West Virginia Legislature Has Forced One Of Its Supreme Court Justices Off the Bench, and Its House Judiciary Committee Has Prepared Articles of Impeachment Against the Remaining Four

It's actually called the West Virginia Supreme Court of Appeals but the function is of a state supreme court, so I simplifiedfor the headline.

They're being charged with lavish spending on the taxpayers' dime.

The West Virginia House Judiciary Committee approved 14 articles of impeachment against the four sitting justices of the West Virginia Supreme Court of Appeals on Tuesday.

The eighth day of the committee's meetings regarding possible impeachment produced the first material results when 14 articles of impeachment were introduced at 9:25 a.m.

...

The articles serve as formal charges or accusations that the justices committed one of the impeachable offenses listed in Section 9, Article 4 of the West Virginia Constitution.

The articles of impeachment charge Chief Justice Margaret Workman and Justices Robin Davis, Allen Loughry and Beth Walker with maladministration, corruption, incompetency, neglect of duty and certain high crimes.

In total, Loughry is the subject of eight articles of impeachment. Workman and Davis each are the subject of four and Walker is the subject of two.

Former justice Menis Ketchum was not a subject of impeachment because he resigned from the bench last month.

Streiff, from whom I got the article, opines that the federal Congress should take a page from the West Virginia legislature's book. Impeachment is one of their powers -- in theory. But it's a use-it-or-lose-it sort of thing. When you don't use a power, many begin to consider it dead-letter and unofficially repealed.

To borrow a concept from our former neocon friends: For too long we have prioritized "stability" over all other things. This has in fact given us "stability," but it's the "stability" of the cesspool, at rest only because the shit can descend no lower.

When the stability produced is the lowest-lying shit, maybe it's time to risk shaking things up a bit.

46 Under state law, if a justice has more than two years left in his or her term and leaves or is removed from office 84 days prior to a general election, the governor appoints an interim justice, and voters pick a new justice during the general election.

Eighty-four days before this year's general election is Aug. 14.

If a justice with more than two years left in a term leaves office or is removed after Aug. 14, the governor still appoints an interim justice, but the special election to replace the justice would be in May 2020.

120 Seriously, the four liberal justices on the Supreme Court -- particularly Ginsburg, Sotomayor and Kagan -- blatantly disregard the Constitution in most of their rulings, even by their own admission, and have to rely on "emanations and penumbras" (convoluted and esoteric intentional misinterpretations of the Constitution) to justify their outrageous rulings.

In a sane world, those three would be impeached and removed form the bench for being "unfit for office," since they don't actually perform their specified duties (interpreting the Constitution).

Maybe only Breyer (among the libs) would survive impeachment.

Democrat drives to friend's home and reportedly shoots him over political disagreement on Facebook

Authorities say the dispute between Alex Stephens, 46, and Brian Sebring, 44, both of Tampa, Florida, reached a crescendo when Sebring drove to Stephens' house and shot him in the thigh and buttocks. According to the victim's explanation to police, the confrontation was sparked over a political spat on social media.

Even though Stephens was the shooting victim, he might have played a part in provoking the confrontation. The Tampa Police Department said in an emailed summary that "after receiving several explicit messages and threats, the defendant responded to the victim's home to confront him."

192 Delegate Mike Pushkin, D-Kanawha, also suggested the nature of grouping all of the justices into one set of articles of impeachment appeared to be an attempt to allow Republican Gov. Jim Justice an opportunity to appoint four of the five Supreme Court justices for at least two years on the bench.

Well, of course D Delegate Mike pushkin suggested that.

250 Impeachment is much clumsier, blunter instrument than Congress using its normal, everyday power of legislation, to limit jurisdiction of courts, change their organization, over-rule them, etc.

But that would involve breaking several current de facto taboos: asserting constitutional prerogatives, engaging in politics (the purpose of the accountable branches, esp. Congress) by "politicizing" issues - i.e. taking a stand that voters can assess at the ballot box.

Dems of course have no current interest in any of this, as the judiciary is predominantly an extreme, lawless, authoritarian element with no accountability that almost always enacts their policy preferences by decree (essentially what it is, it's not "judicial review").

