Mitch McConnell Cancels August Recess To Force Democrats to Either Begin Confirming Trump Personnel or Else Forgo Campaigning for Re-Election

Finally. Though I should allow that if you're going to apply this kind of pressure, this is the right time to do so.

WASHINGTON, D.C. -- U.S. Senate Majority Leader Mitch McConnell (R-KY) made the following statement Tuesday regarding the cancellation of August recess:

"Due to the historic obstruction by Senate Democrats of the president's nominees, and the goal of passing appropriations bills prior to the end of the fiscal year, the August recess has been canceled. Senators should expect to remain in session in August to pass legislation, including appropriations bills, and to make additional progress on the president's nominees."

Background: It is expected that Senators will have a state work period during the first full week in August before returning for the rest of the month.

Posted by: JackStraw at June 11, 2018 07:58 PM (/tuJf)

I am pretty sure that is correct. McConnell, though, has had a pretty weak hand in the Senate with all of the NeverTrumpers there.* In my opinion he has had to finesse a lot of things, time a lot of things, just to get them through without losing what little control he has over the McCain, Flake, Graham, etc. type of senators he has. This is the finish line stretch so there is no more need to conserve, it is just to sprint since now - now - the spotlight of electoral performance is on everybody who wants to return. (That stuff that happened in February 2017, darlings? Hobo Suits - I do not look back, darlings.)**

So things have changed, and someone with an actual understanding of the pulse of politics in the capitol gets to use that.

*Trump is not your standard issue Republican and he is in the role of the unconventional guy sent to straighten out the sorry unit and get it going, with McConnell as one of his company commanders, the guy who seems resistance but is timing things right for the idiots under his command that he knows. Great movie , two thumbs up, popcorn worthy, most bigly.

I think you misstated the Dems choices. In no event will they start to confirm Trump's staff. But, they will likely mostly fail in their obstruction, because McConnell has also been changing the rules to make obstruction harder. The only way they can be successful is where they can swing a few GOPers over to their side on particular nominees.

So, the punks have to ask themselves, Do they feel lucky? Is it worth forgoing their campaigns to attempt obstruction when they will mostly just be pissing into the wind.

Of course, they can still just be absent and hit the campaign trail, but that is politically perilous, especially if their opponents are in the least bit competent in holding their feet to the fire for being absent and campaigning while the Senate is in session.

But, GOP, so competent can be a high bar.

A) McTurtle didn't say boo to IWon about his trade deals even when he flat refused to tell congress (and, in particular, the Senate) what the hell was in them.

B) To the extent that trade is with foreign countries, it falls mostly into the Presidential Constitutional powers. The Senate's roll is to provide advice and consent to treaties, both trade and others. This is another attempt by Trump haters to limit his powers unconstitutionally.

Yeah, I heard the beginning of that. Then I arrived home, parked my car, and didn't have the urge to turn on the radio once I got inside.

It isn't "free trade" when American businesses are hamstrung by Byzantine environmental and labor laws, while China has none of that. Hell, they still have hundreds of coal miners killed every year, like we did 100 years ago.

One of their factories that builds consumer electronics for the American market installed nets around the roof of the building, because too many workers were cracking under the pressure and committing suicide.

167 As I said when this was announced, it's a long over-due move - but yes the leverage gets much more intense as the calendar moves towards November.

And Mitch actually does not have to please caucus members on things like this - usually leaders do, of course, try to keep the caucus happy, but when it comes to the calendar they would have to actually remove him to change his decision.

As outrageous as the appointments situation is, the appropriations one remains key. A decade since regular order in appropriations, basically a giant systemic dodging of accountability by *both* parties in Congress.

So the "Trump agenda" will remain largely abandoned, and nobody faces walk-the-plank votes (or very few).

175 Trade means you have to get along with your neighbors.

Over the years, neighbors all over the world have been chipping away at the USA's yard, pooping on the corner, doing a donut with the car on the front lawn, TP'ing the trees at night.
Bush, Clinton, Bush, Barky. All let the neighbors get away with it.

