Maryland Cops Descend on Man's Homes to Confiscate His Guns Under New "Red Flag" Law; When Man Scuffles to Keep Possession of Guns, He's Shot Dead

Wonderful.

It seems like a member of his family filed the "red flag" complaint, so it's possible this guy was behaving strangely or threateningly enough to justify some kind of an intervention.

He also seems to have opened the door with a gun in hand, which is legal, but also seems provocative.

This doesn't bode well for "red flag" laws going forward.

Two police officers ordered to remove firearms from a house on a "red flag" protective order fatally shot an armed man Monday morning in Ferndale, Maryland, police said. Anne Arundel County Police arrived at the house at 5:17 a.m. to remove guns from the home under a new law that temporarily allows for the seizure of firearms if a person shows "red flags" that they are a danger to themselves or others, CBS Baltimore reports.

A man, later identified by police as 61-year-old Gary Willis, answered his door with a gun in his hand, Anne Arundel County Police Sgt. Jacklyn Davis said.

Sgt. Davis said the man put the gun down. But then, according to a police press release, Willis "became irate" when officers attempted to serve the order. Willis picked the weapon up again, "a fight ensued over the gun," and a shot was fired, Davis said. The first shot didn't strike anyone, but the officers then fatally shot the man, Sgt. Davis said.

Neither of the officers were injured. Their names weren't released.

It wasn't clear why the "red flag" order was issued. A spokeswoman for the Maryland Judiciary denied a request from the Baltimore Sun to release protection order requests associated with the home, citing the law which states the orders are confidential unless a court rules otherwise.

Michele Willis, the man's niece, told The Baltimore Sun that one of her aunts requested the protective order against Willis, but she declined to say why.

Either someone has committed a crime or is not sound of mind - and they can be arrested or committed - or they haven't. Setting up a special parallel reporting and confiscation structure for what may not amount to more than gossip and butthurt is a terrible idea.

I'm unclear as to the nature of the problem. The man apparently had stability problems, meaning he had no business with a gun. If there are armed policemen around me, and they want to take my gun, I'll let them, and if their actions were wrong, I'll deal with it legally. Sounds like the cops had no choice.

Beyond the due process issues, it's worse than non gun-owners really understand. Generally speaking, what happens in most areas when your stuff is confiscated is that it's piled into a rubbermaid bin, driven to an evidence room, tagged/processed, then thrown loose into racks or even dumped in 55 gallon drums with dozens of other firearms.

They typically get beat all to shit. You're lucky if they don't actually electro-pencil inventory numbers right into the metal. Climate control in some facilities ranges from bad to nonexistent; you can expect anything that can rust to do so.

Basically, if your shit gets taken, it doesn't matter if you get it back; it's usually ruined. And that's assuming you DO even get it back; most major cities have agencies who have a habit of "losing" extremely valuable arms.

The suits will go nowhere, and she actually lost about 10k votes in Fulton county because they were duplicates or from illegals.

319 I love living in the Midwest. IN born and currently living in OH. After last week and the governor losses in MI and WI I believe that gun controls will surge in the middle states. OH is Republican but after the reign of the postman's son I don't trust it either.

Sees that it's cops. Sets the gun down to talk to them because it's not a robber or crazy person.

They "serve" the order and say they're taking his gun.

He moves to secure his property.

He and one cop scuffle and the gun goes off.

Other cop hears gun-shot and reacts.

I'd read an account where the niece said he wouldn't hurt a fly and well, her aunt, that was family being family.

I wouldn't assume for even the *barest* moment that the aunt was justified.

In Ohio, that would be considered a Night-time service of a court order and bigly hoops must be jumped. If the MD officers were expecting trouble, 2 guys would be a bit light on the manpower since the now-deceased guy had firearms available -- if they weren't expecting trouble, no reason to be there before about 8AM and Daylight service.

I have seen and read of too many examples of bad behavior by police. I don't give them the benefit of the doubt. Their word is suspect unless it is backed by evidence like video, or third party testimony.

I will never believe FBI testimony about interviewing without video or audio evidence. 302 does not cut it.

455 If the aunt won't say why, it's because she really didn't have a good reason. She decided it was 'for his own good' and now the family is all over her case.

This is like so many other shootings by cop when the family calls the cops thinking they can handle the situation leaving the family out of the scrum so they won't get blamed by the person they're calling about once they get out or back from wherever the police take them.

Trouble is the police have very few actual options and since these days the cops don't like to get physical and if they don't have a taser it's Bullet Time.

People don't understand about that because they've been sold that Mr. Cop is Your Friend lie for so long.

No offense to LE but the cops ain't your friend when they're on duty. They have protocols and rules that they must follow or be suspended or dismissed if they don't.

Hopefully this will discourage a few of the pearl clutchers for calling the cops unless the person is actually waving a gun around for no reason.

Is there a court hearing? Does he have an opportunity to retain counsel before his guns are removed?
