Fairfax Accuser Brings Sexual Assault Complaint to Boston D.A.

The media is going to find it harder and harder to downplay this, and to justify downplaying it when they eagerly hyped up Blasey's allegations.

Blasey never specified a date or place or even a year.

And she certainly never went to the DA. She went to... her "beach friends."

A woman who accused Virginia Lt. Gov. Justin Fairfax of sexually assaulting her in Boston nearly 15 years ago will meet with prosecutors to discuss her allegations, her attorney said Wednesday.

Vanessa Tyson will meet with members of the Suffolk County district attorney’s office to detail her accusations against Fairfax, attorney Debra Katz said in a statement. It came days after District Attorney Rachael Rollins sent a letter to Tyson's legal team to inform them that her office is prepared to investigate should Tyson file a criminal complaint.

"Usually in sexual assault cases we are not public in any way, but this individual chose to self-report and issued a statement and has a law firm and I felt compelled quite frankly to make sure that her firm knew that we stand ready, willing and able to assist in any way possible," Rollins, a Democrat who took office last month, said in an interview Wednesday.

I'm not sure what this alleged crime would be categorized as. Per this site, the Massachusetts statute of limitations for rape or assault with the intent of committing rape is 15 years, so she would just barely get her complaint in before the statute of limitations tolled.

But that's for rape. Other crimes have statutes of limitations of six years.

Per this site, Tyson's allegation could certainly be categorized as "rape" within the Massachusetts criminal code's definition.

In Massachusetts, rape means the penetration of any bodily orifice by any part of the body, or by an object, Performed against the victim's will, without consent, and with the threat of or actual use of force.

Now, the problem is with "the threat of or actual use of force." Now she does allege he "forced" her head down, so arguably that brings it within the definition. At least as far as what she alleges.

Thanks to Duke Lowell.

45 I've been saying this from the beginning - the biggest mistake the left has made from the start of this mess has been to pretend that telling a bad joke 30 years ago is THE EXACT SAME THING as committing a felony. Newsflash - it isn't.

And as far as who resigns - it's all about leverage, it always is.

Leverage on Northam - none. He already knew he was never going to run for office, and he can't be impeached. (that little thing about actually having to prove a "Crime" as opposed to having a bad sense of humor) So what can make him resign? Nothing.

Same goes for Herring - what leverage does anyone have on him? None.

Fairfax, on the other hand - MAYBE if you resign you won't be spending the next 15 years in the Massachusetts State Pen. Maybe. But maybe it's too late for that already.

Now that's what leverage looks like.

To be fair -- it's hard to write a law.

Especially for something like rape, which is a very ... charged issue.

A lot of states used to have VERY specific definitions of rape like "forcibly violated a victims genitals" and things

But then you get the guy who anally rapes another guy in prison... and his defense attorney argues that the anus is not a genital.

Or forced beejers.

Or a situation where a sicko rapes a woman (or man) with a foreign object. That's still rape, right?

Anyways, you can see how it gets complicated.

Posted by: Blonde Morticia at February 14, 2019 02:21 PM (13CQC)

Right. Anti-rape advocates (I dont know what else to call them) got a lot of laws changed to remove "forcible" from the definition of rape for situations like that.

"well, your honor, she was passed out drunk by her own admission, my client didn't use any force whatsoever. So under the laws of our state, this was not rape."

So people were getting off with misdemeanor sexual assault charges when what they did was clearly rape in the vernacular, if not legal definition of the word.

everything happens in porn. that does not mean it makes sense.

so does having a guy quit having sex in whatever way he is having sex with some hot girl so he can whack off while blowing his load on her face, chest, whatever. why would someone do this. really inconvenient.

191 Anyways, you can see how it gets complicated.

Posted by: Harry Paratestes at February 14, 2019 02:23 PM (GBteo)

It only gets complicated because our courts have made a mockery of written law. But to write a law so broad as to actually include a 10 year old giving a wet willie to another 10 year old on the school playground (if a prosecutor felt so inclined) is just crazy. That's the sort of law that shouldn't be written, to start with.

It's not all that difficult to write laws that cover pretty much all the actual rapes and sexual molestations you are going to run into.

Can everyday people come together and effectively organize against
creeping overreach of one of the world's biggest corporations?

Yes, they can.

Posted by: SMOD at February 14, 2019 02:32 PM (QkjLD)

Eh. Lotta righties gloating about what they believe to he a Pyrrhic victory for AoC and her cohort, but as you say, I think that this is something Left and Right ought to come together on.

