Trump's Supreme Court Nominee Announcement Set for 9PM
AP Says It's Brett Kavanaugh

hosta has said it's not Amy Coney Barrett, and on Martha McCallum's show, he confirmed he wasn't just speculating, and that he knew who the nominee actually was.

Disappointing. A lot of enthusiasm has grown for Barrett.

Update: I've heard it's either Kavanaugh or Hardiman.

Update: AP says it's Kavanaugh.

There's another possibility...

The biography of Justice Byron White that I own mentions that at one point in White's career on the Supreme Court, the mental faculties of one of the justices started to deteriorate to the point where the other justices quietly discussed having one member of the court vote opposite whatever that justice voted just to invalidate his vote (incidentally, White was opposed to the idea).

Can't remember which justice it was off the top of my head. And fortunately, things didn't go that far. The justice in question apparently decided to retire at the end of that term.

Unfortunately, plaintiff Heller asked the Court to use "strict scrutiny" to strike down the D.C. regulations. The District of Columbia argued against this standard, believing that the Court should be more deferential to its efforts to curb violence.

Predictably, the Court of Appeals rejected Heller's proposal and refused to use "strict scrutiny" -- instead using a lower barrier which would permit the DC government to restrict people's Second Amendment rights, so long as they were "reasonably related" to an "important governmental interest."

Kavanaugh is a good and possibly great choice too. I hope. Certainly better than anyone Hillary would have put up. The courts have fabricated different levels of review which serve as balancing tests. I think it's more about who he can get through the Senate. With McCain AWOL and a Collins no, Barrett wouldn't have the votes. Trump could have gambled and put her up anyway, watch her get turned down, wait for the new Senate after the election, and if the GOP picks up some extra seats, get her through then.

But, not only would that be a gamble, but SCOTUS starts hearing new cases in October. If we don't have someone in place by then, then some cases will be lost or at best, delayed.

Long-term, replacing Thomas with a young judge would basically mean that the right flank of the court is in place for the next twenty years: Gorsuch, Alito, Thomas' Replacement, Kavanaugh, Roberts. Not perfect, but my concern is if Trump were to lose in 2020, or if RBG were to hold on until 2025 and a Dem President.

That sounds like quite a reasonable possibility. Does Soros actually give ANY money to anything worthwhile or just left wing causes and agitation, because (his dangerous opinions and actions aside) I think it's a sin for someone with that much money not to give to say-Meals on Wheels, or Habitat for Humanity or Food pantries or any number of organization that actually do GOOD in helping individual people? I think Thomas may eventually retire, and will be paying attention to make sure Trump is Pres and there are enough R Senators to vote for his successor.

But I see it in 2020, or if Trump looks to be re-elected like I am guessing at this point, 2022.

And by then, at least one more squishy will retire. So that would be a solid 6-3 for a long time.
