Collins, Murkowski Signal "Comfort" With Kavanaugh

A lot of people were disappointed Trump didn't pick Amy Coney Barrett. Including me.

I suspect the problem was with the new Liberal Twins of the "Republican" Senate Caucus, Collins and Murkowski.

They're okay with Kavanaugh, it seems.

For anyone concerned by that -- a category which again includes me -- Glenn Reynolds offers some reassurance.

But what kind of a Supreme Court justice will he make? And what can we say about the confirmation process?

With regard to the former, it’s likely that he will be another sturdy conservative, somewhere between Neil Gorsuch and Chief Justice John Roberts. Justices surprise the presidents who appoint them sometimes -- President Dwight Eisenhower supposedly said that the two worst mistakes he ever made were the appointments of Earl Warren and William Brennan to the Supreme Court ---but they usually don't. Kavanaugh has been a judge for a while, and is pretty much a known quantity.

Some conservatives would have preferred someone farther to the right, but realistically Kavanaugh fits Trump's stated requirements for the court, and Kavanaugh is probably a safe pick, unlikely to pose any surprise problems in the confirmation process.


The fact that Kavanaugh was a Kennedy clerk might be worrisome. But Reynolds notes that Gorsuch was also a Kennedy clerk, and he's been bang-on thusfar.

8 I think part of the reason we got Kavanaugh, not Barrett, is honestly the toxic nature of modern politics. The woman has how many children? 29 We're certainly moving the court right. I would have preferred Barrett too, but it's not like this is a bad pick - he's almost a Gorsuch clone. Roberts is now the 'swing' vote. Hopefully one of the lefty justices will step down soon because they're sick of losing every case. Then we'll have a 6-3 majority and Trump will have saved the country, if he hasn't already.

Saving Barrett until and if a spot comes up after the midterms is smart. With the number of red state democrats possibly losing senate seats, Collins and Murkowski might not matter next time. But I think he'll mostly be ok. But yeah, a missed opportunity to have Barrett assuming she could have got through. And I think tester and jones would have countered the rino twins since election year.

I think Kavanaugh will be okay from what I've read of his cases. But you never know whoever gets in there. Once you are there, you are free to do as you please, as we have seen with Roberts.

99 Kavanaugh appears to be crazy strong on 2A, and passed the Mickey Kaus test on immigration, certainly compared to other top names. He also had some great religious freedom opinions. He may be weak on resisting the surveillance state and some other issues I can't recall at the moment. Roe was badly decided of course, who knows what will happen with that. But if he stays a steady course based on his past, it'll be at least a triple, maybe a home run.

Compared to what most of thought was going to happen with Hillary, it's basically proof that God loves us.

No, one no vote makes it 50/50 and Pence steps in with the tiebreaker. But once McCain's tumor said it was fine with Kava, that was the end of the resistance. None of the retiring GOP'ers want to look even more bitter than McCain is. And Kava will get 4 - 5 dem votes.

That's not my concern at all. In fact, that's admirable and shows she has plenty of heart and compassion.
My issue is when that compassion flows into judgment and obscures the law for personal predilection.
By the way, I had the same worry about Kavanaugh. The man is also very active and compassionate. But it ultimately, based on a long record, it seems he's separated law and constitution from his personal compassion.

I had a female lawyer, who was amazing btw a real bulldog, once over the past 6 years. Well she decided to have another baby. Then decided to take a 2 years off leaving her practice. I had to get a new lawyer setting me back 100k easy and 1.5 years on my case.

Also I disagree with you about having all those kids and not taking care or them. The dad was not a stay at home father. They are a family of means so these kids are raised by hired help.

Also, Judge Barrett said it would be upheld and a different case involving different set of circumstances would have to be brought to the court over the privacy issue. I believe the ruling had to do with a married couple. So until a state makes abortion illegal and a single woman sues to have an abortion in that state, we are stuck with it.

There is nothing stopping state legislatures from making abortion illeegal. But the feminist lobby won't even allow for mandatory shared parenting after a divorce unless probbalr cause the child would he in danger so you see the strength of the lobbyist groups we are up against.

I've gone round and round with many people about this in the past year. The best argument they have is that it's never been tested in court. What court you might ask? Supreme Court? That's why firing Mueller will likely lead to a constitutional crisis.

Whatever your moral thoughts on birth control, is it really such a crazy idea that it's in the government/taxpayer's interest for poor people on Medicaid not to have accidental pregnancies? Considering a mom on assistance is basically a guarantee that a child will also be on assistance?

In plain English, we have been allowing the Bureaucracies to get stronger and stronger, and the Courts and the Legislatures to get weaker and weaker. This more than anything else is what has empowered the Deep State, and up until now the SCOTUS has mostly ignored the issue, even the conservatives.

This is one of Kavanaugh's signature issues - rolling this back. It is also a passion of Gorsuch. They may still be outnumbered on this 2 - 7, but they can at least work on Thomas, Alito, and Roberts, and start bringing them around. I think their chances are very good.

But I really dont want to hear about abortion or gay marriage until the underlying structural issues of governance are restored to their Constitutional Order.

When you have a sitting justice (Ginsberg) who said if she were creating a new nation's charter she wouldn't base it on the US Constitution, but on South Africa's, you can see why it might be "controversial." If you want to make a case for responsibility, let's take away their ObamaPhones first.

I don't want another mouth to feed, if it's even a little bit effective at accidental pregnancy in these communities and might even prevent some abortions from happening, seems like a great bang for the buck.

I'm not so sure. As someone posted above Kennedy voted w/ the originalist position 71% of the time, Roberts 81%. From what I've read I suspect Kav maybe be even better than Roberts.

A student of Kav's said the first thing he did was have them READ the constitution. He said the others all had them study precedent ruling w/out reading the constitution.. Big difference.
