9th Circuit: Trump Cannot Use an Executive Order to Reverse Obama's Executive Order on DACA Because We Like Obama and ORANGE MAN BAD

This aggression shall not stand.

"In a world where the government can remove only a small percentage of the undocumented noncitizens present in this country in any year," the panel said, DACA lets it "devote much-needed resources to enforcement priorities such as threats to national security, rather than blameless and economically productive young people with clean criminal records."

This is the political argument Obama used to justify his policy. This is not even close to a legal argument mandating that Trump accept Obama's rationale.

Anticipating another outbreak of Hawaiian Judge Syndrome, the Trump Administration asked two days ago for the Supreme Court to take authority from the 9th Circuit and decide the cases themselves.

32 That's not how any of this works. It doesn't matter how much the 9th Circus might like the original EO and think that it was justified - all that matters is the question of the president's authority to change it or remove it through an EO. Tht they think the original order was good is completely irrelevant. It doesn't matter if they think enforcement dollars are better spent elsewhere. Those determinations of relative value or quality are the job of the legislature.

They are outright trying to steal elections.

107 I noticed that on the ballot last Tuesday, you can't vote against a judge, you can only vote for the judge. If there is not an alternative candidate to vote for, you can only leave that line blank.

So any candidate for a spot in the court system running unopposed could be elected by one vote. There isn't anyway to vote that candidate out of that slot.

And most people have no idea who these people are; they make very little news.

It's only been since the 1960's that we've had the legal principle that a single circuit, or a single Federal judge, could issue an order that applied across the United States.

We need to go back to that - fine, the 9th Circuit's order applies to the 9th Circuit's jurisdiction, but not elsewhere.

188 gotta go off topic with this, don't know if it's already been mentioned.
from the Weakly Standard, first site I found it

Elijah Cummings, the top Democrat on the House Oversight committee, wrote in a statement that there are "many, many reasons" to remove Sessions, "but one reason that is not acceptable is to interfere with or obstruct the Mueller investigation."

"Congress must now investigate the real reason for this termination, confirm that Acting Attorney General Matthew Whitaker is recused from all aspects of the Special Counsel's probe, and ensure that the Department of Justice safeguards the integrity of the Mueller investigation," he continued.

190 The 9th does not care... the Supreme Court can't take away their positions... can't fire Judges.

All they can do is write sternly worded letters, and eventually overturn their rulings...
==========
Well, It would be an interesting turn of events if the Supreme's ruled the 9th decision was not based in law, and evidenced an illegal bias and prejudice against the executive and not only overturned it, but then entered an order disqualifying the 9th circuit judges involved from hearing any more cases involving the executive.

Fun stuff.

It's not enthusiasm for someone to die. It's the enthusiasm to be rid of someone who has betrayed the trust of their office and does a great deal of harm.

If she retired of her own free will or if she apologized for legislating from the bench and vowed to stop it, no one would wish her ill. Unfortunately neither of those things was ever on the cards. But we hope to be rid of her actions - nothing about that is malevolent.

If you were being chased by a thug, would it be malevolent of you to hope that he trips and falls? No. If he gave up, or if he apologized and went away you'd be equally happy, but you'll take a fall and a broken neck if you can get it.

Why do people keep falling into this silly error of moral reasoning? It's not that difficult.

It's painful and it hurts constantly, you roll wrong in your sleep and it will wake you up with the pain.

350 243 So am I wrong in thinking we can now do all kinds of things provided it benefits blameless and economically productive young people?
Posted by: DamnedYankee
_____________

I'd like to see the evidence that that assessment was based on.

We know the Obama administration did not vet any of the DACA applicants, as Obama promised. Heritage served DHS with an FOIA request to try and find out the DACA approval standards it was using, and DHS admitted that it did not vet DACA applications -- just stamped them "approved." DHS said it didn't have the money or the personnel to review the applications.

So much for being "blameless." We know for a fact that quite a few of the actual DACA recipients have been identified as known gang-bangers, and some others have been arrested for crimes like assault and rape and murder.

As for their "economic productivity" that too has just been assumed, never proved with any actual facts. If somebody did an actual study, we'd probably find that, like so many other illegal aliens, a hefty percentage of them are receiving welfare.

