oberlin should be.

They're not sequestered. They read this stuff.

The next stage is a punitive damages hearing, since the jury found the defendants acted with intent and malice. A separate punitive damages hearing is required under the Ohio Tort Reform legislation that passed several years ago. The point is to keep some of the more inflammatory evidence that does not go to liability or compensatory damages away from the jury during the initial deliberations. That additional evidence relevant to punitive damages could include information as to the wealth of the defendants, but also additional information supporting the need for punishment.

In this context, there is nothing more baffling than a statement sent to alumni after the verdict by Donica Thomas Varner, Oberlin College’s Vice President and General Counsel.

The statement was contained in a mass email sent to alumni (and possibly others) criticizing the jury verdict and repeating the same stale defenses that failed at trial (emphasis added)...

The Daily Caller notes that this latest Social Justice Warrior "hoax" will be a costly one.

"Raimondo," mentioned below, is Meredith Raimondo, the Vice President of the school and Dean of Students who is apparently quite the little rabble-rouser.

The lawsuit stemmed from a 2016 incident involving three black Oberlin students who claimed they were victims of racial profiling even though one was caught openly shoplifting and trying to use a fake ID to buy alcohol. When Allyn Gibson followed the student out of the store and confronted him, "the two got into a physical altercation," the Chronical-Telegram reported. When the two other students joined in, police said all three were hitting Allen Gibson, who was on the ground. All three students pleaded guilty to misdemeanor charges and denied that Allyn's actions were racially motivated in August 2017.

After the incident, however, Oberlin College faculty and students engaged in a series of protests against the bakery, urged people to boycott, and Raimondo even made a flyer accusing the store of regularly racial profiling its customers.

The college reportedly contended that it merely allowed students to engage in free speech.

There's the hook for the college's liability -- as well as Raimondo's personal liability.

Above, I called Raimondo "quite the little rabble-rouser." Even as I wrote that, I thought, "Oh Lord, she is almost certainly not 'little.'"

Correct:

Yes, that is more or less precisely how I imagined this sort of person would look. Eternally, unquenchably vengeful against society and God.

And understandbly so!

Today begins the punitive damage phase of the trial. It is expected that the plaintiffs will receive an additional $22 million reward as punishment for their malicious, deliberate acts.

It is time to begin suing the living shit out of these people. They think that Life Is Twitter, where they can defame anyone and destroy businesses and careers without censure -- at least without censure by Twitter, that itself encourages such witch-hunts.

But Life is not Twitter. It's time to get these cases away from Twitter's "Trust and Safety Council" and in front of juries of normies who are not social justice warriors and do not subscribe to the notion that defamation and lies are perfectly valid tactics when fighting against Nazi Baked Goods and Fascist Pastry.

The plaintiffs' lawyer made a similar point:

"I think part of what we did here today is answer the question as to, 'What are we going to tolerate in our society?'" attorney Owen Rarric said. "We're hopeful that this is a sign that not only Oberlin College, but in the future, powerful institutions, will hesitate before trying to crush the little guy."

Oberlin has an $887m endowment.

One of our key problems is that the institutional Left is so flush with cash, just swimming in it, that financial penalties mean almost nothing to them.

And when individuals are placed in financial jeopardy, they suddenly are able to draw such nationwide attention to their plight, and such sympathy, that heretofore unknown people can garner millions in a GoFundMe, overnight.

It's amazing how many regular old folks are willing to step right up in these situations.

That was a very good lesson as to how to have a Total Fail in the Expert Witness department. (a big part of the fun in examining this is that EVERY legal decision Oberlin made was catastrophic) So, usually in a Court fight over damages, both sides will present their estimates to the jury, and juries being people, they will usually try to come up with something in between that the jury thinks is fair. BUT in this case, the Oberlin expert's estimate was such an obvious lowball number that the Jury simply threw it out as ridiculous - and once that happens, they only numbers they have to go on are the other sides, and so they give them everything they ask for. Ooops.

