Was Mueller's Statement His Quid Pro Quo to Jerry Nadler for Not Being Subpeoaed Under Oath?

This theory, via the Morning Briefing's Liz Sheld, sounds plausible in the extreme to me. I think it's almost certainly correct.

Here's the real story, in my opinion, with Mueller's press conference: Mueller doesn't want to be called by Nadler to testify before the House Judiciary because he doesn't want to answer tough questions under oath. Nadler doesn't want to call Mueller because he doesn't want Mueller answering questions that undermine the Democrats' plan to keep a cloud of suspicion floating over Trump until 2020. Mueller and Nadler are communicating because Nadler was pretending to negotiate a Mueller appearance before his committee. Basically, Nadler was like, "I need you to give me something if you don't want to be called to testify." And of course, Mueller was more than happy to hold a press conference where he could recapture his rightful status on all those prayer candles after failing to seal the deal against Trump with his report. I should mention that the Senate Republicans can call Mueller to testify, but I have little faith they will do that because they are sad, weak little men.


A compromise had to be made because the Democrats' planned narrative was derailed with Barr's cut-to-the-chase press conference. But this time, Mueller delivered for the Democrats by insinuating that his team could not charge Trump because of DoJ's regulations not to bring charges against a sitting president...but would have if not for the regulation.

AG Barr testified under oath otherwise about the DoJ regulation. Barr said that Mueller told him three times it was not the case that the OLC regulation prevented him from bringing charges. I believe Barr, who made this assertion under oath, over Mueller, who does not want to make any statements under oath. There were also witnesses to this conversation. I wonder what they have to say.

She also speculates -- and many have speculated about this -- that Mueller's game-plan with the release of the report was to feed his "summaries" to the media, which would pump up the notion that Trump committed crimes which are just not being prosecuted because Whatever YOLO. Some, for example, find it intriguing that a New York Times reporter had lots of background information ready to go within hours of the report being released to Barr.

Barr sniffed that plan out and then blew it up by not releasing his own summaries, but instead releasing a short letter stating the report's top-line conclusions: No collusion, not enough evidence of obstruction to charge.

This put Mueller and his corrupt henchman Weisman in a difficult spot: They'd intended the report to be an indictment without any actual charges, but now Barr was ruining everything.

And so, since then, the anonymous quotes fed to the usual suspects. Trying to do everything to get their precious Narrative back.

Alan Derschowitz breaks from his previous defense of Mueller and now calls him an out-of-control partisan and abuser of prosecutorial power:

The statement by special counsel Robert Mueller in a Wednesday press conference that "if we had confidence that the president clearly did not commit a crime, we would have said that" is worse than the statement made by then-FBI Director James Comey regarding Hillary Clinton during the 2016 presidential campaign. Comey declared in a July 2016 press conference that "although we did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless in their handling of very sensitive, highly classified information."

Comey was universally criticized for going beyond his responsibility to state whether there was sufficient evidence to indict Clinton. Mueller, however, did even more. He went beyond the conclusion of his report and gave a political gift to Democrats in Congress who are seeking to institute impeachment proceedings against President Trump. By implying that President Trump might have committed obstruction of justice, Mueller effectively invited Democrats to institute impeachment proceedings. Obstruction of justice is a "high crime and misdemeanor" which, under the Constitution, authorizes impeachment and removal of the president.

Until today, I have defended Mueller against the accusations that he is a partisan. I did not believe that he personally favored either the Democrats or the Republicans, or had a point of view on whether President Trump should be impeached. But I have now changed my mind. By putting his thumb, indeed his elbow, on the scale of justice in favor of impeachment based on obstruction of justice, Mueller has revealed his partisan bias. He also has distorted the critical role of a prosecutor in our justice system.

No prosecutor should ever say or do anything for the purpose of helping one party or the other. I cannot imagine a plausible reason why Mueller went beyond his report and gratuitously suggested that President Trump might be guilty, except to help Democrats in Congress and to encourage impeachment talk and action. Shame on Mueller for abusing his position of trust and for allowing himself to be used for such partisan advantage.

Of the 10 items mueller listed, only 2, possibly 3 hold up at all (meaning they arent just some random theory based on an out of context email or similar) and those 2-3 are completely consistent with trumps innocence and general frustration of being falsely accused and being unable to fully focus on his most important job

There are 10 "possible instances of obstruction" in the Report, but every one of them is weak. For example, #4 is Firing James Comey - the left has always wanted to impeach Trump because he fired James Comey, even though Trump had the right and the authority to do it.

Dershowitz is truly an Honest leftist, and his other party members have begun to hate him for his honesty. He won't let go of it, which is very rare.

He gave Mueller the benefit of the doubt as long as possible, which was frustrating but fair. As soon as Mueller finally openly demonstrated that there was no doubt at all anymore about his motives, then Dershowitz called him out on it, and said that Mueller was a disgrace to law enforcement.

When you have rule of law, the cops investigate *crimes* to try to find the *men* who committed them. This, however, was the cops investigating *men* to find *crimes* they may have committed.

I have always had a problem with this. To this day the only people who have examined the DNC server are from CrowdStrike which in turn was hired by Perkins Coie. The DNC refused to let the FBI ever look at the server.
