That said, what I know so far of Ms. Ford and her allegations is sufficiently credible that were this a criminal case and Mr. Kavanaugh my client, we would be having a very serious conversation about the risks of trial and the weakness of his alibi witness.

So she can't figure out how to defend her client against a decades-old allegation with no actual, you know, evidence or witnesses. Or to effectively cross-examine the accuser under oath? Holy hell. If she were my lawyer, I would immediately fire her ass and hire someone competent.

Yeah, so a lot of states of verrrrry generous (or no) statute of limitations of felony sexual cases where the victim was a minor at the time.

For kind of obvious reasons. If a sicko molests a 4 year old, she might not even know what really happened until she was 14, and may not come forward for another decade, especially if the molester was a family member or whatever.

I think many states do the "SoL runs when minor reaches age 18 + x number of years."

So I suppose a charge could be brought by a creative prosecutor, but, er... I don't see a jury going for that.

These SoL expansions were clearly aimed at the cases I described, not at some woman claiming to have been groped at age 15 by a 17 year old 36 years ago.

Third rule of polls is to look at the way the question was asked. Here, unreported. This one is huge, because most polling is push polling: "Do you support Kavanaugh, a serial rapist that hates women?

I call BS. My own anecdotal observation is that the non-partisan people I've heard talk about this Kavanaugh accusation are appalled at the Democrats.

IF there is another hearing, it would be have to be Wednesday in order to hold the hearing and then vote him out of committee that day. That way at the latest he would be confirmed by the full Senate Sunday night or early Monday, in time for him to be sworn in before the new SCOTUS term starts.

Following her hypothetical, if she was repping Kav, and he wanted to go to trial, she should advise a bench trial rather than a jury trial. 99% of judges would find for Kav, and very quickly I'm sure. It would take an afternoon at most.
