I think suck "exculpatory evidence", would in fact be evidence of crime *by the FBI*, actually the most serious charges we might see in this whole affair. Fraud upon the FISC to obtain the warrants.
Thus the *public* seeing this is not only somewhat secondary, it's *implied* in the process that is presumably under way right now. For this reason I find Gowdy's wording a bit odd. Oh - and Horde, good thing ace linked you to Undercover Huber. WSJ says the House Democrats just passed a bill euphemistically called the "Equality Act", designed to offer very far reaching legal superiority to LGTBQ people.
One explicit provision is to require in all states that men claiming to identify as teenage girls will be permitted access to girls locker rooms. Also, that pedos, once they gain "equal rights" will be allowed to groom your kids in their schools, at scouts, or wherever. Because, rights. Orwell is smiling. Jay, while the narrow point here of course is valid, tragically you gotta be careful about over-generalizing. In particular - the judicial branch has been legislating, increasingly, and more brazenly than ever. The constitutional order is a shambles, top to bottom, in that regard. Of course that's tied up with congressional abdication of power, and it starts to get complicated. But the judicial lawlessness aspect is central, and urgent.

It's called the "power of the purse." Piss off Congress? No budget for you. The GOP controlled both houses and therefore the entire budgeting process. Anyone remember how when the Dems got control, they gave up on running budgets and just did "continuing resolutions?" And then the GOP totally SWORE on a stack of Bibles that they would revert to "regular order" and use the time-established budget system. Spoiler alert: they didn't. Gowdy and his gang of liars could easily have broken up the budget into the component pieces that were used for the first oh, two hundred years of the Republic and then tweak each item. So DoJ won't give documents under subpoena? Gosh, there goes their payroll! State Dept. can't find Hillary's emails? Gosh, no payroll until they do! This is not new people, all legislatures have his power, but only the GOPe in its new incarnation as Democrat gimps seemed to have forgotten how to use it. How about PLANTED evidence, as in leaking your rumors to Yahoo to cite the Yahoo article in support of your FISA application? How about planting a spy to suggest to a Trump advisor that the Russian's have Hillary's emails, then citing his "comments" about it to a foreign intelligence service as evidence of collusion. How about trying to plant 10,000 in currency on Carter Page? This "withholding exculpatory evidence" is weak tea that would only impress Fey Gowdy's fellow law weenies. Related: There was a documentary (on NBC's Dateline if I remember right) about a murder conviction being overturned because of prosecutorial misconduct. The kicker is that the prosecutor in question, Anna-Sigga Nicolazzi, is the host of ID Channel's True Conviction crime documentary series.
The alleged misconduct was a discovery violation of failing to disclose an alleged deal between the prosecution and a jail house snitch witness. These documentaries often dumb the legal stuff down to the extent that you can't really tell what happened but, reading between the lines, I think the Supreme Court judge (which in NY is the trial court) ruled as a factual matter that there was no deal made and no benefit conferred and so nothing to disclose and therefore no misconduct. The Appellate Division (which is what they call the court of appeals in NY) reversed that and vacated the conviction. The prosecution has appealed to the Court of Appeals (which is what they call the supreme court in NY) and who knows how they'll rule? But anyway, I liked it better when you could basically trust the prosecution and the courts. >>Them quit with the masturbatory fantasies and hearings and throwing subpoenas around and admit to John Q Public that the only thing you can hold is a circle jerk.
I've actually been saying this for a couple years. Congress only does oversight hearings. They have zero power to indict or arrest anyone. The often whispered about jail in Congress is being used as a storage closet for Lincoln's caisson. It's never been used because Congress powers to arrest are like Bigfoot, mythical. The hearings are useful for informing the public particularly when we have a DOJ that doesn't leak like the one we have had since Trump took over and got supercharged when Sessions and Coats started a leak task force in the summer of 2017. The dynamic tension we often see with Congress railing at the Executive branch to turn over documents is mostly kabuki. They are supposed to be in conflict. Congress does oversight, writes reports and from time to time makes criminal referrals to the DOJ. If there is going to be criminal charges it will come from the DOJ. When I mentioned Congress abdicating its power, I was thinking, and largely, of the power of the purse, which is its clearest constitutional power, and which it has nearly completely abdicated. Note that the Dems' descent into whatever it is they are now has included total abandonment of one of the key things the founders counted on to maintain balance - jealous of their power/prerogatives. Dems in Congress, since Obama in particular, have taken a purely partisan approach on this. And GOP .... well. The recess appointment fight under Obama was an astonishing, and appalling, spectacle for anyone familiar with the history of congressional-executive wrasslin' matches. Power of the purse, jealous protection of institutional prerogatives - poof, just gone. Posted by: rhomboid at May 20, 2019 05:32 PM (QDnY+) 198

Due to the very nature of a FISA warrant a very high bar is put on the FBI when they submit an application for a warrant. Not only do they swear that the person they want to surveil is working for a foreign government as a spy against US interests they must swear that all of the information has been verified. They also must present any exculpatory information they have on the target. This is critically important because the whole process is done in secret and there is no lawyer or representation for the accused. The FBI must play both sides and they must be fair. Papa has claimed for a long time that he told Mifsud, Downer and Halper that he wasn't working for the Russians, had never worked for a Russian government official and in fact didn't even know any and was not looking for Hillary's emails. All of that is exculpatory information and it was never presented to the court. If there are recordings were he did say that the FBI is screwed. They were screaming it. No doubt you heard it on CNN and MSNBC. No? Maybe read about it in WaPol or the NYT? No? We have always known that the media was in the tank for the left but thanks to these investigations we know have proof that they were in many cases in league with the FBI/DOJ. They were helping tank stories and build narratives. And we know that Comey and Loretta Lynch, Strock, Page, Baker and McCabe to name a few had no intention of ever prosecuting Hillary. was promised by the US Government to be allotted to the Crow Tribe forever, as hunting grounds. Yeah fair or not that was the deal, a treaty signed by the US government. Posted by: Christopher R Taylor at May 20, 2019 06:02 PM (39g3+) The treaty allowed for hunting on unoccupied lands. A Federal Park is occupied . Simple as that. This was nothing more than SJW signaling. Posted by: Can't resist temptation at May 20, 2019 06:34 PM (2DOZq) 345

Posted by: Jean at May 20, 2019 06:38 PM (25Dt7) I don't disagree but this was specifically in a National Park as opposed to a land grab. Posted by: Can't resist temptation at May 20, 2019 06:54 PM (2DOZq) Processing 0.04, elapsed 0.0455 seconds. |
