Democrats Refusing to Cooperate in Scheduling Follow-Up Calls With Kavanaugh's Accuser

For some reason they don't seem to want their 11th-Hour Accuser participating in an investigation.

Because they don't want an investigation. They just want Republicans to fold. And as soon as one Republican folds, that gives Trump State Democrat Senators permission to vote "no" as well.

And of course, Flake and Corker are already making all kinds of noise about folding.

They're exactly who we thought they were.

I actually give McConnell more credit than most people. His caucus is fractious, to put it mildly, and I couldn't control it without running a risk of Majority Leader Schumer. But... no matter how pissed he, Collins, and even Murkowski are, if Corker and Flake make those noises, that's the ball game.

Don't chose this place to fight to the death, like how they chose to fight to the death of Gorsuch.

They're looking for energy in literally everything that's happening, but they're not choosing their battles. They're just fighting with no strategy at all.

Imagine it as an actual war with troops and everything. Do you send your army in full to hit every little outpost that you can? Do you throw your whole army deep into enemy territory because they have something valuable there, no matter what the potential costs?

I think the reason is that they were so surprised by Trump's win that they had never even considered a strategy beforehand. When the win happened, they just followed the energy of the party into blind resistance.

We'll see if it works in about 7 weeks.

I've been depressed as long as I can remember. I've never been "happy" in the sense that normal people have. Therapy and medication get me to at best a day-by-day sort of thing. OK, this is sappier than I intended. Still, over the past few threads there's been more than a whiff of a defeatist attitude, and certainly over the years I've been guilty of it. I'm not talking about misplaced optimism, which is useless, but I AM talking about refusing to bend over.

This is all over the place, I'm sorry. Just....don't give this up. I think this is a good pick, the Senate has breezed through appointments for far worse people, and they need to be reminded of this.

She can't remember what year it was but she can remember what she was wearing. She can't remember whose house it was but can remember the music that was on when it happened (but hasn't said what was playing). She can't remember how she got there. b) on what legal theory? Kavanaugh is definitely a public figure. I dont see how this gets past summary judgment
and
c) how long would this all take to get to the discovery stage? Especially with D's bankrolling the accuser? Months? Years? Decades?

If you're a public figure, you have to prove actual malice. And I'm like 90% sure the burden would be Kavanaugh to prove that
a) the allegation is untrue
and
b) the allegation was made with actual malice,

not on the accuser to prove that the story was real.

And how do you prove such a thing? That's why the accuser will stay very vague with details and it'll stay a "he said she said" story -- and even if she nails down a date and time, how does Kavanaugh prove he didn't do what she claimed? Unless he happened to be sitting in jail on the night in question or something like that, how does he prove where he was and what he did on November 26, 1982 or whatever? And god forbid he really was at a party with this chick that night... I mean come on.

EVEN if he finds 4 witnesses to say, "I was there, that didn't happen." she says "no, no, I was talking about a different party with different witnesses on a different night."

If you want to challenge her changing story then you have to have the therapist testify (and challenge whatever doctor-client privilege exists), then track down and subpoena all the witnesses or people who were at the party, after figuring out exactly when/where it was, etc.

It doesn't matter if this accusation is true or not, the accusation is the crime itself. This woman has accused Kavanaugh of sexual assault, but she refuses to provide any details like the year, month or day or place the alleged crime was committed so the Judge can't defend himself.

This is a pure 100% political hit job that does not deserve any consideration on what may have or not have happened. Until the alleged victim agrees to provide details of the alleged crime, then it is all bull$hit.

In this case, the answer is no. It's nearly impossible for a "public figure" to win a defamation suit because they have to prove actual malice, and (as Sarah Palin can tell you from her experience), it's nearly impossible to obtain enough malice evidence to satisfy the court.

This then goes into the same trash can as the weird 'revenge' story that has Kavanaugh's mom, also a judge, sitting as judge on the foreclosure case against Ford's parents' home in Maryland. It's all intriguing as hell until it turns out Ford's parents WON the frickin' foreclosure case, so why TF anyone in the Ford family of fine Democrats would feel vengeful against the judge that presided over their victory is anyone's guess.

On the "they don't want her interviewed" front, maybe that's intended as a shot at the Democrats for being against Ford 'just' being interviewed by SJC staffers under Grassley's control, I don't know. But as I read the coverage at NewsMax, Fox online, Daily Caller & Mediaite, the Democrats on the SJC are actually PUSHING that she be interviewed, only live on C-Span by the full committee.

I think this whole thing is actually very coordinated and has a paper trail from 2012 when Kavanaugh was on some short lists. But if you want to get into drunken he said/she saids and say some of it is true, even by that standard this is tame stuff and not disqualifying.

Cannot be optimistic about this, since it should have (obviously) been done decades ago, and the GOP is unserious and useless as a whole.


The voters have allowed the republic to be trashed and abandoned, and I see few signs they understand or care enough to really make a serious effort at restoration.

I don't think she has said what month, but she said she was wearing a swim suit under her clothes, so probably a summer month.

Oddly enough, that was my experience as well. Parents were responsible for what happened in their homes and I just can't see underage drinking as the woman described -- and the boys were minors as well as the girls.

Oddly enough, that was my experience as well. Parents were responsible for what happened in their homes and I just can't see underage drinking as the woman described -- and the boys were minors as well as the girls.

Only two possibilities

1) He's taking the (reasonable) chance the fruitcake is talking
about a "summer" party (hence, swimsuit) and he and his family
vacationed "elsewhere" in the summers, or

2) His folks would would never allow him to attend a party with no parents present (happened all the time back then)

Funny, I grew up in very blue-collar NJ suburbs of NYC. The locale of the weekly party was at whatever house was going to be without parents that weekend. Typically there was a choice. We would drink our fill, clean the place spotless, and leave without anyone "knowing", only suspecting.

My dad, on the other hand, taught HS in one of the richest zip codes not in NJ, or the USA, but in the freaking world at the time. The parties each weekend would trash whatever house was unfortunate enough to hold it. Parents were home, often times partying with the kids. Didn't care - money cleans-up everything.

Weird stuff.

It's suburban Maryland, where the winter months (and autumn and spring nights) are usually pretty chilly, so she probably would not have left a wet suit on. Makes more sense if it was summertime.
