Kavanaugh and His Accuser Will Testify on Monday; Confirmation Vote Delayed

Well, at least there's still 60 days until the election. There's some room in the schedule.

Meanwhile, the legal adviser for Blasey Ford (the accuser)*, says that it's not up to her to corroborate her client's story, and if her client can't even say when or where this party allegedly took place, well, you'll just have to believe her anyway, like we believed the Duke Rape Hoaxer or Jackie Coakley.

During the interview, Katz revealed that there was another girl present at the party, which allegedly took place in 1982 while Kavanaugh was attending Georgetown Prep. Ford previously told the Washington Post that there were four boys at the party but never indicated if there were other girls beside herself.

"While we have you, perhaps you can help us fill in the blanks on some of her story. She says that she was at a party in probably 1982 in Montgomery County, Maryland. She says that there were four guys there, these are high school students, as was she. There were four guys there. Were there any girls there that day?" anchor Alisyn Camerota asked.

"Yes, there was another girl at this party, yes," Katz said.

Camerota asked if Ford has tried to talk to any of the other partygoers to see if they will corroborate her story, but Katz declined to place the burden of proof on her client.

"That's not her job to do that. If this is going to be investigated, it should be done by investigators," Katz asserted.

* CNN's legal analyst said that Kavanaugh, by hiring a lawyer, must have feared being prosecuted for lying. But Blasey-Ford hired a lawyer -- or a legal adviser -- first.

Does she also fear prosecution for perjury? Or does this logic only work the way left-wing CNN wants it too?

Before: your obviously too liberal vote for the state you represent proves you need to go.

Now: "I had to vote this way based on the seriousness of the charge."

No one in DC actually gives too shits about whatever happened whenever it happened. They didn't care about Kennedy, Dodd, hush money payments to congressional staff, Billy Jeff, Menendez flights to pedo island -- none of it, and they don't care about this. They only care about saving the Dems from R states.

54 Soooooo.... what's the real actual deal here legally? Political bullshit kabuki dickwaving aside?

There's no change of criminal action, because statutes etc., right?

So if this accuser wants to do anything, it's got to be a civil suit. Right?

In which case the burden of proof is entirely upon the Plaintiff (unless there's a marriage or kids involved, but let's not get into that whole mess here).

Soooo..... What precisely is this so-called "accuser" up to?

Either file charges, or file suit.

So far, it appears to be nothing more or less than a citizen interfering with a Congressional matter in a rather uncouth, unethical, and possibly illegal manner thanks to the machinations of the minority party.

have I got that just about correct, here?

The Trump/Russia BS is their template ... they find tools to try to plant a contact, which they later manufacture into "collusion" (like that Russian spy lady). And a radical feminist is just as willing to play the con game as a Russkie spy, comrade.

But if you cross-examine her vigorously in Congress on TV, the optics are _terrible_. All the LoFos will watch the five-second clips on Bill Maher and go "Ohhh they were so MEAN TO HER! Those Republicans are black-hearted victim-shamers and nazis! And that's NOT OK!"

Don't know mechanics of SCOTUS, but I doubt Kav would be excluded from entire term, if he were to be confirmed a week or two later than hoped. Think he would only be excluded from cases that had already been started/heard.

Grassley: we have procedures ...!

Kavanaugh: I care nothing about your procedures . Confirm me or not I no longer care . Be prepared for me to initiate my procedures starting with the woman and then working my way up the chain to include sitting senators and rest assured I will get to the bottom of this and ruin everyone's lives who contributed to this farce. Posted by: Brian in New Orleans at September 17, 2018 08:16 PM (rnXGe)

It's delayed until after Monday's testimony. If she doesn't show, so what. Kavanaugh will be there , along with his lawyer. The Dems can ask him ( well, I can only imagine their pontificating) all about his partying when he was in high school.

According to what I understand, Grassley had arranged for a conference call with the committee today with Kavanaugh to hear his rebuttal of Psycho Ford's accusation but they refused to participate in the call. So now, Grassley had scheduled Kavanaugh to testify and has invited Psycho to also testify on Monday. IF none of the Dems show up to participate, then he will have done all he can do to while allowing Kavanaugh an opportunity to personally refute Psycho's claims. He can schedule a committee vote at that point and regardless of what they recommend, Kavanaugh can go to the full Senate for a vote.

And Manchin, McCaksill, etc. will be faced with voting no on an impeccable candidate whose last minute fake accuser didn't show up.

Or if she does show up, one can only imagine the psychotic testimony she'll provide. I can picture her sitting in the committee room, and becoming hysterical that she caught a glimpse of Kavanaugh.

A week gives the Republicans on the committee time to brush up on how to ask a crying, hysterical 51 year old psychology professor why she thinks she was groped by Brett Kavanaugh 35 years ago when he was either 15 or 20.

Yes, those people are stupid. They get their news from entertainers and talking heads. They judge politicians by their looks. But some of them vote. Recall that SCOTUS nominations - for the first time ever, at least first time confirmed through surveys - was actually material to the presidential election, as a particular, priority issue. If she is lying then Mr Judge, who is not a public person, can sue her for libel and slander (if she testifies publicly-I still think she might pull out) and damages to reputation, and he doesn't have any bar to reach. 429 Doubt Kav regrets a bit of it. He's getting the ultimate job he's always wanted. Not many people do.

