How Did Peter Strzok's "We'll Stop It" Text Get Deleted or Go Missing from Archiving?

Here's the efforts it took to get the text back -- efforts, of course, that the FBI did not take, preferring to let buried evidence lie.

What Horowitz did not explain -- and was not asked -- was why Strzok's portion of the Aug. 8, 2016 message was so difficult to find.

Horowitz said that the FBI’s failure to discover the text messages raises concerns about whether the bureau was able to collect all of its agents’ and officials' text messages.

"We are not convinced that the FBI was collecting 100 percent of the text messages," he said.

The official story we're getting is that this text wasn't originally archived because there was a period of several months when the automatic-archiving system wasn't capturing texts.

But...

As Mollie Hemingway points out starting around 16:00 here, that December-May glitch where texts weren't being auto-archived does not include the August "We'll stop it" text -- so why was that text not turned over?

Did Peter Stzok intentionally delete it? And if so, what does that suggest about his state of mind -- you know, his intent? Prosecutors routinely cite efforts to cover up an action as consciousness of guilt and therefore as proof of intent.

Also see Sheryl Atkinson's discussion of the FBI's and DOJ's illegal redactions of information not for "national security purposes," but for the forbidden purpose of sparing them from embarrassment and/or criminal inquiry.

The head of the Senate Homeland Security Committee, Sen. Ron Johnson (R-Wis.), is not only seeking redacted material but also is trying to find out who is responsible for withholding it.

Improper redactions are when federal reviewers - -in consultation with their political masters -- block out parts of documents that the public or Congress is entitled to see. Under policy and law, redactions are only permitted in limited, carefully defined circumstances, such as to protect national security. After all, government officials do not lord over us; they work for us, on our behalf. They own neither the documents they generate nor the information they collect; we do.

Yet, too often, the feds have redacted information in an apparent attempt to obstruct efforts to investigate their actions, or to prevent release of material that implicates them in embarrassing behavior or wrongdoing.

He includes some seemingly outrageous examples found among text messages written by FBI agent Peter Strzok to his reported then-lover, FBI attorney Lisa Page. One of them reads, "Currently fighting with Stu for this FISA," where "Stu for this FISA" was redacted in a version turned over to Congress.

"FISA" refers to the secretive Foreign Intelligence Surveillance Act, which dictates limited terms under which the FBI can wiretap U.S. citizens. It's not known who "Stu" is but a man named Stuart Evans is National Security Division deputy assistant attorney general at the Justice Department. And the date of the text coincides with the timeframe in which FBI agents successfully convinced a FISA judge to let them wiretap Trump campaign adviser Carter Page.


Other redactions included: "Went well, best we could have expected. Other than L.C.'s quote, 'the White house is running this'” (the initials “L.C.” had been redacted); and "Jesus. More BO leaks in the NYT" ("BO" had been redacted).

Is that even legal? What about making a change in the year without initaling it by the signee and the notary? Is that legal?

The notary stamp only recognizes that the letter was as examined at the time of notarization. You can't back-date notarizations. (or much of anything, really).

Mikey, a few years ago a B-52 came to the airshow here, I joked with the crew about how I remember - vaguely - back when the age of the planes *first* matched the age of the crews (back in the 80s), and now the planes are twice the age of these guys.


They were based in Minot. As they said, the only time they got away, they went to Barksdale, Guam, Diego Garcia. So they had two guys at a time with the plane at the airshow, everybody else at the suite they'd rented downtown (party!), no sleep was expected for days. Funny.

Seems likely at some level. As long as he was employed he was under the control of DOJ and subject to the IG. Apparently his usefulness ended when the IG released his report.

Would also seem to indicate that Horowitz is pretty far along with the FISA abuse part of his investigation. That would seem to be where his real exposure lies.

Dr. Rockzo - it's difficult to be precise when obviously there is a lot going on here, more than you could possibly relate in that post. But, it's possible - IF the person who authored the letter took it a year and a half later to a notary, and then re-signed the letter in the notary's presence, and attested to the truth of everything he stated (is this an affidavit? what is it?) then it could be valid.

As to changes - a notary can only certify signatures and initials that are made in his or her presence.

But if someone makes any change on a document AFTER it has been notarized, that probably makes the entire document invalid for any legal purpose.

Dr. Rockzo - it's difficult to be precise when obviously there is a lot going on here, more than you could possibly relate in that post. But, it's possible - IF the person who authored the letter took it a year and a half later to a notary, and then re-signed the letter in the notary's presence, and attested to the truth of everything he stated (is this an affidavit? what is it?) then it could be valid.

As to changes - a notary can only certify signatures and initials that are made in his or her presence.

But if someone makes any change on a document AFTER it has been notarized, that probably makes the entire document invalid for any legal purpose.

Tom, a notary can't assert that someone was telling the truth about some past event - that is not in the scope of the profession. What the notary can attest to is what the document looked like at the time of notarization and that the parties supplied and identified their signatures (the notary is actually supposed to be watching, but that is often, um, glossed over).

Absolutely nothing is asserted as fact before the time of notarization.

The date on the notary page was changed by pen with no initials at all about the correction. So we have no idea if this person even wanted this statement to be a sworn statement and get involved at this late of a date. Almost 2 years later since the original letter and the date was changed by pen with on initials.

And the letter itself was hidden from us for over 2 years and the noterized affidavit part of the later was never given to us but filed to the clerk without delivering it to us as required by the courts.

I just found out while doing due diligence.

While it might vary State by State, any changes made to a document signed and witnessed by a Notary must be initialed and dated by both the person signing and the Notary.

I found this out when we lived in Kentucky and I put the wrong date on a document when we were in the house buying process.
