FOID (Firearm Owners Identification Card) Ruled Unconstitutional In Illinois

Well, this should be interesting! Apparently a judge doesn't think that it is appropriate for the state to tax and regulate our rights protected by the 2nd Amendment to the United States Constitution.

People v. Brown - FOID ruled unconstitutional in IL District Court

Of course Illinois is appealing, and I assume that some judge or judges will eventually find in the state's favor, but if this goes to the United States Supreme Court we have a shot at winning.

Ignoring the patently offensive idea of an FOID, what's the point? Most purchases include an NICS and a 4473, so it's just typical government harassment. And since New Jersey is making noises about jacking up the fees for its own FOID, and requiring regular reapplication (instead of the current lifetime card), I have a vested interest in this case.

Nothing builds a strong, healthy society quite like marijuana and gambling.

If it's any consolation, they'll probably screw that up too. California thought utopia was nigh when it legalized marijuana, but they added so many regulations and so much tax that the illicit market still thrives, and the state is collecting bupkis in tax.

Because, believe me, Connecticut is as restrictive as you'd want it to be. Submitted Permit application on August 28, called the officer on December 11 and again two weeks ago and in each case he said he was almost done and would get back to me next week.

They can't help it, they have backed themselves into a corner where tax increases is their only option. It goes without saying (or at least is should) that having our freedoms depend on some unelected gaggle of judges opinions is wrong. Our Founders never would have stood for that.


Our freedoms should be strongly defended and absolute to the point where they would never need to be challenged by progressives who wish to strip us of them by any means necessary.
Government needs restrictions, a line beyond which they cannot go and will not be allowed to go. "No" should mean "no" in no uncertain terms.

53 As a New York City resident with the extremely rare NYC firearms permit, I find this to be an interesting story as well.

I don't so much mind the 12 months (and 2 days) it took me to get it, or the $1,200 in legal advice the paperwork required, or the fees for the permit. I don't mind that they asked to see my complete driving record from every state who has ever issued me a driver's license since 1980. I don't even mind the mandatory registration of the gun. (Well actually I do mind all those things, but complaining doesn't get me anywhere.)

But the part that really annoys me is that the transfer laws are so strict, that I can't take anyone to my local Manhattan shooting range and let them try out my lovely G30S with a Trijicon RMR, unless they too have a permit. I am also annoyed that if I bring 2 boxes of ammo to the range and buy another to shoot while there without using one up first, I have committed a separate crime of ammunition hoarding.

NJ is tough. I have a relative who is a mayor in a deep red county and another who is a superior judge, and still couldn't get a carry permit. (That's how many things are just done in NJ) But at least when I was there I could bring 5 guys to CJRPC and shoot all day without having to get FFL's to sign off every time someone wanted to take a turn at shooting.

I was incensed when I first read that, but then realized that they don't mean taxing holdings, but rather taxing disbursements from 401(k)s as ordinary income, something that a lot of states - including California, natch - do already.

Oh, please stay incensed. You cannot even begin to imagine the number of retirees who will be leaving IL if this happens. Many retirees have other sources of income besides IRAs and pensions (rental property, agriculture, part time jobs for example ) and that income tax will also be lost to the state when they leave.

And yeah, I'm going to whomp on this for a while. We have a serious, clear and present danger to our country from her domestic enemies. They're operating out in the open now and will take away every enumerated right we ever had if we don't stop them, the sooner, the better.
We need to get a bit more insistent that government start doing our bidding instead of the opposite. Take the Mexican border for instance: Poll after poll shows overwhelming support for securing it, yet progressives in Congress openly and proudly defy the wishes of the people, so much so that these anti-Americans are doing more to defend the imaginary rights of people who aren't Americans.
What sense does that make? More importantly, why are we the people tolerating that when we don't have to? There is absolutely no excuse for the situation we find ourselves in today with regard to our own government.

172 53 - Tom, thanks for the update on NYC firearms laws. They've gotten worse since my target practice permit in 1988. Then it took 8 months, a background check, fingerprints and photo, membership in a NYPD approved range, a 24 hours deadline to register after purchase, locked container to transport the gun. I didn't drive then so my driving wasn't an issue but they wanted to know about any therapy I had. Ammo hoarding wasn't a issue. I went to the range at 20 w. 20th street until I found a nicer one downtown.

FYI, if/when you leave NY, hold on to the transfer paperwork and keep it handy. Five years after I transferred the guns to Florida the NYPD called asking about them!! Lucky I had the paperwork and read the numbers and info to the cop of the phone. She sounded disappointed. Five years on.

No sarc intended. I have no beef with Chik-Fil-A, and if they choose to close Sundays, I am fine with it. If I am driving down a road lined with fast-food joints, I have a lot of easily-exercised choices in where to eat.

Not so in an airport terminal. There are a limited number of food/beverage outlets in any given gate area, and to get to another gate means a long hike, so I would like for whatever outlets are at my gate to be available 24/7.

If CFA were to make an exception to their Sunday-closing rule for airport outlets, I would be fine with them being there.

Thing is, I don't ever have to go to a stadium for any reason. If I want to travel by plane, I have to go to an airport. And sometimes I have to spend time in East Whoop-whoop airport, by reason of changing planes, despite having no desire to ever visit that city. Airports are public accommodations much moreso than are stadiums.
