The EPA May Terminate California's Very Special Right to Impose More Stringent Pollution-Control Measures Than the Clean Air Act Requires on the Rest of the Nation

Big, if true.

Summing up: the Clean Air Act enacts national standards for things like cars' exhaust. But it contains a provision which states that any state may be granted a waiver permitting them to enact even more stringent regulations, so long as they're "necessary" for that state.

California has sought such a waiver and has been granted that waiver for as long as the Clean Air Act has existed.

California is the country's largest auto-market, so car manufacturers just build for California. It would be more costly to set up factories to produce some cars that are California-legal and some others that are legal everywhere else. So the waiver permits California to essentially set the nation's car-exhaust policies.

This, of course, forces the rest of the country to subsidize California's environmental occultism, as the costs of these unnecessary abatement schemes are lowered in cost because their R&D costs are shared by a nation which doesn't need them, and California gets the savings of a massive economy of scale only by drafting unwilling Americans to be forced into being consumers of the products that they demand but which few others want.

Trump's EPA seems ready to end this special perpetual waiver.

Cue the whining about "owning the libs" from the people who are owned by the libs and want to remain owned by their generous liberal masters forever and ever.

Our diesel trucks with a GVWR of more than 14,000 lbs, that are older than 2004 are not going to be allowed on the road starting in 2020. There is a repair for them but it is worth more than the trucks themselves. This is devastating for small business owners. So many are affected by this arbitary regulation. We already sold off several and had to replace them. Now we still have one left. Can't sell it, cuz they are no drivable here. And yes I do know others that sold them to other states at a great loss.

Tesla is finally making enough Model 3s - but an analyst says many customers are growing too impatient to wait any longer for them.

Cancellations for Model 3 orders have picked up in recent weeks. Refunds now outpace deposits for Tesla's new mass-market electric car, according to Needham And Co. analyst Rajvindra Gill. Tesla disputes that.

In an analyst note delivered to clients Thursday, Gill cited extended wait times for the car, the expiration of a $7,500 tax credit, and the fact that Tesla has not yet made the $35,000 base model of the car available for purchase yet.

About one in every four Model 3 orders is canceled, Gill said, double the rate from a year ago.

Maybe regulating emissions of factories to offset increased emissions of newer car models that don't comply with the waiver. Maybe mandating some sort of device be added to get the car to comply with the waiver.

A modest proposal:

Hetch Hetchy is town down AFTER:
1. Sites Dam is built.
2. Temperance Flat Dam is built.
3. Auburn Dam is built.
4. The "Wild and Scenic Rivers" of the North Coast are dammed and diverted. Yes ceertain dams can be done with fish ladders and enough flow left over for the salmon and other fishies, and without flooding out anyone's Indian Reservation.
5. Another dam down stream from the Tuolumne River is built to make up for the lost Hetch Hetchy Storage. The Poopenaut Valley is a good site.
6. Shasta Dam is raised, as it can be.
7. Former Upper and Lower River Campgrounds in Yosemite Valley are restored. What good is a national park if people cannot enjoy it?
8. A proportionate number of campsites are built in the restored Hetch Hetchy Valley.

The eco-fiends have a point--it IS a National Park. But if they want that precious pristine National Park restored, then let us build dams everywhere else.

89 The reason the Left has made so many gains is because many of us have lost our critical thinking skills. And an argument can be made that schools and modern pedagogy have done this deliberately (an argument I happen to subscribe to).

We should however be able to win those skills back fairly easily because critical thinking is merely, IMO, a fancy way of saying you have a BS detector. Or more politely, that you are skeptical at being spoon fed information and try to corroborate it from other sources before you accept it. With all the over the top shrieking that the Democrat Left is dumping on America more and more people are hopefully becoming reacquainted with their BS meter.

I can only pray that it is so.

92 Maybe so. But this is preferable than CA de facto inflicting their problems on the rest of the states. They can find other ways to deal with it. Maybe regulating emissions of factories to offset increased emissions of newer car models that don't comply with the waiver. Maybe mandating some sort of device be added to get the car to comply with the waiver.

106 I saw an article this morning on this possibility over at Ars Technica. It was actually worse than I thought it would be. From claiming that this is an infringement of States' Rights, to complaints about the dark 1859-style racism of anyone to the right of Mao (and probably, some people to his left)... I could barely skim it, and it was at around 700 comments this morning. Probably more by now. And I was too busy to look at it in depth today, because I have work.

If and when these people get power back they're going to grind us into little pieces in true Red Guard style and pretend they're fighting against the charge on Little Round Top.

