Supreme Court Rules 7-2 In Favor of Masterpiece Cakeshop, Persecuted by Colorado Civil Rights Commission for Refusing to Bake the Cake

The Court, unfortunately, did not rule that the Bake Me a Cake, Bigot law was itself unconstitutional, only that the members of the Colorado Civil Rights Commission showed a "hostility" and "animus" to religion that made this particular decision invalid.

The Supreme Court sided with a Colorado baker on Monday in a closely watched case pitting gay rights against claims of religious freedom.

Justice Anthony M. Kennedy, writing for the majority in the 7-2 decision, relied on narrow grounds, saying a state commission had violated the Constitution's protection of religious freedom in ruling against the baker, Jack Phillips, who had refused to create a custom wedding cake for a gay couple.

"The neutral and respectful consideration to which Phillips was entitled was compromised here," Justice Kennedy wrote. "The Civil Rights Commission's treatment of his case has some elements of a clear and impermissible hostility toward the sincere religious beliefs that motivated his objection."

The Supreme Court's decision, which turned on the commission’s asserted hostility to religion, strongly reaffirmed protections for gay rights and left open the possibility that other cases raising similar issues could be decided differently.


"The outcome of cases like this in other circumstances must await further elaboration in the courts," Justice Kennedy wrote, "all in the context of recognizing that these disputes must be resolved with tolerance, without undue disrespect to sincere religious beliefs, and without subjecting gay persons to indignities when they seek goods and services in an open market."

Chief Justice John G. Roberts Jr. and Justices Stephen G. Breyer, Samuel A. Alito Jr., Elena Kagan and Neil M. Gorsuch joined the majority opinion. Justice Clarence Thomas voted with the majority but would have adopted broader reasons.

Note that Hawaiian Judges have previously ruled that Trump's alleged animus and hostility to Muslims makes his travel ban unconstitutional, even though such measures are generally constitutional. I don't think this an analogous case (this case involves a tribunal ruling against a specific person, whereas the travel ban involves an executive action previously deemed constitutional; the court did not rule here that the Colorado commission's bias makes the entire law unconstitutional, which is the outlook pushed by Hawaiian Judges), but we'll see if the left pushes that angle.

I think the Court punted a bit by focusing upon Colorado's Kangaroo Process and its blithely dismissing the idea that religious rights exist.
In sum, you can read it as a roadmap for future Kangaroo Tribunals not to make a record that would necessarily run afoul of this holding.

It has been a long time since I dealt in this area so bear with me. The Supreme Court has long taken a view towards freedom of religious expression and freedom of political expression that can only be described as "the government better have a good reason" for the restriction. There has to be a compelling government interest and no other less restrictive way of achieving that interest (I know I am butchering this). I believe the Supremes noted that the Commission did not use this test and in fact blew off the religious belief explanation. I think the ruling (which I have yet to read) was to send the case back, use the correct religious expression balancing test, show your work, and stop f**king around - we're busy.

Nothing there that says God demands that you have buttsecks and call it good.

The Catholic position is that same-sex attraction is a burden--NOT A SIN in and of itself. It is that actual buttsecks that is a sin. Homosexuals are called to a life of chastity if they cannot find attraction to the opposite sex and marry. Pretty much the same as pedophiles are called to a life of chastity, because sex with kids is evil. And unmarried folks are ALL called to chastity, period.

94 I'm breaking my rule about commenting whilst at work (though I'm at lunch so that's okay) and on any thread that directly involves gay matters because this is very important to me.

I'm so happy about this decision that when BC texted me that the bakers won I very nearly started sobbing at my desk. I still may.

I was convinced the bakers would lose and I assumed it would be a 5-4 decision in which SCOTUS eliminated the First Amendment. I am thrilled to be wrong.

I'll have to read the decision and there is some troubling language in the dicta I was seen so far but this is a win. This is a HUGE win and that it was 7-2 is going to make it more difficult for the Left to do the out of touch and this is not who we are schtick.