Another big part where the "Expert Witness" failed was when he was asked on the stand if he had gone and physically examined the Gibson's business before he valued it, and his answer, (paraphrased), was "naaah, didn't need to, I just paper whipped the numbers from my office in NYC". That's probably the moment where the jury stopped listening to anything else he had to say.

The information is a matter of public record, but a local/regional news outlet running a story specifically to say "Oh hey, look at Joe Smith here who runs Smith Lawncare in Smalltown, OR, and lives in Nearbytown, whose facebook page is [here] - they donated $200 to Trump" is crossing the line.

There is a reason why a lot of non-lefty pundits who are expats from various other nations - who experienced certain types of unpleasantness in the past, in those nations - are furiously trying to wave of the left from this sort of behavior. They know where this inevitably ends up.

Consider other parts of the internet that are a bit more, eh, perpetually pissed off. In 2-3 years they've gone from "nothing will ever happen, the right will roll over", to "it's probably inevitable because the left isn't going to let it drop", to "hey let's make sure we make the most of what's coming". Or rather, that's the chatter among the 50% or so who haven't been deplatformed by their ISP, wordpress, etc.

Nope - in the end, their "defense" came down to "eh, Your business is worthless so who cares what we did."

I suspect, in reading some statements made before the trial started, that Oberlin had intended to put some students on as witnesses and they were supposed to claim that Gibson's really was Rayciss and had harassed them. But the Judge, to his great credit, ran a very tight trial and he disallowed everything that did not have a direct bearing on the facts of the case. They could present evidence about the protests and about Oberlin's subsequent actions, but NO political discussion at all, no emails about attitudes, no general impressions of who was "rayciss" or not, the Judge said "Nope!" to all of that. And it seems like Oberlin had no plan B and just gave up on any kind of effective defense once the Judge put those rules into effect.

I recall that just before the trial, people were worried that the Judge looked like he was tossing out a whole lot of items that both sides wanted to present, but in retrospect he was very effective at making both sides stick to only the facts of the case, and cut out everything else.

The hearing today is about punitive damages - if I understand Ohio State law correctly, the Jury is allowed to assess up to Twice the amount of compensatory damages as punitive damages, if they think such a thing is warranted.

in other words, with an $11 million award on Friday, the Jury has the option of adding on another $22 million.

Unfortunately it's the same way here. My daughter used to work in a retail shop here which sold nice women's clothes. There was a shoplifting ring which would come around every so often and steal them blind. They knew who they were, they knew when they were in there what they were doing, yet because the ring was composed of minorities the corporate headquarters told them to leave them alone because they were afraid of a lawsuit.

It made the manager of the store and all the employees livid, but there was nothing they could do. They couldn't call the police, they couldn't confront them, unless they wanted to be sacrificial lambs when the inevitable lawsuit came.

That's probably true - they could never overcome having such horrible clients. Raimondo herself was on the stand, the way the opposing attorney took her apart on the stand was a thing of beauty, a Perry Mason moment, of maybe a Captain Queeg.

A local reporter had written a story about the day of the original protests, and said in his article that Dean Raimondo was standing in the middle of the protests, handing out flyers and directing students with a bullhorn. She publicly accused him of being a liar, said that never happened. So Gibson's lead attorney got her on the stand (now she's under oath) and he asks her, "Now you have stated that this article written by so and so is untrue?" And she says "oh yes he's a liar." And he asks "but he has testified that he went up to you and asked for a flyer, and you personally gave him one that day. Is that part true??" And knowing that other people had seen this, and that she was under oath, she said, "well yes, that is true." And the attorney asked, "Well since he asked you for a flyer, and you gave him one that day, is it fair for him to say that you were handing out flyers?" And Raimondo said "oh no he's a liar!!!"

I very much doubt the Jury listened to a single word she said after that.

Yep. Interestingly, the City of Portland is removing real estate information identifying property owners from being online - there have been problems with stalkers using that information, of course.

It's one thing when records are public, but you have to take a trip to dusty archives to look them up, versus being able to Google the information online in sixty seconds.

I'm not sure, but it wouldn't matter - remember that the State of CO was one of the parties that got smacked down by the SC in the last case.

