Indeed, the desire to stock the DC Circuit Court full of liberals was a prime reason Miguel Estrada was filibustered, and then why Harry Reid ended the fillibuster of federal judges (below the Supreme Court level), to push in their leftwing judges above conservative objections. So Kavanaugh's dissents will tend to be dissents against a very left-wing circuit.In federal appeals courts, cases are usually decided by three-judge panels. Across the D.C. Circuit during Kavanaugh's tenure there, 3 percent of the votes were dissents. But Kavanaugh cast a dissenting vote 7 percent of the time. When Kavanaugh authored the opinion, 14 percent of the time the co-panelists dissented against him, compared to only 10 percent of opinions that provoked dissents when he wasn't the author. In contrast to this rift-making, Justice Neil M. Gorsuch -- as well as previous nominees rejected for being divisive, such as Merrick Garland and Robert Bork -- generated more agreement than Kavanaugh relative to their peers on the opinions that they wrote. We also found that was extremely polarizing in his votes. We measured how dissents vary with the party affiliation of the president who appointed judges. (For the sake of our research, judges elevated by a Republican president are "Republicans," and vice versa.) Judges who tend to dissent mostly against those appointed by the opposing party's president contribute to "vote polarization." When sitting with two panelists appointed by Democrats, Kavanaugh dissented 19 percent of the time; in other cases, he dissented 5 percent of the time, which is nearly double the rate of his colleagues. Kavanaugh's vote polarization is especially clear in cases relating to constitutional, civil rights and due process law. (In a recent abortion case, for example, he dissented against the Democrat-controlled majority ruling that guaranteed an undocumented immigrant's right to an abortion while in state custody.) Gorsuch and Bork, by contrast, did not display the same degree of vote polarization. Garland was actually more likely to cross party lines than his D.C. Circuit colleagues did.He'll do. These stats about how conservative or how many times you dissent or whatever, its got a sort of fun baseball appeal but the numbers really don't mean much. You can't learn much about a judge Ior a legislator) from numbers, you have to look at the cases.
Take Ron Paul for example: the dude would vote against every bill that fit his speeches... when he knew they would pass anyway. But when it came to act on them, he'd take every earmark and sneaky trick to fatten his district that was available to him. So his votes LOOKED good but in reality he was just as bad as anyone else. Let's be honest, the Senate didn't take up the Garland nomination because they didn't want Obama to replace Scalia. That's it. Whatever other reasons they stated were just excuses, that was the real reason.
And I'm fine with that, it would have been a horrendous result if Obama had picked yet another low-octane true believer for the court and swung it 5-4 against the constitution. At first I was against Kavanaugh because of the Bush family connections and he seemed very Kennedy 2.0 being his former clerk and all, but the actual decisions I've seen show a pretty solid conservative pick. Really strong on 2nd Amendment especially.

If there's some conflict involved, they don't ask who did what, they ask what were the skin colors of the parties involved? They think they can "prove" institutional racism or sexism by citing statistics instead of actual cases that demonstrate racism or sexism. And here again, they are not looking at which judge supported what, but at statistics about dissent from the majority in order to prove that the judge's judgment is unreasonably biased. When my liberal father tried to guide my thinking as a child with such insinuations, I could clearly see it was pure bullshit even then. Way way back when I was much younger I went to an open-mike comedy show in Berkeley. Somewhere in the middle of the evening this androgynous black person with kinda short cropped hair got up and spent the whole 20 minutes in character as "Fontaine," a sort of deranged black street bum. On a hunch, I looked up the name of the comedian who created the "Fontaine" character, but saw that Fontaine was actually a chick called Caryn Johnson. I shrugged it off. It was only later that I learned that Whoopi Goldberg WAS Caryn Johnson, and that the person I had seen as "Fontaine" all those years ago had eventually morphed into the person known as Whoopi Goldberg today. There are so many interesting new dynamics on the Court going forward. Thomas is now the elder statesman for the Conservative side - what affect will that have? Roberts is fully in charge and found his footing. By all accounts we have (will have) two young dynamic writers. Alito brings his own brand of originalism. There is a sense of optimism on the Court that I haven't had in a long time.

I love women in high heels. I mean, damn, I really, really love 'em. Wedges or stilettos, both are great, and makes a sharp-lookin' girl even sharper-lookin'. The whole effect is lost if you put high heels on those stupid platform shoes. The whole point is the elevation of the heel relative to the flat of the foot, and how it accentuates the legs O.o A nine-inch heel is absolutely pointless because no one could even stand in such things... therefore, they add a massive platform to the flat of the foot that does nothing but make the woman have to walk on stilts.
