Kick Ass: Judge Invalidates New York's Nunchuck Ban on 2nd Amendment Right-to-Self-Defense Grounds

The judge invalidated the whole of the law because she found one part of it unconstitutional and ruled that part could not be severed from the rest of the law. So it all had to fall together.

The part she objected to was New York's declaration that even having nunchucks in your own home was illegal. You couldn't even have them in a locker at a martial arts studio, I guess.

That doesn't seem to invalidate less absurd nunchuck laws in other states, which may only ban people from carrying them.

But -- shouldn't it? If you have a right to self-defense, why can't you carry nunchucks?

Ah well. One cat-stance step at a time.

1974 New York state ban on nunchucks that was put into place over fears that youth inspired by martial arts movies would create widespread mayhem is unconstitutional under the Second Amendment, a federal court has ruled.

Judge Pamela Chen issued her ruling Friday in a Brooklyn federal court on the martial arts weapon made famous by Bruce Lee.

The plaintiff, James Maloney, started his legal quest after being charged with possession of nunchucks in his home in 2000. He initially filed a complaint in 2003, and appealed all the way to the U.S. Supreme Court when the case went against him. The Supreme Court in 2010 remanded the case back down to be reconsidered in light of a Second Amendment decision it had made in another case, and Maloney filed an amended complaint later that year.

Maloney had been focused on getting the part of the law overturned that banned nunchucks, two rigid rods connected at one end by a chain or rope, even in private homes.

In her ruling, Chen said the court couldn't simply take that part out, and ruled that the state's law as it pertained to possessing nunchuks as well as to manufacturing, transporting or disposing of them was in violation of the Second Amendment.

Nonserverability is a bona fide doctrine of constitutional analysis, until we come to Obamacare, and then, Who Cares.

128 Actually, if you wanted to argue that the Second Amendment protects an M-16 but doesn't protect nunchucks, I'd probably buy it. The courts have ruled that the Second Amendment protects the common weapons of war, and nunchucks are no longer common weapons of war.

It's mind-boggling to me that the most common weapon of soldiers in the modern world, an assault rifle, is banned due to being "full-auto" (in quotes because not only actual full auto but 3-round-burst and 2-round-burst are considered "full-auto" and banned).

The ban on short-barreled shotguns from 1934 was passed on the idea that such a shotgun is not used by soldiers. Nobody introduced evidence of their use as "trench guns" in World War I or else perhaps that ban wouldn't have passed at that time.

Of course a ban on nunchucks is just stupid and should be overturned on that basis, even if the Second Amendment didn't apply.

I would argue that a hypothetical "Doomsday Machine" that would destroy all life on Earth is not protected by the Second Amendment. It's certainly not a common weapon of war. But back in the 1700s it wasn't rare for people to own cannons, the "weapons of mass destruction" of their day, and nobody questioned that it was covered by the Second Amendment.

He said he didn't want to sentence an innocent man or something, and made a comment about Flynn being charged under the Logan act, "you mean the act no one gets charged for". Herridge on an update on break said that the judge was also harsh on Flynn too. So I am utterly confused.
I thought electing Trump would solve our problems; it hasn't, it's just shown how pervasive and all powerful the Deep State is, and frankly, if Flynn doesn't have a chance, who does?

Something wrong here - he was unhappy with the plead deal - he wanted Flynn to opt out of it, he accused him of treason and acted like he was ready to put him away for life or something for agreeing to it. Now he adds pressure with a local custody parameter - he's either an odd old coot, or he really thinks something is wrong about this whole thing and he hates that Flynn is caving to the prosecutor's blackmail.

219 Its apparent that this deal is upsetting the judge, either he thinks Flynn is bad and deserves worse treatment than he's getting, or as I believe, that Flynn is not availing himself of the right legal outs that are being offered because he's been steamrolled by the prosecution. We'll see. The pressure is being applied to show Flynn what caving to the SCO might mean so as to change his mind?

What I meant (should have clarified), is I thought Trump would solve our problems because he clearly does not go gentle into that Deep State night, and he would actually FIGHT, instead of GWB, etc doing Lib-Lite with more government assistance shit like the prescription drug plan and 'compassionate conservatism' and getting slagged by the Obamas, only to offer Mooshelle gum on a regular basis.

I mean, who would be super nice to those assholes? They took a nice shit on the Constitution, and made good inroads in destroying the greatest nation ever to grace this planet. But no, GWB has to 'show he is a better man' and be friendly. YOU DO NOT MAKE FRIENDS WITH PEOPLE WHO HAVE BETRAYED THIS COUNTRY. Period.


So I thought with Trumps election, we'd have a juggernaut to get some stuff done for the republic, instead of seeing it get ratcheted back to more liberalism. But I didn't count on the perfidy and depth of the Deep State entrenchment. It actually makes me unutterably sad.
