Collins, Murkowski Signal "Comfort" With Kavanaugh

A lot of people were disappointed Trump didn't pick Amy Coney Barrett. Including me.

I suspect the problem was with the new Liberal Twins of the "Republican" Senate Caucus, Collins and Murkowski.

They're okay with Kavanaugh, it seems.

For anyone concerned by that -- a category which again includes me -- Glenn Reynolds offers some reassurance.

But what kind of a Supreme Court justice will he make? And what can we say about the confirmation process?

With regard to the former, itís likely that he will be another sturdy conservative, somewhere between Neil Gorsuch and Chief Justice John Roberts. Justices surprise the presidents who appoint them sometimes -- President Dwight Eisenhower supposedly said that the two worst mistakes he ever made were the appointments of Earl Warren and William Brennan to the Supreme Court ---but they usually don't. Kavanaugh has been a judge for a while, and is pretty much a known quantity.

Some conservatives would have preferred someone farther to the right, but realistically Kavanaugh fits Trump's stated requirements for the court, and Kavanaugh is probably a safe pick, unlikely to pose any surprise problems in the confirmation process.

The fact that Kavanaugh was a Kennedy clerk might be worrisome. But Reynolds notes that Gorsuch was also a Kennedy clerk, and he's been bang-on thusfar.

8 I think part of the reason we got Kavanaugh, not Barrett, is honestly the toxic nature of modern politics. The woman has how many children? I'm sure she doesn't want to expose them to the harsh criticism of the media, not to mention the death threats and vitriol of the lunatic leftwingers who make it their stock and trade to run women out of restaurants and movie theaters.

99 Kavanaugh appears to be crazy strong on 2A, and passed the Mickey Kaus test on immigration, certainly compared to other top names. He also had some great religious freedom opinions. He may be weak on resisting the surveillance state and some other issues I can't recall at the moment. Roe was badly decided of course, who knows what will happen with that. But if he stays a steady course based on his past, it'll be at least a triple, maybe a home run.

Compared to what most of thought was going to happen with Hillary, it's basically proof that God loves us.

Just because you work for someone, does not indicate that you always agree with them.

Second? The Senate could end up MORE Conservative next year, so easier to get a more Conservative pick through.

That's not my concern at all. In fact, that's admirable and shows she has plenty of heart and compassion.
My issue is when that compassion flows into judgment and obscures the law for personal predilection.
By the way, I had the same worry about Kavanaugh. The man is also very active and compassionate. But it ultimately, based on a long record, it seems he's separated law and constitution from his personal compassion.
Barrett is light on the record. And she's younger. You get that pick wrong and we're in trouble for generations.

Peeps, old people are living longer than ever. With top notch health care, attaining the 90s ain't no big thang no moar.

And it ain't like they work themselves to death. Ruthie just grunts once for Yes, twice for No, and her clerks make up the rest of it. Her biggest problem is NOT falling asleep during open sessions, something she did do this year.

193 Erick Erickson even had to explain why Trump made the best pick last night and had to admit that Trump is far exceeding what conservatives believed he or anybody would do with getting the courts stacked with great judges.

1. Kavanaugh dissenting opinions in the DC appellant court were used by SCOTUS as the majority opinions to overturn the DC court of appeals, which is like a mini Supreme Court.

2. We get to appoint a hardline Judge to replace him on the DC court of Appeals.

3. He is not a swamp creature/Deep State. He will be the only SCotUS Judge not worth over a million dollars. Rush went over this today, he has between 15k-50k in the bank. He is basically poor by DC standards.

4. He wanted to charge the Clintons with the murder of Vince Foster when working with Ken Starr on the Start report. He wanted Bill impeached.

5. David Brock notes in his book that Kavanaugh called Hillary a bitch.

William Rhenquist and Thurgood Marshall already did that. Rhenquist, especially, would be wheeled in to SCOTUS sessions by a big orderly in a white suit, where he sit through hearings and do his best Captain Pike impression. 233 At least we all get to see now that the 2016 campaign was not really for the Presidency, it was for the SCOTUS picks the President gets to make. The left wanted to remake the Court to be a liberal rubber stamp approval for laws they could not get passed through legislation but Trump crushed their plans just like he did to hillary.

The left could care less that hillary would have robbed the Country blind to enrich herself, they just wanted all of the Judge picks to be far left and that would have sealed the Court for the next 25-30 years. It would have been literally the end of the Country if she had been elected.

Hillary would have had three picks, the vacant one Gorsuch got to fill, ruth "Buzzy" ginsburg who would have retied at the end of the 2017 Court season if hillary had won and Kennedy as I am pretty sure he was going to retire now no matter who had won.

248 232 169 No, one no vote makes it 50/50 and Pence steps in with the tiebreaker. But once McCain's tumor said it was fine with Kava, that was the end of the resistance. None of the retiring GOP'ers want to look even more bitter than McCain is. And Kava will get 4 - 5 dem votes.

254 8 I think part of the reason we got Kavanaugh, not Barrett, is honestly the toxic nature of modern politics. The woman has how many children? I'm sure she doesn't want to expose them to the harsh criticism of the media, not to mention the death threats and vitriol of the lunatic leftwingers who make it their stock and trade to run women out of restaurants and movie theaters.

Posted by: MWR, Public Intellectual, aka Beth at July 10, 2018 03:33 PM (rP4OC)

I think it's because at this point she's a cipher. We don't know how she'll rule on things because she hasn't done that yet. She's been a professor in law schools. Give her some time on the bench and she'll have some accomplishments. Trump likes a track record to go off of with people.