They seriously didn't think that would happen, the officials involved were obviously surprised and stung by the rebuke, and I am positive they want vengeance.

However, on cases like this, the umbrella carrier is involved in the defense, because it is their excess coverage that comes into play on large verdicts. I'm going to guess that the defense counsel(s) for Oberlin is a card carrying member of the same SJW crap taught in the school. As we see time and time again, logic escapes these people. Any defense attorney who cannot logically look at their case is not very effective. Similarly, I'll be Lexington (who would have separate counsel) could view the case more logically, and they likely sent all kinds of warnings to Oberlin relative to the path they decided to take. I see some merit to the declination of coverage...but other aspects are a little weak. The strong part of that position is that a faculty member willingly aggressively and egregiously participated in dissemination of false information about the defendant.

If you read the post, the insurer is attempting to get out from under paying, but that's a separate legal issue. At the end of the day, the judgment is going to exceed coverage (if it stands on appeal) and the college will dip into its near billion dollar endowment if necessary. With appeals it could be another couple years before the whole thing is hashed out.

My own personal opinion based on observation is that it comes about when Women think they have to "make it' in a Man's world, doing it Men's way. Far too many women think they have to "act like men" to do that, even though they don't really understand what they're doing, so they go all heavy handed on being confrontational and "acting tough" and treating underlings badly. They want to be given respect and authority, but they have no clue as to what actual leadership is all about, and all they can manage to come up with is a sad caricature of it.

Women are comfortable with lateral organizations, collaborations of mostly equal status individuals. The vast majority of men are very hierarchical. Men do not do all that well in lateral structures, and most women are generally terrible at any level in a Hierarchical organization - which is most major businesses today.

A librarian at the small college Doane University in Nebraska has as part of her job description the task of putting together a little exhibit of historical photos from the university archives, displayed in the library lobby. She was told that this month's exhibits theme was "Parties" in the olden days. So she dutifully dug through the archives and found some photos of old parties and cotillions and dances at the University in the early 20th century and displayed a few of them in the library, as instructed.

Next thing she knew what has happening to her, SHE WAS ESCORTED OFF CAMPUS BY SECURITY GUARDS, who seized her keys and told she could not return to university property. Then she got an email saying she was essentially fired (placed on "indefinite leave until further notice"). Treated as if she was a terrorist.

Why? Why???

Because ONE student walked into the library, saw the photos, and noticed that in one of them, some of the party-goers in some 1926 costume ball were wearing (gasp!) blackface minstrel costumes (as was absolutely commonplace in the 1920s), and was so triggered that he or she complained to the administration in an outraged tweet, and the university replied by choosing the librarian as the ritual scapegoat for stoning and the Two Minute Hate:

Josh Mandel pulled out of the 2018 Sherrod Brown race, I thought, due to his wife's cancer. He did lose the 2012 race but there were plenty of reasons for that loss, beyond "incompetence". I admit I was disappointed by the loss though.

Mandel is not a bad guy, IMO, even if he could have done better in 2012. You can't really hold it against him, since he was only 16 at the time. Or looked it anyway.

Well there's going to be some issues there always are in trial like this one. Funny thing is, ohio appellate courts don't like to reverse Plaintiff verdicts. They will if its unavoidable, but the normally do a great job of avoiding that. So, the plaintiff's will probably get paid.

Last June they had a $160 million budget, with a $4.7 million deficit. This lawsuit will make that a $26.7 million deficit. That is 17% in the red.

Oberlin has estimated just this last year that a $9 million deficit was entirely unsustainable in a open letter to the campus. Oberlin's total debt could reach $162 million within a decade.

Oh and I imagine their insurance costs are likely to increase substantially.

So overall this is a swift kick in the nuts to Oberlin.

The trial judge kept a pretty tight rein on things, so it's unlikely there will be a successful appeal. There was ample evidence to support the jury's verdict, and most appeals courts are reluctant to second-guess juries on damage awards, unless the damage awards are just so completely unrelated to the evidence that they're unjustifiable (which was not the case here).
