In an Ultrafast Decision, An Obama Judge Immediately Rules That Trump May Not Block Congressional Harassment Efforts to Dig Into His Taxpayer Records
Congress has no authority -- none-- to conduct a criminal investigation.
That's an Executive branch function. But even assuming that Congress may exercise its pretend "oversight" function and it needs Trump's tax records to do that -- how the hell can it demand his private taxpayer records when he was a private individual with no connection to the US government? That's what they did -- they demanded his last eight years of tax records. He's only been a president for two, and he was only running for president since June of 2015 or so. So now the Congressional Democrats can just demand private citizen tax records when they want to conduct a lawless vigilante invasion of privacy? Indeed, says another Obama appointee -- in record time, as Mark Levin pointed out.A federal judge on Monday upheld a congressional subpoena seeking President Donald Trump’s financial records from an accounting firm, arguing that Congress is well within its rights to investigate potential illegal behavior by a president -- even without launching a formal impeachment inquiry. U.S. District Court Judge Amit Mehta's ruling delivers a striking blow to the president's efforts to resist Democratic investigations, and is certain to give Democrats further legal basis to investigate Trump, his finances, and his presidential campaign. In addition to upholding the House Oversight and Reform Committee’s subpoena to accounting firm Mazars USA for eight years of Trump's financial records, Mehta took the extra step of denying the president's request for a stay pending appeal.In other words, he took the decision out of the hands of the Appeals Court by saying that the firm must turn over the records before the appeals court has had a chance to check his ruling.
Jay Sekulow, one of the president's personal attorneys, said: "We will be filing a timely notice of appeal to the D.C. Circuit Court of Appeals."But unless the Circuit Court issues its own emergency stay, then this appeal will be moot -- this Obama judge has rigged the game to get the records to Democrats before the appeal. Meanwhile, Trump has directed his former WH counsel Don McGahn to ignore the Democrat congressional subpeona.
"The Department of Justice has provided a legal opinion stating that, based on long-standing, bipartisan, and Constitutional precedent, the former Counsel to the President cannot be forced to give such testimony, and Mr. McGahn has been directed to act accordingly," White House Press Secretary Sarah Sanders said in a statement sent to reporters.The DOJ's own Office of Legal Counsel wrote a memo declaring this to be their understanding of constitutional law.
The White House letter to House Judiciary Chairman Jerry Nadler was signed by Pat Cipollone, the current counsel to the president, citing the Justice Department’s advice based on executive privilege.
In an opinion released Monday, the Department of Justice's Office of Legal Counsel ruled that former White House counsel Donald McGahn is "not legally required" to testify to Congress on matters related to Special Counsel Robert Mueller’s report. "The immunity of the President’s immediate advisors from compelled congressional testimony on matters related to their official responsibilities has long been recognized and arises from the fundamental workings of the separation of powers," the opinion stated.

Funny how there was a headline yesterday on MSM saying how Gorsuch had sided with the 4 Liberal Judges.
Case was does an Indian Treaty from before an area became a State, still have legal standing.
Stare Decisis said no, Gorsuch looked at the case and said yes.

Republicans need to grow a spine and start to become even more insistent that rules and the law be followed and never back down or give in. Ever. And if Prog judges try to circumvent the law, then they need to be impeached ASAP. Like, starting this afternoon. Push that hard and point to the law as the justification for the impeachment. "If this judge cannot see the law, he is unfit for the bench." Get him out right now.

Trump really needs to speechify about this. He needs to somehow light a brush fire under the SCOTUS by bringing the abuse (and the total disregard) of the Constitution to the forefront about these political operators that call themselve judges.
He should also do the same with the senate judiciary committee.

I took a quick look at the language and was an endless chain of "communications regarding" every tax matter to every type of professional in every part of the "Trump Organization."
Basically full compliance would required almost a full shutdown of the Trump Organization and occupy hundreds if not thousands of hours of time of everyone from DJT on down. Not to mention that you have a qualified privilege to talk to your tax lawyers.
Outrageous harassment and DJT needs to go on TV and start reading the "Subpeona" to the American people to give them a sense of the sheer scope of this harassment shit sandwich they are trying to feed the American people.

So, now the circuit court has to issue its own emergency stay. These are typically granted, and if the DC Circuit refuses to do so, I imagine the denial of a stay will be immediately appealed to SCOTUS.

I'm trying to get some other work done but off the cuff I think he can still go for some kind of Temporary Restraining Order. Exactly where I'm not sure.
The problem is that to get a TRO you generally need to show "irreparable harm" and "likely success on the merits."
The latter is easy. The former would be hard/abstract, and just the harassment factor may not satisfy the standard.
And its too easy for a Judge to deny a TRO by saying you just havent proved the "irreparable harm."
I think DJT needs appeal to the American people.
Then maybe slow walk partial compliance, move for adjournments and legally grind it out until he can get it to the Supremes.

Not possible, the Accounting firm cannot ignore the Judge, because a Judge can issue a Contempt of Court citation and have every principal member of the firm jailed until they produce, on his own authority. You can't do that to the President, but you can do that to Business owners.

Especially since the judge expressly acknowledged the documents will almost certainly be leaked and therefore any later stay would be ineffectual to remedy the harm.
ALSO the firm who will be the subject of the subpoena will NOT be turning over the documents on that day (presumably, unless they have already said they have everything ready to go) and that could buy a few days for the appellate court to act.
This is awful, awful, awful.
The rule making power exists but there is NO REASON to see TRUMP"S as a private citizens' tax records so that they can supposedly craft appropriate rules for disclosure. Let them disclosure their own financial records, if they need an exemplar to work from.

That said, I do think that we should have a constitutional amendment that requires all presidents to show proof of everything any average person needs to in order to get any other job. Proof of citizenship, etc. And since this is such a high risk, high security job, even greater level of transparency including, yes, tax records and school transcripts.

I think it will become like software, where you no longer purchase it and physically own it, instead you subscribe/lease it. Or like an electronic book that you put on your kindle, but Amazon can still alter or remove it.