Leaving the GOP, which has little interest in it due to ..... see taboos, above.

252 Ahhhh.

Vice President Joe Biden and President Barack Obama team up in this high-stakes thriller that combines a mystery worthy of Watson and Holmes with the laugh-out-loud bromantic chemistry of Lethal Weapon's Murtaugh and Riggs.

Vice President Joe Biden is fresh out of the Obama White House and feeling adrift when his favorite railroad conductor dies in a suspicious accident, leaving behind an ailing wife and a trail of clues. To unravel the mystery, "Amtrak Joe" re-teams with the only man he's ever fully trusted: the 44th president of the United States. Together they'll plumb the darkest corners of Delaware, traveling from cheap motels to biker bars and beyond, as they uncover the sinister forces advancing America's opioid epidemic.

Part noir thriller and part bromance, Hope Never Dies is essentially the first published work of Obama/Biden fiction-and a cathartic read for anyone distressed by the current state of affairs.

Yeah, I quite like it. I understand that using it entails a potential security problem itself, but it's a matter of risk-benefit. The alternative is to have a text document compiling passwords, or to use weak, easily remembered ones.

So LastPass is the lesser risk, I suspect.

357 Our IT folks have adopted the policy that long passwords are better than special characters so we are now encouraged to string a few random words together. I've been using Wheel of Fortune thing of words that form 2 phrases as a memory aid. i.e. Fire and Ice Cold.

Use the diceware method.

Get five dice. Each roll of five dice represents a word on the list. Four or five words strung together require nation-state level equipment to brute-force.

375 I think Ellis might have gotten confused.

Supposedly he had ruled pre trial to permit a witness to attend part of the trial (probably an expert) usually witnesses are separated (not allowed to hear court testimony) until after they have testified. This does not apply to parties who are witnesses or to witnesses who are essential to the presentation of a party's case -like say an expert witness.

I guess he saw the guy sitting there and realized he was a witness and yelled at the prosecution to get him out. Then later realized he had agreed to allow him to attend. Its his screw up if so. It happens. They just want the jury to be told that it wasn't misconduct on the part of the prosecution since it was implied by the Judge's reaction.

Not a big deal if so.

Recently I mentioned that FaceBook could easily be replaced by the 'CC:' function of email. Someone questioned WTF 'CC:' was.

After I typed out about six paragraphs I deleted the entire thesis, in the belief that no one would believe that you pressed down really, really hard on a keyboard and a little metal pole struck a piece of paper, then through a sheet of carbon paper, then onto the next sheet of paper.

448 I think Ellis might have gotten confused.

Supposedly he had ruled pre trial to permit a witness to attend part
of the trial (probably an expert) usually witnesses are separated (not
allowed to hear court testimony) until after they have testified. This
does not apply to parties who are witnesses or to witnesses who are
essential to the presentation of a party's case -like say an expert
witness.

I guess he saw the guy sitting there and realized he was a witness
and yelled at the prosecution to get him out. Then later realized he
had agreed to allow him to attend. Its his screw up if so. It
happens. They just want the jury to be told that it wasn't misconduct
on the part of the prosecution since it was implied by the Judge's
reaction.

Not a big deal if so.

465 Fox suspended JudgeNap after he said he had sources telling him our IC used the Brits (as a cutout?, if that is the correct term) to spy on US (specifically in this case iirc it was about TrumpTower "wiretapping"). But the Brit (or Aussie, whomever) could be in the same room, it is just a Clintonian styly crafted lie.

JudgeNap came back after a week or so, but he seemed compromised, and imo consistently spouted crazy talk. Or at least he seemed at odds on many issues with others (more notable) on several topics.

Are there ANY legitimate advertisements online? Seriously. I travel a great deal and have come to realize that in all towns, great and small, there is a unbelievably tiny company that is disrupting a $200 billion industry (which I refuse to find out about: seeing "this" in a headline or ad is a red flag for clickbait or something otherwise illegitimate).

If a legislative simple majority could impeach and convict a judge, that would open the door to wholesale purges and packing of the judiciary.