Then Trump moved in, and immediately set out to kick the dog that poops, shoot the tires from the car making donuts on the front lawn, and kicking the azzes of those throwing toilet paper rolls into the front yard trees.

The rest of the neighborhood screams because suddenly the old man does a Clint Eastwood impression of "Get off My Lawn!"
And working America is waking up to it. That is why the Leftists (don't call them Democrats, that party died a long time ago) are so shrill and antagonistic.

Just like President Two Scoops planned.

180 McTurtle didn't say boo to IWon about his trade deals even when he flat refused to tell congress (and, in particular, the Senate) what the hell was in them.

Not true. TPP was a treaty and was never ratified by the Senate. It's dead (though they're trying to get it passed piecemeal under new names).

To the extent that trade is with foreign countries, it falls mostly into the Presidential Constitutional powers. The Senate's roll is to provide advice and consent to treaties, both trade and others. This is another attempt by Trump haters to limit his powers unconstitutionally.

Yes, the president can negotiate treaties, subject to Senate approval. That's not what this is about.

The way the law reads now the president can declare (without providing any evidence) a country is "dumping" products in the US and unilaterally impose sanctions. That's what is unconstitutional.

I understand the rationale for it - there are millions of different types of items imported from around the world, and Congress is too ponderous to deal with them all individually. But they're still sidestepping their responsibilities, and there's no reason they can't force the president to get approval for major sanctions.

If the Senate manages to neuter Trump's trade leverage via Lee's bill, they might not like the accountability they'd be assuming. They have aggressively run from accountability in all things for years, and I don't see too many of the midgets who make up Congress actually wanting to walk the plank on a trade vote where they oppose Trump.

242 Ace's liver, whether delegation of particular powers on any matter (incl. trade) is "constitutional" becomes sort of an instant tail-chase. Generally, and logically, Congress can delegate whatever powers it chooses to delegate.

The example you give - implementing and executing particular provisions of trade agreements - is classically something that *is* delegated to the executive. Congress has infinite ways of dealing itself in to such decisions, if it wants, to give it a partial, non-executive-ish say on particular calls.

Many examples. From base closure (BRAC) to sunsetting authorities on various powers given to the executive, Congress can constitutionally rig up any Rube Goldberg scheme it desires.

252 "How Long Does a Recess Appointment Last?

A recess appointment expires at the sine die adjournment of the Senate's "next session." Where the President has made a recess appointment between sessions of the same or successive Congresses, this appointment has expired at the end of the session that next convened. Where he has made the appointment during an intrasession recess, however, the duration of the appointment has included the rest of the session in progress plus the full length of the session that followed. At any point in a year, as a result, by making a recess appointment during an intrasession recess, a President could fill a position not just for the rest of that year, but until near the end of the following year. In practice, this has meant that a recess appointment could last for almost two years."

Posted by: golfman at June 11, 2018 08:33 PM (If3tB)

I used to be a big proponent of free trade. Even still I think in the long run it gives you the most aggregate growth.

The problem is it has two major re-balancing effects - it tends to make wealth among countries more equal, which isn't a good thing if you start out the wealthiest.

It also makes wealth distribution inside countries more unequal - if you have a globally useful skill you end up making more money; if you don't you make less.

All in all free trade hasn't been a good thing for the US - it's helped China become more powerful at our expense and, with virtually unrestricted immigration, left the left half of the national bell curve at subsistence wages.

Several big issues ran together into the Big Libertarian Lie. Would a totally free world, like, utopian-level free, not have borders? Of course not. And so the United States, alone of all nations, was expected to behave as if its borders did not exist.

Protective tariffs: in general, a less than good thing? Sure. And so everybody in the world gets to keep their tariffs, except the United States, because we libertarians can influence the United States and the French yell at us in a foreign language.

Military adventures, foreign involvements, secretive influence in the affairs of other nations. All nations may do this, except you-know-who.

