Dems sent a letter to Mattis telling the military that the idea of thew military building a wall along the Goldwater Range would be illegal. Every time an illegal is found (and they are found there multiple times a day) the range has to be shut down and cleared before our pilots can start dropping?firing again. I think it's apparent what might be happening: there isn't support in the Supreme Court right now for 86ing Planned Parenthood. Taking the case now would mean PP would be sacrosanct for a long time (stare decisis and all that). Kavanaugh & Co. might just be waiting for the Notorious RBG to join the Choir Invisible before taking up the case.

The Supreme Court denied cert in a case involving the question as to whether individual Medicaid recipients have standing to challenge a state's determination of which groups qualify as Medicaid providers. There's currently circuit split on that, with 5 circuits finding there is an individual right and 1 saying there isn't.

Those who denied cert did not issue any opinion as to why cert was denied.

Clarence Thomas issued a dissent, joined by Gorsuch and Alito, as to why cert should have been granted.

That dissent noted "That makes the Court's decision here particularly troubling, as the question presented has nothing to do with abortion."

Thomas goes on to note that it appears that the reason the Court is punting on the issue, which he notes that SCOTUS is responsible for screwing up, is because some of the respondents are Planned Parenthood.

But the case itself? HAS NOTHING AT ALL TO DO WITH ABORTION.

Thank you and I've been burnt so many times that I've taken to going okay where's the damn ruling because ye gods the people who report on SCOTUS in particular have no freaking clue what they are doing.

The moment I saw people going on and on about some kind of abortion ruling my bullshit detector went off the charts because it's mid-term, not end of team, so no rulings should be being handed down. Then I saw it was a cert issue and those usually don't have opinions. Then I read the Thomas dissent and started yelling all the profanities at the screen.

Thomas is absolutely right. SCOTUS created the disaster that is trying to determine if there is standing by a private citizen and SCOTUS needs to stop being even more fecklessly moronic than usual and take up a case to clarify the issue. That case was a perfect vehicle, what with there being a matter of national import with a circuit split. As Thomas says more politely, that's kinda what SCOTUS is supposed to deal with.

But yes. Always check the rulings themselves, not what people who have obviously never read the ruling are saying.

(As far as the issue itself, Congress could, you know, fix this whole problem by passing a law stating something clearly and hahahahahaha I'm so funny)

So very true. Neither side had a clue. Hell more were killed at Shiloh than in all previous American wars and that was an early battle, it got worse. Something rarely taught is that the war was so horrible, that both sides realized if they ceased hostilities, they would never start it up again. Which is why they just kept going. Terrible price there but anyone saying there was an alternative is being ahistorical.

I get that. I am just saying that the secession issue was decided on the battlefield and then later, after the fact, clarified by the courts. The union was a big freaking deal back then and there were reasons for that. Today, is a very different world. If we taught history better, and were more unified as a nation, it would not be as different a world.