Frankly, I'm thankful Trump's being careful here. Socons, and really most of the wings of the party outside the corporate goons who get whatever they want, are cheap dates when it comes to politicians. All you have to do is talk nice and they're ready to pour votes in the box for said politician.

How has that worked? Look around.

What did the Moral Majority accomplish?

Thank God for Donald Trump because he's going to deliver for you and he'll make a lot of effort to make sure the gift pays off.

"
That's not my concern at all. In fact, that's admirable and shows she has plenty of heart and compassion.
My issue is when that compassion flows into judgment and obscures the law for personal predilection.
By the way, I had the same worry about Kavanaugh. The man is also very active and compassionate. But it ultimately, based on a long record, it seems he's separated law and constitution from his personal compassion.
Barrett is light on the record. And she's younger. You get that pick wrong and we're in trouble for generations.

I had a female lawyer, who was amazing btw a real bulldog, once over the past 6 years. Well she decided to have another baby. Then decided to take a 2 years off leaving her practice. I had to get a new lawyer setting me back 100k easy and 1.5 years on my case.

Also I disagree with you about having all those kids and not taking care or them. The dad was not a stay at home father. They are a family of means so these kids are raised by hired help.

Point is that it points towards a crypto-feminist. I do agree with you about the feelz blinding of facts, evidence, and law could be an issue.

321 A huge reason PDT got elected was his promise to pick good scotus judges. He's following through on that, using a process that even his enemies are calling innovative, effective, and transparent (he published his list of candidates during the campaign).

This is going to be a cornerstone of his argument for re-election. It shows:
a) he keeps his promises
b) he's not wacky when it really matters (twitter doesn't matter.. scotus does)

394 Democrats are concerned Sen. Elizabeth Warren might not appeal to independents or blue collar workers living in the Rust Belt states that voted for President Donald Trump...

"I just can't see a blue-collar, Rust Belt guy voting for her," one Democratic strategist who has worked on presidential campaigns told The Hill Tuesday. "I think the party needs to be realistic about that." The skepticism possibly stems from Democrats fears that Trump has voters in Pennsylvania and Michigan on lock down.

Ol' Ben Roethlisberger might say: It's funny because they are unintentionally admitting they need white men to beat Trump.

397 There's no question Trump knew it was a narrow margin and didn't want to chance it with these GOP women who seem to worship at the altar of abortion. One of which is from a state that is about as red as it comes, Trump carried it by about 15 points.

But Kavanaugh is VERY strong on the 2nd amendment and against a lot of the Chevron agency nonsense, I put both those issues way above SoCon issues like abortion.

He praised dissent in Roe v. Wade.

Also, Judge Barrett said it would be upheld and a different case involving different set of circumstances would have to be brought to the court over the privacy issue. I believe the ruling had to do with a married couple. So until a state makes abortion illegal and a single woman sues to have an abortion in that state, we are stuck with it.

There is nothing stopping state legislatures from making abortion illeegal. But the feminist lobby won't even allow for mandatory shared parenting after a divorce unless probbalr cause the child would he in danger so you see the strength of the lobbyist groups we are up against.

With a 50-49 majority, if you can call it that (when Jeff Flake, Corker, Burr and other flamers are considered), you are no doubt right on the money.

With one more good election, assuming we can build on the Senate majority, and maybe a few more fortuitous retirements, we might give Trump the ability to nominate someone like Barrett.

Indiana Jones 3 was cast in 1989. Connery was born in 1930. That means Connery was 59 or 60 in that movie.

Ford is currently 75.

That means Ford is about ten years too old to play the role.

I've gone round and round with many people about this in the past year. The best argument they have is that it's never been tested in court. What court you might ask? Supreme Court? That's why firing Mueller will likely lead to a constitutional crisis.
My best comeback is that even Mueller agrees. Otherwise he'd have empaneled a grand jury for Trump instead of writing a report for Congress,

It's funny because IIRC, she has become on of these biggest Senate fundraisers off of her association with the CFPB. Just like the Janus case, this has nothing to do with the people, and everything to do with a threat to a proven Democrat donor stream.

What you refer to as the "Chevron Agency Nonsense" is the reason that I think he is an absolutely fantastic pick. It's bit of legal "inside baseball", but in short, many critics of our legal system have been pointing to the huge problem of allowing us to slip into an administrative law system, which has happened gradually over the last 30 years. (or more likely 50)

In plain English, we have been allowing the Bureaucracies to get stronger and stronger, and the Courts and the Legislatures to get weaker and weaker. This more than anything else is what has empowered the Deep State, and up until now the SCOTUS has mostly ignored the issue, even the conservatives.

This is one of Kavanaugh's signature issues - rolling this back. It is also a passion of Gorsuch. They may still be outnumbered on this 2 - 7, but they can at least work on Thomas, Alito, and Roberts, and start bringing them around. I think their chances are very good.

I guess there are social conservatives that think less subsidized birth control will lead to an increase in moral, sexual behavior. Seems naive to me.

Poor people make a lot of stupid decisions (that's why they're poor) and this one thing to make a stand on seems strange. A nickel for some condoms vs hundreds of thousands of dollars in health care, education and welfare for a new ghetto baby?

If you want to make a case for responsibility, let's take away their ObamaPhones first.

I don't want another mouth to feed, if it's even a little bit effective at accidental pregnancy in these communities and might even prevent some abortions from happening, seems like a great bang for the buck.