As bad as they have been at understanding what is Constitutional, I'll be surprised if they don't blatantly say that an express power in the Constitution is "un-Constitutional" because no other president has "stooped this low" before. I just made assumptions about the equation. Like, it only applies to one product, rather than a basket of goods. And, that the fraction is a percentage. I understand how it is a sliding percentage based on the deficit/surplus of the specified trade. I would not have a big issue with the general principle of that scheme. However, the devil is in the details.
My opinion is pretty much the one stated above regarding 0% tariffs, 0% subsidies, etc. if we were in an ideal, optimal world. But, because we are not in an optimal world, we occasionally need to use the tariff stick to beat others into something more 'fair', even though it is *long-term* sub-optimal for everybody.

418 No tingles here. Cold-blooded, yes, but also (like Trump) entirely results-oriented.

Generally speaking, negotiations are *not* much affected by personalities, when we're talking about major countries, negotiating big questions. This could be an exception.

The Norks are only there because circumstances compel them to be there (some of those circumstances the direct result of Trump's strategy, some more long-term in origin). Kim's a dictator running a very weird, narrowly based system. He's no match for Trump in any sense, so in this case personalities *might* matter more.

And, amazing as it seems, Trump may be the best possible person to have to do this.

(OSIA, from earlier comment, was On-Site Inspection Agency, set up to monitor the INF treaty with the USSR, it involved constant presence of each side's inspectors at production facilities in the other country)

Posted by: rhomboid at June 11, 2018 09:08 PM (QDnY+)

419 my prediction:
1 - Trump makes a really good deal and the Dems oppose it because Kim isn't put on trial for war crimes; or
2 - Kim proves exceedingly difficult and the Dems demand that Trump make concessions to prove his sincerity.

either way I would not be surprised if Kerry decides to have a few off the record meetings with Kim to help Kim get a good deal.

421 If recess appointments are so trivial and unimportant, why has the Senate constantly refused to recess. They barely even worked in March, but made absolutely sure they kept up the fake 1 minute gavel open gavel closed nonsense the whole Easter break.

Until proven otherwise, this cancel the recess business is just more of the usual. McConnell doesn't care if agencies are still understaffed 1.5 years into Trump's term.

423 Really, anything less is unacceptable, and a blow-it by the Trump team. They've given themselves the leverage to demand this, and they understand nothing less is really acceptable. Expecting this will be the outcome.

We ended up going to war in Iraq because of the IAEA dipshits not doing their job, and our "allies" (France , Germany, et al) cheating on sanctions. I'm glad PDT is pushing these fuckers on trade policy. We can't trust Congress to do anything. As Tucker put it, half of Congress takes money from the Chinese, so they get to devalue their currency and steal our technology while the WTO sits by with their thumbs up their asses!

========

It would make an interesting story if Kim were to abdicate to live the rest of his life in some South Sea island paradise. North Korea becomes a true democracy. Years later, a disgruntled citizen comes to prominence, and tracks down Kim for the torture inflicted on his family. Would make a good revenge flick.

629 "A comparison of two recess appointments during the 108th Congress illustrates the difference in recess appointment duration that results from the timing of appointments. During the recess between the first and second sessions, President George W. Bush appointed Charles W. Pickering to a federal court of appeals judgeship. Several weeks later, during the first recess of the second session, President Bush appointed William H. Pryor to a judgeship on another federal court of appeals. Pickering's appointment expired after less than 11 months, at the end of the second session. In contrast, Pryor's recess appointment would have expired after approximately 22 months, at the end of the first session of the 109th Congress.27 Although the Pickering and Pryor recess appointments were only several weeks apart, Pryor could have served nearly twice as long because his appointment was made during an intrasession recess."

But the damn guy could come to your hometown - like he did to Memphis to defend against Koko Ware - draw like crazy, make your guy look good, get the pin, leave with the title ... and leave the promotion better than he found it by putting over the top face without losing.

The Senate held pro-forma sessions to prevent from recessing for every "break" they took this year and last year, including last year's August "recess".

It's very clear there has been no interest in actually filling vacancies. The primary motivation has been to prevent a single recess appointment from occuring.
