Lin Wood Files $275 Million Lawsuit Against FakeNews Enemy-of-the-People CNN

Before the media onslaught, "Nicholas Sandmann was a 16-year-old man who had a perfect reputation: he was loved by his parents, respected at his school, and had many good friends at Covington Catholic High School. So he was a person that was doing very well in life and due to his strong character, he still is," the lawyer said.

"But nevertheless, his character has now been determined by the lies issued by CNN. So the facts were not first, the lies were," McMurtry added.

Fox News played a clip of the video that CNN spread at 7 a.m. the day after the incident.

"Sending out a short snippet like that at 7 a.m. after the event happens is totally irresponsible, completely negligent, and in our view subject to punitive damages," the lawyer said. "They did this without any reasonable investigation. They took something straight off Twitter that had been, in essence, manipulated so that it told one story and they reported it as the truth."

Before filing the lawsuit, Sandmann's lawyers gave CNN an opportunity to retract. "They did not retract within the timeline provided for by Kentucky law. So their opportunity to retract is now passed. So we will proceed for our lawsuit for both compensatory and punitive damages."

Todd McMurtry said he expects to file a new lawsuit every few weeks, and that he's looking closely at NBC, AP, HBO (due to Bill Maher), and even Kathy Griffin, for calling for a doxxing of innocent boys.

Actually, I would have to respectfully disagree. A court imposing damage awards on a speaker in a civil case is considered state action, so the First Amendment is always in play in a defamation case. (The New York Times isn't a state actor either, but in New York Times v. Sullivan, the Supreme Court stepped in and limited the power of a court to punish speech against "public figures" on First Amendment grounds.)

I'm not an atty, but after listening to Lin Wood's calm determined explanation of what is his lawsuit filing's purpose and his rationale behind them, I'm betting on Wood. The damage purposefully done to a minor for a political purpose. As he told Levin, Nicholas Sandmann is simply collateral damage to the media. Their real target is Pres. Trump, and they will use anyone and anything to try to damage him.

I was also impressed with his take down the next day of Judge Nap, who according to Wood , shouldn't be on TV if he doesn't know the law, LOL. Wood actually cited the specific statutes, etc. that are in effect here. This is Wood's specialty, and his experience. He's not just some random lawyer who is being financed by a SJW group. He's been doing this type of defense for a long time, with well known clients.

Believe it or not, there's actually a doctrine under which a private person like Sandmann can be deemed an "involuntary public figure" so that the "actual malice" standard of New York Times v. Sullivan can be applied. (Defamation defendants in a media case are always claiming that the plaintiff is an involuntary public figure if he or she is not an actual celebrity.)

The cases that apply this label to a private plaintiff are extremely rare and I don't remember what elements have to be present for it to fit. I do have a vague recollection that there was a big fight in the Richard Jewell case over whether he qualified for the title.

Facebook also pressures your friends to pull you back in (or they used to, anyway). A friend of mine (a real friend who was also a Facebook "friend") once forwarded me an E-Mail that said something like, "It looks no one has connected with Mannix recently. I do find the transformation into the sandworm god to be almost heartbreakingly tragic for some reason. Losing your humanity like that...it was almost a horror story.

That is why I loathe Sullivan as applied.

I doubt highly that the involuntary public figure approach will work here because the defamation itself made him a public figure.

It is also different when you are dealing with minors because the law grants additional protections to minors.

Lin Wood knows his stuff. To be fair, this is all tainted by how much I detest Sullivan as applied and thus I want there to be a case like this that lets Justice Thomas throatpunch Sullivan as it deserves.

As Calm Mentor notes above, SCOTUS has ruled that your defamation cannot be the predicate act that makes the defamed a public figure. And like I noted, Lin Wood says he believes he can satisfy the actual malice standard, in any event.

That movie was a heartbreaker for me, since I had looked forward to it for years, I so much *wanted* it to be a good movie, and it came so close to being a Good Movie -

but it was not a good movie. It was like a team that plays a pretty good game, and then chokes it all away at the end. They never understood the elements that made the first Blade Runner so legendary, they never understood why that one worked. You can't recreate what you don't understand.

446 Dune is a great book. I think the attempts at making it into a movie fall short because the book has a lot of "thinking" going on. Lots of inside of head being put on paper, but not a lot of dialogue. I haven't read it in a while so my memory may be a bit flawed.

I don't think that that's really relevant. It's an aggravating factor, but I think smearing anyone like that should be actionable.

Arguably, it could do more damage to an adult, who could be fired, lose his house, etc. It could influence Sandmann's applications to college, but by the time he's an adult this will have blown over, and few people will remember him.

474 446 Dune is a great book. I think the attempts at making it into a movie fall short because the book has a lot of "thinking" going on. Lots of inside of head being put on paper, but not a lot of dialogue. I haven't read it in a while so my memory may be a bit flawed.

I have more than several 22s for which I have let's to say considerable inventory My Philosophy is that even a relatively untrained person can shoot a 22 effectively I have gone both routes with my 30 ought 6 feel the need to update my inventory by about 500 rounds buying in bulk does happen to get mrs. Sock monkeys attention and I receive a very hard to read eye roll if I buy several boxes of 20 every trip into town she doesn't even notice