But they're judges, not actual policy-makers, so they can just pull "facts" out of their asses.

351 The 9th Circus was under orders from the SC to 'hurry up' this case, ie stop dragging their feet, and I can't picture the SC declaring Obama EO Good Orange Man EO Bad...

We shall see. Btw, the 9th Circus isn't the most overruled on a % of cases, it's the 4th. But the 9th does have an uncanny ability to draw 9-0 overrules...

The SC's way of saying Damn y'all are stupid.

So he put it in the back yard. Monster thing, with 6' of pipe attached. You can imagine.

A few years later, I was cleaning up and decided I had to move it. It was on a hill, just above a compost heap. somehow I managed to fall and while hugging this iron monster I rolled about 30' down the hill, on top of the leaves and crap, unable to stop or free myself from this monster pipe.

I cracked three ribs.

No point to this story, but I kind of wonder if RGB was wrestling a fire hydrant that her brother stole -- it would give me a little respect for the old bag of dust, hate, incompetence, and leftism.

431 The proper response by the SCT is summary reversal of obviously unlawful rulings by lower courts. They used to do that in the days of segregation to overturn state courts all of the time.

The left is now naked in its lust for power and is shedding every restraint on its actions. Rent a mobs, illegal court rulings, election stealing, spying on rivals using the national security apparatus, violating long standing practices such as attorney client privileges, illegal wiretapping, ignoring federal law by states, fomenting sedition, colluding with foreign emissaries (KSA former prince, UK, and AUS ) and foreigners invading the US to affect U.S. elections, etc. And this is AFTER they won some measure of power in the House.

I once thought that Trump might delay the collapse of civil government for a decade or so until the finances gave way. The left appears to want its coup d' e'tat through "people power" now.

434 There needs to be some meta-laws passed that limits the kind of cases that can be brought (call them "ham sandwich" laws). So one could be "An EO by a previous President can be undone by the current President", and if some sleaze tried to file a case in order to get some sympathetic judge to stay the action, that case wouldn't even make it to that stage. It would have been filtered out in advance.

It would not be subject to the judge being honest enough to toss it out. It would just be a common sense principle.

won't win. Plus a recount opens up finding undecounts in red counties,
something not happening now.

Georgia: Abrams is desperate to get to a runoff and try a second
time. Even if she got it, she would lose again by a larger margin.

Posted by: Dave in Fla at November 08, 2018 04:17 PM (MaDz4)

Dave you are right about Florida... and if there is a recount, it needs to be statewide not just in Broward. Abrams on the other hand can go pound sand. She lost and she lost outside the margin of fraud or of run-off.

Ok, I guess I haven't paid much attention to him, apparently he does this frequently that I was unaware.

I also didn't read the link to his latest comments. As far as the photo being "illegal". the great traffic court judge Napolitano this morning on F &F said that appt. the new interim AG is illegal. That the interim AG has to be someone who has been confirmed by the Senate as Deputy AG , etc.

Even Doocy wasn't having it. He point blank said to Judge Nap that considering all of the lawyers in the WH, they certainly had looked at this appt. and determined it was proper. Doocy actually was insinuating Napolitano didn't know what he was saying.

She's a mean woman.

In an interview with the New York Times - Ginsburg said she could not "imagine what the country would be with Donald Trump as our president" and suggested her late husband would have taken such a scenario as a reason to emigrate -- as far away as New Zealand.

calling Trump a faker...

Many in the country are hurting and dying. She is mean spirited. I feel for her predicament, but the timing....

Supreme Court Justices are not supposed to show personal bias.

The timing... haha

551 Eh, I mispoke, Broward can generate about 850,000 votes. So "finding" 46K is 5% of their total. But to be valid they have to be verified. Validation means 46,000 unique IDs and 46,000 unique signatures. Also impossible for more than 30K of those to be for Nelson, the other 16K will be for Scott.

Scott still ends up with a 6K lead. That generates a recount, which is already going to happen. That then brings in all the undercounts from the panhandle. Broward won't get any more votes after shooting their wad on this silliness.

So we will be biting our nails, but Scott will end up the winner.