To get back to what someone else said - yeah I know it's a much broader problem, but for me, the tone and atmospherics of Kav's announcement and subsequent presentations were close to repugnant.

All the crap about hiring women, the daughters, the women this women that - I DON'T GIVE A MEASURABLE FRACTION OF A F**K. What does any of that have to do with the JOB you're being hired for, FFS? Oh right, NOTHING.

To use a vivid example ready to hand, you can be a loud-mouthed self-promoting Queens real estate entrepreneur with zero political experience, only passing background in some big issues, and a decades-long spicey controversial personal life - and turn out to be one of the best presidents the country's ever had.

I don't care if someone's a transgendered former felon with face tackle, 10 divorces, and a mild drinking problem - all I care is that he/she/it f***ing act as a justice within the obvious intended constitutional bounds, with a desire to shrink and humble the judiciary back to its proper size and power, and have the brains and modesty to be fierce in defense of the law and constitution yet reticent in asserting the judiciary's power.

Period. And, in the end, that's all that anyone who cares, cares about. Results. Substance. Job performance. The Boy Scout puffery is stupid, it gives you zilch in terms of fending off the racist-authoritarian vandals, and its completely immaterial to the question at hand: fitness to render (usually quite easy and obvious) judgements on constitutional, statutory, and due process questions.

Jeebus.

Well, more evidence than the 0 she has, that's for sure!

But assuming she could prove anything, third degree sexual assault in Md. is classified as a felony worth up to 10 years in the slammer. The elements are touching another's sexual parts without consent for purposes of sexual gratification, using force,, etc. Aggravating factors could be a young age or that the victim was incapacitated (drunk, which she claims she was).

He can testify that he never attended a party with just 5 or 6 people present. I only attended a hand-full of high school parties but there were always a couple dozen-or more people present. Ms Ford was cleverly unspecific about most details but she locked herself in on that claim. A party or gathering with just 5 or six people, 4 boys and 1 or 2 girls present. I never attended anything like that. Kavanaugh probably heard that claim and thought "that doesn't describe any HS party I attended."

He obviously needs something from his colleagues (particularly McConnell) or he would still be on his fact finding tour of East Bumfuck or where ever he was trekking and all those judicial nominations that McConnell shoved through in the last couple of weeks would still be in a holding pattern. Guys, this is a Senate hearing, it's not Federal Court. Virtually all questioning by Senators, Rep. and Dem is political theater, not evidence based jury presentation. Sure , if she is testifying under oath( haven't heard if that is the case) , she can be charged with lying to congress, big whoop. Remember Eric Holder and his contempt of Congress charge. That was awful, wasn't it.

A Democratic Congress has no choice but to try to remove Kavanaugh from the D.C. Circuit now, right?
https://bit.ly/2NPhVub

Because if you take it seriously, as every Democrat will soon profess to doing when they vote no, there's no reason they should permit Kavanaugh to sit on the D.C. Circuit. It can't be that attempted rape is disqualifying for a Supreme Court justice but merely a "demerit" or whatever for a judge who sits on the Court of Appeals.

If they're serious about this, they have to come after him and try to remove him from his appellate seat. If they don't, then what should we conclude about their own perceptions of the gravity of this charge?

The Dems may calculate that having crazies scream "Rapist!" every two seconds when Kavanaugh testifies may not be worth it.

Also, what are the chances that some rabid left winger who went to the same school at that time comes forward and says "it's all true!".

Given that the accuser can't remember any important details, what is going to stop someone coming out of the woodwork?

The Republicans are going to be coached into not 'attacking " her when
questioned. They will not be able to say or ask anything that sounds
like they are calling her a liar. The Dems will do everything possible
to support this poor fragile creature who is brave enough to show up to
tell her traumatic story.

As of now Grassley has said the committee will vote on Kav on Thurs to refer him to the full Senate. Then he has said they will have hearings on this BS on Mon before a Senate confirmation vote which as IIRC was scheduled for Oct 1.

711 Evidence and Your Reputation
Imagine, if you will, that a High School acquaintance suddenly accused you of a crime 35 years ago (let us say he accused you of stealing $200.00 from him by threatening to beat him up.) Further, your accuser admits that no one else knew anything about this crime for 29 years and that he has no other evidence but his word that you committed the crime. You vehemently deny this accusation. Would anyone take the accusation seriously? Should they? ******** Here is what we have with Dr. Ford's accusation against Judge Kavanaugh: 1. She waited at least 29 years to tell ANYONE, she says. 2. She can't say when and where the alleged sexual battery occurred, which makes it impossible for her story to be checked or for Mr. Judge and Judge Kavanaugh to demonstrate an alibi. 3. She has no physical evidence of the alleged crime. 4. She claims other people were there but she does not remember who they were. 5. She claims she did not make any contemporaneous statement to anyone about the alleged crime. 6. We have no way to determine her condition at the time of the alleged incident to determine her ability to make a credible report, that is, her ability to properly observe and remember. 7. No one is claiming any admissions by the accused to any third party. 8. Even if she is absolutely convinced of the truth of the allegation, memory research has demonstrated that human beings often honestly "remember" things that did not happen, or did not happen as remembered. ++++ I do not claim to be able to tell when someone is lying. The most ridiculous claims are sometimes true. I can only say that if this is very, very poor evidence to lead anyone to believe Judge Kavanaugh did what Dr. Ford alleges.
