Weekly Standard ( 🚢 ) Shocked by Notion of Non-Disclosure Agreements, Despite Routinely Demanding Them from Employees

Background for this: Larry O'Connor was employed briefly by the Weekly Standard to revive its moribund website before being fired, probably because he wasn't toeing the infinitely NeverTrump line the outfit insisted upon.

So when he says what he says, he knows what he's talking about.

If the Weekly Standard finds NDAs contrary to the public interest, they should immediately release Larry O'Connor from the one they made him sign, so we can hear how the sausage gets made in a little-noticed dusty corner of the Fourth Estate.

"According to trusted sources that have contacted my office, many if not all of the survivors of the Benghazi attacks along with others at the Department of Defense, the CIA have been asked or directed to sign additional non-disclosure agreements about their involvement in the Benghazi attacks. On July 24, 2016, just days before Strzok helped launch a counterintelligence probe into the Trump campaign, Kristol gave Strzok and the Obama Justice Department a big assist from the anti-Trump Right by posting a flawed and questionably-sourced article. "Putin's Party" is compelling evidence that Kristol and the Standard were far from mere sideline observers as the Trump-Russia collusion scam took shape in the summer of 2016.

At the very least, the timing of the article suggests there was careful coordination between the central players--including the Hillary Clinton campaign--and Bill Kristol to derail Trump's candidacy just weeks before the election.

The issue here is that the article basically runs down the entire Steele talking points one by one, like he was fed the info. Remember this was the era of that cabal of GOP big wigs dejectedly muttering about what they could do to stop Trump and one of them mentioned "they were working on it" Remember that video?

This goes way beyond disliking Trump, its specifically members of the Republican Party working with the Democratic Party to destroy their own party leader and presidential candidate -- now president.

162 I like to play a game where I wonder "what if its all true?"

So, I think about it. What if the left's allegations against Trump are all true. What if he did have meetings with Russians representing the Putin government about influencing the elections? What they claim is that he or members of his campaign staff did so to gain information on the Clinton campaign.

OK, let's say that is true. Is that even unethical? What about digging up dirt on your opponent from any source is unethical or illegal? If Trump had talked to the British about Hillary's foibles, and got info on her, would that be an act of sedition against the USA? Is that Treasonous? Hillary wasn't even a government employee, how can it be treason?

But lets flip that around. What if the FBI/Deep State work is all true. What if they really did go bad, what if they really did lie to the FISA court, invent crap to attack Trump with, what if its all true?

That, my friends, is another whole ball game. Its a festival of corruption, abuse of power, violations of dozens of federal statutes, and actual collusion with foreign governments to take down a sitting president.

Now THAT is a problem.

And seriously, every leftist everywhere should be trembling at the thought of the Justice Department being corrupted. That's the go-to in every cop corruption drama: the FBI are the good guys, they'll fix everything, we can talk to someone at Justice, he'll bust the evil congressman.

Who do you go to if Justice goes bad? Who watches the watchmen?

After declaring just a few weeks ago that she was a "capitalist", Liz
Warren introduces a bill that would have corporations that earn more
than $1 billion in revenue a year

(note "revenue," not "profits") would need a federal "charter" in order

to operate.

This will continue until people start ignoring this crap because it will be forgotten within a few days anyway. Twitter outrage mobs, even if they number int he tens of thousands (which they never do) are insignificant and meaningless. This isn't some poll showing a representative of the rest of non-twitter humanity. They are a tiny percentage of the overall population and most of them usually aren't even fans to begin with.

Businesses need to figure out that social media is not meaningful. That having 1 million followers means no more than having 1000. That a day of people squawking about a stupid topic is as significant as that crank mail that publicity offices used to get. Once they grok that simple truth, social media will collapse in its wealth and importance in society.

The entire system is a huge con, Twitter and Facebook and the rest have convinced the world that they matter, that they are important, that they are incredibly significant in lives. If they all totally disappeared tomorrow by an act of God, you know what would change? Some people working there would lose their jobs.

I don't know the specifics of the Cosby NDA breach, but an NDA cannot prevent you from reporting a crime.

322 Just watched a crime episode story when I went home for lunch. The 2012 murder of the Kaufman County TX assistant DA and then a couple of weeks later the DA. Turns out it was a former attorney and Justice of the Peace named Eric Kyle Williams. He had been fired and charged for stealing computer monitors from the IT dept when he was JOTP. He was tried by the ADA and DA and sentenced to probation. He had a hit list and planned out all the details. Only caught because as usual with psychopaths, they think they are smarter than everyone else. The scary part is he was hidden in plain sight.

