Judge Tells the FBI That It Will No Longer Be Permitted to Hide Behind "We Can Neither Confirm Nor Deny" Answers, But Must Actually Answer Questions About How It Handled the Alleged Steele Dossier

No more shuck-and-jive.



U.S. District Judge Amit P. Mehta has ruled that the FBI cannot issue a Glomar response when it comes to whatever verification attempts they may have used for the contents of the infamous Christopher Steele dossier. In other words, the FBI can no longer hide behind the "we can neither confirm nor deny" response in order to stonewall records requests regarding how they may have tried to determine the validity of the synopsis of the dossier that raised concerns President Donald Trump might be compromised by Russia, pee tapes and all.

The judge had previously sided with the FBI and permitted them to evade answering. But, since Trump has declassified the Nunes and Schiff memos, the judge has ruled that this matter is taken out of the "can't answer for national security reasons" arena and the FBI must answer as in any other run-of-the-mill proceeding.


National security lawyer Bradley P. Moss, whose tweet on the news you can see above, told Law&Crime that this is a "major crack in the Government’s legal defenses."

"[Those defenses were] designed to conceal whether the FBI has taken any steps to verify the accuracy of the 'salacious' allegations outlined in that synopsis provided to then-President-elect Trump in January 2017," Moss said. "Ironically, if it turns out that the FBI has undertaken such efforts and has verified any of the claims, thereby embarrassing President Trump politically, the president will have no one to blame for that revelation other than himself."

But more interestingly, one assumes this info (documentation of FBI/IC efforts to verify "dossier") is central and pertinent to any legal proceedings against DOJ/FBI for FISA process abuse.


Forget if this is "Woods Procedures" stuff, but I believe presenting a warrant affidavit to the FISC without having verified intel on which it is based is a very big no-no, in the felony category.


This would be central to any criminal prosecution of the perps, I would think.

Bruce Ohr is now in limelight and that might break it open. He may roll in exchange for having his wife imprisoned. She is not much to look at and I doubt it's a pleasure listening to her either.

The "losing" on this key front has been catastrophic. Some will say it will not get worse, due to personnel changes (judicial appointments). Sort of the definition of "system of men, not of laws", right? That's the point.

373 McRaven was a SEAL but not a warrior. He was a REMF. Only assignment to Team 6 was relieved for incompetence after about a year. Chest full of 'salad' but none for combat. As far as I can tell he never 'deployed' in spite of all the SEAL deployments.

I heard his commencement speech at UT and was impressed until I wiki'd him. Second listen to speech reveals it was all "I got through SEAL training - I was damn good. Oh, and by the way, you can maybe be as good as me." He learned all these lessons from SEAL training - not a word about putting them in to action in combat - 'cause there weren't no combat!