Is there still significant work to be done to hammer home as clearly as possible that religious beliefs that homosexuality is morally wrong and that gay marriage is improper are not per se bigotry? Yes. But this is a major, major win.

I'm so happy about this.

The ONLY reason that bakers, florists, photographers, etc. object to providing services and good s for homosexual weddings is that homosexuality is a sin that they cannot participate in. The ONLY reasons that Civil Rights Commissions could give for making them (or attempting to make them since devout Christians cannot break God's laws even if ordered to by the state) disparage those individuals' religions by saying they are less important than the hurt feelings of homosexuals.





Kennedy set this problem up by declaring (twice) with the Constitution hating progressives that homosexuals have special rights that other Americans don't. He boxed himself into a corner where he cannot protect the special rights that he made up out of whole cloth without going against SCOTUS case law and destroying a set of rights that are explicitly written in the Constitution. This opinion was an attempt to square that circle.

That's entirely disingenuous of our judiciary. They re-wrote the Constitutional protections by using Jefferson's letter to the Danbury Baptists. But it is such a special-case splice, because they always seem to miss that the often-cited "Wall of Separation" was, by Jefferson's own words, in defense of the "Rights of Conscience".

So, if everything were on the up-and-up, we would have Rights of Conscience, but that has been taken away in the advance of the Siege Walls of the state.

I disagree, though I haven't read the decision either. But, from what I read of it, SCOTUS merely chastised the Colorado Civil Rights Commission for their anti-religion rhetoric. For the individual in this case, yes, a huge victory. But what of others similarly situated? If the Colorado Civil Rights Commission is smarter next time, and doesn't put their anti-religion bias on display, what happens then? It's anybody's guess.

I understand your pessimism, but common sense will most likely prevail. The law is written to keep things fair. If you let one side demand that you "bake the cake" then the other side can too. Even the most insane lefties can surely see that, especially now that they realize they are NOT going win every election from here on in.Anyway, it really doesn't matter. Apple makes 70% of the customary tasks for 70% of the customary users easy, at the expense of making 30% of the necessary tasks for 30% of the users damn near impossible. And, per friends and family who've done software development inside Apple, they have vanishingly near zero QA.

Of course, that depends to some extent on the platform and the vendor, and the phone/iOS world has taken some of that control away from Apple. They do have nice iOS dev tools compared to what has been something of a mess in the Android world.

I am a PC guy, but I've always used Macs in a professional capacity.

You may not notice the difference if you're not using very intensive processes (however even basic programs like Office have way more problems on Mac).

If you're running graphics software - you'll see it. Programs constantly crashing out. Constantly. Poorly developed interface and hotkeys by comparison to PC. Power users will encounter a much less accessible operating system. It's friendly, but much more difficult to use beneath the "surface" interface, which is inexcusable considering that the UNIX core of the Mac OS is quite versatile.

At this point, the next time I am provisioned a new machine, I'm gonna push HARD for a PC. A Microsoft Surface Studio, if I can make the hard sell.

Not on the record? I believe the Commission was being directed to use a strict scrutiny test to see if their decision was infringing on the right of religious expression. That will require that the correct test be articulated by the Commission and that there be plenty of facts on the record that support infringement of religious expression. And those strict scrutiny tests are not easy to get around. And everything will have to be articulated on the record or it is remanded again.

The Commission was given instructions and they will follow unless they want to be reversed again.

The commission now has to treat Christian beliefs as fairly and equally as it did other religions. If a Christian has to bake the cake, a Muslim or Jew has to bake a Miss Piggy birthday cake. Or a gay baker has to make a cake with a quote on Sodom Gomorrah.

The commission does not want to infringe on these other groups' rights (they're minorities, marginalized, whatever).

It just wanted to go after the Christians, and the Court basically said "everyone bakes the cake or no one has to bake the cake".

The WA case has been upheld by the Commie WA State Supreme Court.