(If not for that, I could engage in a little emotional detachment, and say that I can appreciate a difference between real air quality measurements and their lumping in the very act of combustion as a form of air pollution, or the ZEV tax credit, which when you get right down to it is a way for a private company in California to collect taxes on other non-California companies' factories; a sort of backdoor internal tariff-in-all-but-name against the products of other states, collected in a form of tax farming that paints a thin libertarian-veneer over Roman Empire practices.

This is one thing that was in the constitution and if some farmer can be prevented from growing corn to feed his family because it impacts the corn market, then CA can be prevented from adding burdens to the auto market.

I only hope it becomes a commerce clause battle, and the court gets a chance to toss out CA mandates and at the same time NARROW the application of the commerce clause. That would be big.

About Musk... I think he got lucky with Paypal, and that gave him enough money to power through a whole lot of bad decisions he made at SpaceX and make it successful anyway.

As I emailed to a friend last night... Musk has a Ford Trimotor where all the rest of the world has Sopwith Camels. He stands on the threshold of being able to build a DC-3 of launch vehicles.

And he's going to build his BFR instead, which I think is equivalent to the Spruce Goose.

Howard Hughes could make idiot decisions like that and power through because his Dad invented the rotary drill bit when it would be, for anyone else, proof that they were an idiot.

During the drought the entire state had to cut back on water usage and impose rationing, although the only places that really had a problem were SF and LA. SD gets its water from the Colorado River (and a new desalination plant), whereas the northernmost parts of the state get plenty of rain.

So basically that asshole Moonbeam imposed draconian policies on the whole state to benefit the liberals in SF and LA who were/are too stupid to make provision for catching sufficient rainwater. And, of course, Moonbeam himself has so much to answer for, since his first official act when he became governor in 1975 was to scupper a comprehensive water infrastructure plan that was already approved and funded.

Count Electoral Votes - Indiana, Ohio, Michigan, and Kentucky collectively provide an equivalent market. No reason those states ... All Red the last go 'round ... can't get our shit together collectively and demand a "Non-California Compliant" option.

Of course - it would be easier to do that if our respective State Governments had more control of our State Education Systems.

238 There's something more to this. I understand California is a big state.

But they're not half of the damned country. Their market is not THAT friggin' big, compared to the rest of pie.

----------------

Somebody else mentioned this earlier. There was once a time when the nuttiness was self contained because those that sold to Cali actually manufactured in Cali for that states needs.

Then Cali chased out Mfrs. with taxes and regulations. It is a big enough market that I can easily see mass producers making their products to Cali standards for the entire Country in order to save manufacturing costs.

I believe you 100% ... and that shit is not because of one county in California.

That is because of the "I Must Obey" impulse in people. They see a "standard" - and they will never, ever think - "Do I Care" ?

The NFPA writes the "National Electric Code". I get into this all the time with people.

The "National Electric Code" is not law. Every State has the option to make it law. Indiana chooses to - with exceptions.

But pounding the notion that - just because somebody chose to write rules down in a book doesn't make it law - is pretty much a losing battle.

240 The sad thing is pretty much with few exceptions most of what Trump has done can simply be undone by a future Dem or Republican administration.

Which is why the GOP has pretty much relegated Trump to the EO and rules route.

The GOP is a useless pile of dog shit.

Sounds similar to my friend's experiences with Biafra. I was never into drugs as a punk. I was a "clean" punk and thought that drug use was just one more horrible thing about mainstream rock that I rejected. I was a smug little asshole at the time, a real moron. Now I've come full circle and am proud to be a Moron.

Run from the blue and windy sea.
Should I come home to you, San Francisco?
Your stinky turds and rancid pee?

261 Excerpt from the "Segregation" section of my Occupy report:

----

SEGREGATION

But not all is rosy in this new society. Some of the very worst customs already banned from our existing society have re-emerged at Occupy Oakland. One of the ugliest of these is segregation.

The encampment has already fractured into a series of micro-neighborhoods, just like a real city. But at Occupy Oakland, where you are permitted to live is determined by your gender and/or racial or sexual identity. Here, for example, is a roped-off "gated community" reserved exclusively for female, gay and transgender residents.

Elsewhere are tents with a "minorities only" rule.

And lest you might be so naive to think that these rules would only ever apply to the Occupy camp, and not to the city at large should the Occupiers ever take over, be aware that one of the Occupation's many demands is to "Stop White Gentrification in Oakland" -- which would mean the establishment of new laws preventing white people from moving into certain neighborhoods.

Yes, my friends, the Occupy movement has made segregation trendy again!