Massive tax bribes for a megacorp that got a FEDERAL TAX REBATE on their $11.2B (rebate amounting to $129M per the EMT) to build their new HQ in NYC was quite frankly disgusting, insulting, infuriating, and a whole lot of other words ending with -ing.

That I should ever agree with Elizabeth Warren or AoC on anything is annoying, but they were right on this. Of course, both Warren and AoC will gladly burn taxpayer money everywhere else, so my agreement with them is of course limited.

Some Lefties (the more honest ones) are right in their criticisms of the plundering of the American citizen and their taxes by big business. It is simply that their solutions are no more correct than the solutions espoused by the Righties that enable this plundering, and secretly or not-so-secretly profit from it.

Flat Tax, no exemptions for anyone or anything. Every individual, every corporation, every private entity pays the same bloody rate and there is no escape from it, and if an individual does not pay taxes, or receives money from the Fed or States, they may not vote. That's the answer.

301 OT (and it's kind of a serious blog misdemeanor to go OT when oral sex is the topic, I admit it): lots and lots of disastrous Fail in the appropriations package, but also something more.

Simplified, there's a provision that not only would worsen (vs. fix) the ongoing disaster of "unaccompanied minor/family unit" illegal migration (which is surging, and will not be much affected by barriers), but would literally create *another* very strong perverse incentive for HUMAN TRAFFICKING IN CHILDREN.

That such a thing could even be proposed, even in the committee process, is fairly stunning. Not sure if it's a silver lining of sorts that I *still* can be shocked by the depraved irresponsibility of so many elected officials, and the voters that put/keep them there.

Posted by: USNtakim profoundly deplorable. at February 14, 2019 02:44 PM (0OmEj)

Elderly might be one thing, and disabled veterans sure, that makes sense. But what should be said about the disabled?

It sounds terrible to say, but look at the underlying reason behind "No taxes, no vote." If you receive money from the federal government to subsist on, you have a direct incentive to vote for those who promise you more, or the most.

That's the entire reason behind taxpaying citizenship. How many caveats should be carved out before you're right back where we are now? Single moms? People with partial disabilities? Single fathers who can't make ends meet?

True, my sympathies lay in the direction of we need to help these people, but letting my thinking stop there would simply make me an honest Leftist, no?

We must be driven by reason every bit as emotion. Balance is the trick. Real justice, not the stuff the Left pretends at.

Why did her allegation first get made more than a decade later, in the midst of the "me too" hysteria, when her alleged attacker was running for public office?

I agree, in principle. Everyone who gets a welfare dime also gets a 1099 every year. And a flat tax bill on that amount.

You don't pay the tax bill, you get it taken out of Social Security.

Too many people park themselves on the dole all their lives, then get Social Security at the end? F that.

A) those are the issues that were at the heart of every one of the Weinstein allegations. Why women are shamed and scared to come forward with allegations about powerful men.

B) Fairfax has already (in my thinking, stupidly) admitted that they had a sexual encounter. Now there is no need at all to prove that "it" happened, he admitted it. The only question is, was it consensual, or wasn't it? That's a question for a jury to decide, based on the testimony of the only two witnesses to the event. (which is all you ever have in any rape case)

I'm no lefty but citizens are citizens I don't see how you can remove a right without due process. Being poor is not a crime. Being disabled (veteran or not) is not a crime. I suspect you need too think harder on this one. Sure the non tax payer has a different take on the role of government but the non payer or the low payer still has rights.

BTW. I'm disabled on ssdi not by choice and a veteran.

Ace, Salon has an article about how Trump is ruining everyone's sex lives. It's precious:

https://tinyurl.com/y57yx8ln
*

Holy shit...

"Donald Trump is a right-wing authoritarian and aspiring tyrant. The fascist conception of the State is very masculine in the most crude and basic sense. In this way of thinking about politics and society Donald Trump leads a political cult whose members want to literally be inside of him, to become him, to have a libidinal relationship with the Great Leader. This includes both men and women. The fascist aesthetic can be very erotic for the followers.

Trump's supporters want to be spanked by him. Trump's supporters want to be hugged by him. They want to be with him. They want to identify with him.

One of the things about the evil daddy is that he shames you. This touches your sexuality very deeply. Trump does this all the time with his attacks on people and efforts to shift the blame from him and on to others."

these people need help the rest of the article is almost as funny / scary
