Ted Cruz's Opening Statement: Kavanaugh Should Be Confirmed Based on His Eloquent Defense of the Bofa Doctrine Alone

Great opening by Ted Cruz.

Here is a breakdown of the statement, so you can go to any part that interests you:

First Cruz talks about "what this hearing is about and what it is not about," proving that the Democrats have offered no substantive objections to Kavanaugh, as no such objections can plausibly exist, and so turn to "pounding the table" and making beef over silly procedural objections about how many documents they've received.

Then he says "But let's talk about those documents for a moment," and notes that 480,000 pages of documents have been produced, which is greater than the number of pages produced for the last five Supreme Court nominees combined.

Then he talks about the documents that haven't been produced. These, Cruz says, are almost all documents authored by other people which were merely collated and passed to President Bush by Kavanaugh in his capacity as Staff Secretary, and therefore tell us nothing about Kavanaugh's thinking or beliefs. Further, Cruz says, because these are presidential advisers' communications to the president, they are strictly protected from disclosure by the law. Thus, he concludes, the Democrats are demanding documents precisely because they know these documents cannot be produced at all.

Then he asks, "So what is this hearing all about?" He says it's all about the Democrats being unhappy about the voters' considered choice in 2016, and wanting to overturn that. But he notes that this was the first election since Eisenhower which occurred with an open Supreme Court seat in play, and thus the next Supreme Court nominee indirectly on the ballot. And he notes that the issue of judicial appointments was vigorously contested by both Trump and Hillary Clinton, the issue being asked about in every single debate, and with both candidates stating the type of judge they would nominate.

Cruz points out that Trump took the "unprecedented" step of publishing a list of his likely Supreme Court picks. He implies without directly stating that Kavanaugh was on this list. (Kavanaugh was in fact on the short list.)

Therefore, Cruz concludes, Kavanaugh has something he calls "super-legitimacy" as a Supreme Court nominee, as the voters were already told that he might well be a Supreme Court choice by Trump and chose to elect Trump. Cruz calls this a de facto "referendum" on the acceptability of Kavanaugh as a Supreme Court justice.

Finally, Cruz points out that progressives use the courts to win policy fights they cannot win at the ballot, and points out that America has been debating big policy issues that the left would like to win via the courts. And in the face of that, they chose Trump, who promised to appoint constitutionalists. He specifically notes that every Democrat Senator voted to gut the First Amendment, and that many Democrat Senators voted to repeal the Religious Freedom Act signed into law by Bill Clinton, and that almost every Democrat wants to effectively repeal the Second Amendment.

Huge debates about which virtually every voter was aware -- and every voter was aware what kind of candidates each nominee would select. So again, Cruz concludes, the Democrats are simply trying to undo the will of the American people.

7 Noted in a prior thread. It's not just grandstanding about being unhappy about the voter's choice in 2016. It's about laying the groundwork to demilitarize any ruling he makes/authors/votes in the majority for that the left doesn't like.

Their end game is impeaching trump, and undoing everything he's accomplished. They want to be able to say 30 years down the line that Kanavaugh was an illegitimate justice and every ruling he participates in should be revisited.

I think Ted is being genuine. If he still was sore, he might have announced he would retire rather than serve PDT in the Senate. He's proven to be a bigger person since the inauguration.

And this is true of just about all the primary season's anti-Trumpers who strongly supported Cruz for his own sake rather than merely as a last-ditch effort to stop Trump. They have not changed their principles but they have changed their view of Trump now that they see what he is doing.

The equation Trump enthusiasts made between Cruz supporters and Nevertrumpers was always false. I don't know a single (true vs desperate) Cruz supporter who did not EASILY vote for Trump over Hillary.

The true Nevertrumpers come out of the RINO branch --- and note that they have changed their own (previously stated) views solely to bash Trump. THEY are the ones who have done a 180 degree turn.

Most of them are older white, wealthy libs (especially around colleges) who have spent the last 30 years absolutely hating the way Texas has moved away from their beloved Democrat Party and started voting conservative. To Them, it's a visceral expression of everything they are angry about in their lives.

I supported Cruz in the primary because I had concerns about Trump actually governing as a conservative given his past flirtations with New York lefties. I think Cruz had some of the same concerns (as did many of us here, including Ace...listen to the podcasts from early 2016.) This didn't make us "never Trump" just "I have some reservations about Trump."

But, Trump has pretty much governed as a conservative and actually gotten some things done. I've come around on him and I think many of us have.

That isn't quite the way I meant it; but I will say that every Methodist and Presbyerian clergy member (or church officer) that I know of in my town, and I know several, has got a Beto sign in their yard. There's a Baptist mega-church in the area, generally thought of as a conservative bastion, as one of their members is the local state rep, and the hatred of the old line churches for the Baptists and their allies is legendary here.

Interestingly there's not nearly as many BETO signs in hispanic or black neighborhoods, the people on the ground aren't that into politics. This is a Rich White Virtue signaling thing.

Even if it were overturned (as it should be, since it is made up "precedent"), would there be much of a difference? Most abortion providers operate in states that will be pro-abortion-on-demand until the end of time. In the states likely to restrict or ban abortion, abortion providers are already few and far between.

Yes, the real Roe v. Wade, broke up the level of state interference by trimester. No interference the 1st, Reasonable restriction the 2nd, unlimited the 3rd--with the health of the mother the only restriction.

It was some later decision that made a girl who really x 3 doesn't want to have a baby and will be depressed "the health of the mother".

478 I have been trying to make the case for years that what started happening in Texas in the mid 90's was a preview of the fight that has now consumed the entire country. Now that doesn't mean it will turn out nationally the same way it did here, Texas has some unique qualities that favored the conservative side, BUT the same dynamic is in play.

Under Anne Richards, state government started to go far left in every area. They pretended it didn't but it did, and people were disgusted not just with her, but with Democrat governance in general. That's what fueled GWB's upset, but he was just the beneficiary of a movement that was happening in all offices - he was at the right place at the right time, more than anything else.

Now after this happened, Democrats *Could* have figured out what they were doing wrong, and why they were getting unpopular - BUT they listened to people preachind Demographics, and in the late 90's they made a CONSCIOUS and deliberate decision to target only Hispanic and Black voters. A past Texas Dem Chairman was even caught live saying openly that he didn't care if any more white men voted for their party, he had figured that they didn't need them anymore. And as they turned themselves into the Black and Hispanic party, they went far, far left in all of their other positions, and so brought to the top those white voters that have always loved the idea of being far left radicals, about 15 - 20% of the white voting population.

Republicans have controlled all State Offices in Texas for years now, not because they're so good - they're not, they've got plenty of idiots here like everywhere - but because Democrats have made the decision to become a totally race based far left radical party. That is the last 25 years of Texas politics, in a nutshell.

And now the Dems are taking that strategy national. It's worked for them in places like California - of course California is going to be economically destroyed soon because of it, but that's another story.
