Gowdy: FBI Probably Has Exculpatory Evidence About Trump-Russia Collusion, But Didn't Reveal It To the FISA Court When Seeking Warrants

"If the bureau's going to send in an informant in, the informant's going to be wired, and if the bureau is monitoring telephone calls, there's going to be a transcript of that," Gowdy told host Maria Bartiromo.
Gowdy continued:

[T]here is some information in these transcripts that has the potential to be a game-changer if it's ever made public.

Gowdy, who served on the House Intelligence Committee, said he and Texas Rep. John Ratcliffe have seen the potentially exculpatory documents. He said he hopes the public will one day get to review it.
"If you have exculpatory information and you don't share it with the court, that ain't good. I've seen it, Johnny [Ratcliffe] has seen it. I'd love for your viewers to see it," he said.

Yes and while the leaders, Comey, McCabe, Strozk Me, Page need to go to prison I wouldn't leave it at that. The alleged misconduct was a discovery violation of failing to disclose an alleged deal between the prosecution and a jail house snitch witness. These documentaries often dumb the legal stuff down to the extent that you can't really tell what happened but, reading between the lines, I think the Supreme Court judge (which in NY is the trial court) ruled as a factual matter that there was no deal made and no benefit conferred and so nothing to disclose and therefore no misconduct. The Appellate Division (which is what they call the court of appeals in NY) reversed that and vacated the conviction. The prosecution has appealed to the Court of Appeals (which is what they call the supreme court in NY) and who knows how they'll rule?

But anyway, I liked it better when you could basically trust the prosecution and the courts.

I've actually been saying this for a couple years.

Congress only does oversight hearings. They have zero power to indict or arrest anyone. The often whispered about jail in Congress is being used as a storage closet for Lincoln's caisson. It's never been used because Congress powers to arrest are like Bigfoot, mythical.

The hearings are useful for informing the public particularly when we have a DOJ that doesn't leak like the one we have had since Trump took over and got supercharged when Sessions and Coats started a leak task force in the summer of 2017.

The dynamic tension we often see with Congress railing at the Executive branch to turn over documents is mostly kabuki. They are supposed to be in conflict.

Congress does oversight, writes reports and from time to time makes criminal referrals to the DOJ. If there is going to be criminal charges it will come from the DOJ.

A couple of reasons.

First, he was - like all GOPe types - trying to throw the House to the Dems. Mission accomplished there. Anyone remember the "historic" number of retirements?

So even with a safe seat, Gowdy spread the GOP that much thinner.

Plus, he'd be a minority committee member, so less opportunity for graft.

Now he gets a new career to preen and strut and act like he totally was on the brink of uncovering all this stuff, but for Obama, sunspots, etc.

And maybe he runs for Senate or governor down the road?

Due to the very nature of a FISA warrant a very high bar is put on the FBI when they submit an application for a warrant. Not only do they swear that the person they want to surveil is working for a foreign government as a spy against US interests they must swear that all of the information has been verified.

They also must present any exculpatory information they have on the target. This is critically important because the whole process is done in secret and there is no lawyer or representation for the accused. The FBI must play both sides and they must be fair.