I posted this because that's how I see the Left. ( on a side note , the guy had a 70 gun collection that I would have loved to have. )

341 Here's an image of somebody's future.
A relative of ours died yesterday. It's OK, he was 98, had a full life, and all that. An actual rocket scientist, and among other things, an enthusiastic boater.
So Wife calls a flower shoppe near the funeral, and asks if they can do a nice flower arrangement on some sort of nautical theme. V.helpful florist there, says nothing in stock, but let me check with my local supplier. And, less than an hour later, sends an image of a nice planter they can get today.
It is The Cruise Ship from our memes. A ceramic, color-glazed National Review Cruise Ship. So now you know what Bill K. will have at his next Big Affair as a centerpiece.
I don't know if she ordered that one or not. Don't want to know, because I don't want to know in advance whether I will get the giggles at my dear relative's funeral.

But I suppose i'm really stealing a base in saying they reverted back to Communism. Their tactical, clinical, bloodless approach to political theory and political writing is what lead directly to the malaise of cuckdom on the so-called "Intellectual Right" that we see in their progeny.

For the fathers, it was an ideology.

For the sons, it's a franchise.

suppose that could be, though this is the very first time I have come across anyone suggesting that someone should be concerned with an expansionist eu. maybe when they are fully subdued by their muslim invaders, have been weaned off russian gas, and have figured out how to rein in their social programs so they can afford something more than a make work military.

given the russian's recent discussions of using nukes earlier in conflicts you would think the euros would think hard before moving in.

who cares about the eu army? they have been talking about this forever. the uk, germany and french are in no state to defend their territory much less acquire more.

I'm an attorney. I write NDAs for private and public companies all the time, and have done so routinely for the last 16 years or so.

Almost EVERYONE is subject to NDA terms in connection with their employment, if not by signing an express NDA during the employment intake process, then pursuant to the terms of the employee handbook and company policies that were surely referenced in the documentation signed by the employee during intake.

Why? Because the things you see and hear at work is the property of the company you work for, and employees can and should be restricted from disclosing confidential information of the company without authorization.

They started early in the Franklin household. Finished early too, since Aretha was still a relatively young woman when her grown children could start their own lives, which is probably the good side.

624 But there are cases where non-disparagement clauses have been held unenforceable, particularly in the National Labor Relations Act (NLRA) context.

Attorneys thus need to carefully draft non-disparagement clauses to both define what disparagement means, and to take care not to make that definition over broad.

Posted by: RichardWindsor at August 16, 2018 03:15 PM (db5dt)

625 3/ In Omarosa's case, because she was employed by the US Government, she'll have additional 1st amendment defenses that don't present in the private company context. But Trump will also have special arguments to make as Executive, including protection of the well-recognized principle that the President should able to protect as confidential the discussions he has with his Executive branch employees and other advisors. Even if a court rules that disparagement is protected speech under 1st amendment, that won't extend to disclosure of Executive Branch discussions. Omarosa is most definitely going to live to regret breaching the Non-disclosure parts of the NDA, even if she eventually wins on the non-disparagement piece. Further, to the extent she knowingly and intentionally says false and malicious things about people in the administration (including Trump), she could also be sued for defamation, and if the victims can prove that Omarosa showed reckless disregard for the falsity, she could.....suffer greatly. Nice book proceeds you've got there Omarosa.... would be a real shame if something happened to those proceeds... and, good luck on your future employment endeavors. Sounds like you are a very low-drama prospective employee, full of integrity, honor and sound judgment.

631 Are non-disparagement provisions in employment agreements enforceable? Yes, in most cases.

As just one example, see Freelife v Music Publications, 2009 WL 3241795. There, an employee agreed to a non-disparagement clause as part of an employment agreement, but the contract did not define what constituted disparagement. The employee later criticized the company's policies on his website, and the business sued him for violating the non-disparagement clause. The court upheld the clause, even though there was no express definition of what constituted disparagement. But there are cases where non-disparagement clauses have been held unenforceable, particularly in the National Labor Relations Act (NLRA) context.

It seems the ONA may be a conduit for CIA funding dirty tricks in, by, for, and against the US Government.

The DOD Consolidated Adjudications Facility (DOD CAF) pulled his clearance. The DOD CAF is part of the Washington Headquarters Service, which, as the activity that also owns the ONA, is a target of the complaint.
