Yeah I think Max Boot has reached the limits of his value to everyone, including the left. A lot of commentators rose to prominence during Operation Enduring Freedom supporting the idea of destroying terrorism where it is found and fighting against tyranny in nations that cause us harm at home. And I'm fine with that.

The concept is that the Republican Party simply will not listen to reason or complaint, so that they will only listen to failure and loss. Basically, stare decisis means that precedent has great weight. Lower courts are bound by decisions of higher courts. And the highest court should not overturn its previous decisions lightly. In that particular case, it's fair to say that Dred Scott was overruled by the 13th, 14th, and 15th Amendments. (the Reconstruction amendments) But Stare Decisis is really just a rule of thumb created by courts over the centuries to stop people from bringing the same old cases back to them when they're sick of hearing about them. On important topics, it's "more honored in the breach than in the observance", as Shakespeare put it. Yes, with any dementia of all kinds, they can get quite agitated. It often gets worse at night, "sundowning" they call it. I noticed this tendency with my father when he first got back after his broken hip. He's okay now, and never got violent, just "testy" and grumpy. They essentially changed the part of the 5th amendment that says nor shall private property be taken for public use, without just compensation They changed "public use" to "public purpose"meaning anything the gov wants to do is now OK.
