SPLC Settles Defamation Lawsuit for $3.3 Million

Some cash-money consequences for the defamation factory SPLC.


The Southern Poverty Law Center has made an apology and agreed to a $3.3 million settlement in a lawsuit over its "Field Guide to Anti-Muslim Extremists." When the Field Guide was published in 2016 it included the name of Maajid Nawaz, a British Muslim who runs the Quilliam Foundation.

...

The SPLC posted a video apology on its own site.... The apology says in part, "Since we published the Field Guide, we have taken the time to do more research…" Yes, lawsuits have a funny way of making people do more research.

The Southern Poverty Law Center Surrenders Unconditionally To Maajid Nawaz. We Should Be Concerned.
One of the most basic principles of defamation law, mandated by the First Amendment, is that pure opinion can't be defamatory. Only statements of provable fact - or statements that imply provable fact - can be defamatory. I write about this constantly. An opinion, however moronic or unfair, is absolutely protected by the First Amendment unless it implies that the speaker is relying on undisclosed provable facts. So, for instance, "look at what this guy wrote, he's a bigot" is by definition not defamatory; it's based on an interpretation of a disclosed fact, the thing the guy wrote. "I've listened to this guy's conversations and, let me tell you, he's a bigot" might be defamatory, because it implies undisclosed facts - whatever you claim you heard.

Here, the SPLC's fatuous Field Guide appeared to be classic opinion based on disclosed facts. The SPLC offered its opinion that certain people were "anti-Muslim extremists" based on facts it set forth and linked. Their conclusion appears unfair, narrow-minded, and uttered in bad faith, but opinions are absolutely protected whether or not they're unfair, narrow-minded, and in bad faith. It's possible that I have missed a textual analysis, but it appears to me that Nawaz' criticism of the piece was that it unfairly characterized him based on facts, not that it got specific provable facts wrong.

On the one hand, not nice for free speech.

On the other, if the SPLC's ratings are affecting people's livelihoods in such negative ways while they completely abandon any pretense of their original mission, then fine.

Make them play by their own rules until they either voluntarily demand that no one should use their hate list, they purge their hate list forever, or they get behind 100% the free speech movement.

I would normally not care if some non-profit labeled people as racist, but the fact that so many other organizations use it to make business decisions about who to fund and not to fund is what gets my gourde.

If other lawsuits get them to either clean it up or stop the hate list completely, then I think it's overall a win. A bigger win than the (hopefully temporary) loss to free speech.

If the SPLC won't fight such a defamation suit, other similar organizations from every side of the political spectrum are probably going to be more willing to just settle and modify their behavior.

There's no government action, of course, but the affect on the culture of free speech is probably real.

Of course, not many organizations create Hate Lists that include the people who founded Chik-Fil-A.

And, the post I quoted from is largely legal analysis, not political commentary. He is a former federal prosecutor and currently a practicing defense attorney, specializing in free speech law. So, he knows what he is talking about, though I (not an attorney) at times disagree with him.

Not being a lawyer, here is my guess. The SPLC settled because while they will claim that they were just stating an opinion, and they were, the SPLC and the dipshits of the MSM use their declaration of an organization being a hate group as fact. So while they had a chance of actually arguing on the grounds of opinion and free speech, they and their media allies have essentially killed that claim by their actions. Thus they chose to settle rather than wind up paying more.

(Even MSNBC seems to know where the line is, and as repulsive as I find them, they still have those protections of free speech precisely because they haven't yet crossed the line. Most people know Maddow is just an ignorant loudmouth, but her show never pretends to be anything but an opinion piece) But the fact of the matter is that the $PLC has NOT, in fact, been open about their insanity being their opinion, but rather have been presenting themselves as a non-partisan watchdog group. At best, maybe a out-of-the-way disclaimer filled with weasel words, but the entire site is set up specifically to deceive visitors. If they aren't guilty of libel, they're certainly guilty of misrepresenting themselves, another issue on top of that.

That's probably why the suit was successful; Nawaz was probably able to reasonably present enough evidence that the $PLC was engaging in libel or at the very least misrepresenting themselves. Let's be real here, it probably isn't all that hard to do.

291 Brian, I could have this wrong, but I think the presumption is that Strzok has an immunity deal with DOJ (the only entity that can prosecute him), thus this frees him up on the Hill, where he wouldn't need such a deal (the Hill just refers cases to DOJ when they think there is one).


I find the idea that Strzok has any kind of immunity deal very troubling. My assumption is that no truly big names are going to swing on any of this (in any of the related mega-scandals centered on campaign 2016), so ..... what would immunity for him be in exchange for? Beyond that, Strzok clearly is one of the worst characters in the play, and the country should see him hit with maximum punishment for obstruction of justice (what else could you call the conduct of these "investigations"?).

I still think he's mistaken about the "Field Guide" as opinion piece, and as one commenter pointed out, it was drafted to specifically be taken as an authoritative guide (hence, "Field Guide") which is likely why they're having legal trouble now. That shit plays great for the annual drives to grift elderly leftists out of their Social Security cheques, (which I suppose is one reason to want $PLC to still be around, otherwise they might give to a group who do some real damage like Planned Babykilling) but it probably looks pretty bad for the lawyer trying to represent you in a defamation suit. And, as others have pointed out, the $PLC positioned themselves as "experts", so much of the pain they're experiencing is the direct result of blurring that line between protected opinion and unprotected "fact presentation".

Also, what "good work" the $PLC did was by sheer dumb luck: they were a scam outfit from the very beginning.