Not quite. She is pointing to the D'Souza case as an example of what can occur in future cases. D'Souza is, for them, a lost cause. But, they are worried about Trump pardoning someone who Mueller goes after. Under NY law, once someone has been charged by the feds, if Trump pardons them before they even serve a sentence, NY can't go after them with state law. They want to change that state law so that if Trump short circuits Mueller with a pardon, NY can still stick it to that person.

For the individual in this case, yes, a huge victory. But what of others similarly situated? The Christian baker politely told them he did not bake custom cakes to celebrate gay weddings, just like he did not bake cakes to celebrate other events that violated his religious beliefs (such as cakes celebrating divorce, or cakes for raunchy bachelor parties, etc.). He told them he would happily sell them other types of cakes or baked goods.

Instead of acting like normal, decent, tolerant human beings and saying "okay, we understand, thanks anyway," they sued him. There were dozens, if not hundreds, of other local bakeries that would have happily baked whatever cake they wanted, but then they wouldn't have been able to pose as victims.

I have a kneejerk-Dem friend who is a photographer. She sides with the gay 'rights' crowd on just about everything and is fashionably anti-Christian, kind of new-agey but mostly agnostic.
But she BIGLY supports the right of Christian photographers to refuse to photograph gay weddings.
BIGLY.

What if a nudist sect wanted her to photograph their wedding? Ewwww. What if a Santeria group wanted her to photograph a chicken sacrifice? Ewwww.

It worries and angers her that the criterion is purely religious. It shouldn't be.

There was a case from Florida... went to the Supremes... property case... that took TWENTY YEARS to be done... originator of the case had DIED waiting (luckily his heirs continued the case).

"Justice Anthony M. Kennedy, writing for the majority in the 7-2 decision, relied on narrow grounds..."


I.e., they're saying the Kennedy's written opinion was where the "narrow" part comes in. Which, if I read commenters here correctly, it was narrow because the court didn't take on broader issues beyond the CO commission's animus.

But of course the MSM has to be itself and mangle the meaning in the headline.

I believe the Supreme Court did not rule any broader because there is already a long line of decisions regarding religious freedom and when the government can infringe upon it. This was a clear case of religious bigotry, the decision was overturned, and the Commission was told to go back and decide it properly. The Supreme Court hasn't exactly been silent on this subject over the past century or so.

383 There's cases in England and Scotland that have taken centuries and are still not finalized. Mostly because the cause of action has become moot for one reason or another.

This happens especially in property claims concerning boundaries or certain types of rights by adjoining owners.

If the family maintains continuity the cases can be continued indefinitely until a final adjudication.

It would agree that he wasn't liable for breaking the law but that the point of whether or not his religion trumped the feelz of the gays would not be decided.

They wait for another case to drop the hammer on Christians then. or the religious.

And there's talk that Heller wasn't such a good ruling after all and that it might just have closed the door to a lot of clarity about the possession of firearms and the type of regulations allowed.

And as we see they've not taken on another case since and there's some real doozies that are developing now.

I fully expect the gun grabber will finally realize that if they can cut off ammunition they will have the same effect and there's plenty of ways for that to happen that won't be turned back by the court.

They'll keep at it until someone finally decides they've had enough and enough other people start to gather.

I thought the Bundy thing would be the case but it was too isolated.

Need something in the midwest or coastal.

AND this wasn't about "not serving Gays," it was about "not participating in a ceremony that is directly contrary to your religious beliefs" [you know, that whole "sodomy is an abomination before the Lord" thing that shows up several times in the Bible]. The bakery in question would have sold them a cake, and had served gay customers without complaint; they just didn't want to be forced to participate in a homosexual "wedding."
Now, if the gay Mafia goes after the Muslims for their genuinely cruel treatment of gays, they'll have some respect. If not, they're just persecuting Christians. Oh, and also, orthodox Jews still follow the Torah teaching on sodomy as well. Somehow the gays never attack them or send affianced couples to their establishments to demand wedding services. . . .
