Former Attorney General and Federal Judge Mike Mukasey: End the Mueller Probe Now; It Was Illegitimate and Partisan From Its Still-Secret Origins

Recall that the investigation was begun to learn whether the Trump campaign had gotten help unlawfully from Russia. Justice Department regulations permit appointment of a special counsel only if (i) there is reason to think that a federal crime has been committed, and (ii) investigating it would present a conflict of interest for the Justice Department or there is another overriding public reason to take the investigation outside DOJ.
Because Attorney General Jeff Sessions had worked on the Trump campaign, he recused himself from the matter, and so the deputy -- Rod Rosenstein --took the decision to appoint a special counsel. The regulations require that such an appointment recite the facts justifying the conclusion that a federal crime was committed, and specify the crime. However, the initial appointment of Robert Mueller did neither, referring instead to a national security investigation that a special counsel has no authority to pursue.
Although Rosenstein apparently tried to correct his mistake in a new appointment memo, he has thus far refused to publicly disclose a complete copy of it. In other investigations supposedly implicating a president -- Watergate and Whitewater come to mind -- we were told what the crime was and what facts justified the investigation. Not here.

47 "They" get around all of that by claiming it is a national security issue not a criminal charge. This makes spying on the president reasonable since the president is suspected of being a traitor and you can't inform the traitor or his allies that you are investigating him.

Nothing can be made public either. The effect is the president is smeared with the label of traitor and there is nothing he can do to prove otherwise.

No, not too much to ask.

However, if you want the rule of law, you have to suck it up and let the gears of justice grind, at least until they grind completely to a halt.

Then, and only then, do other remedies become viable long-term solutions.

I think this is basically our last shot at those "other remedies.

I don't like the pace any more than you do, I think. But I'm willing (if not eager and happy) to let it play out a while longer.

The moment of truth IMHO is the mid-term election in November. Democrats win back Congress and it's over, and it's on.

Republicans hold (and non-GOPe's increase their numbers) and the Republic still has a chance.

I expect historic levels of vote fraud by the D's this November.

We live in perilous times.

Jared Walczak of the Tax Foundation noted in a paper earlier this year that case law and IRS regulations “generally require charitable intent for a contribution to be deductible,” which means the person doesn’t receive a substantial benefit. In the current work-arounds, the only point is to lower tax liability. The politicians in Sacramento and Albany are not charities. A victims' fund would be more appropriate.

Treasury says the rules “will make clear that the requirements of the Internal Revenue Code, informed by substance-over-form principles, govern the federal income tax treatment of such transfers.”

But how? If Trump fires Mueller, there are going to be immediate shrieking claims that Trump obstructed justice. And not just by the media or Democrats, but also some Republicans. Republican Senators and Representatives.

Sessions recused himself and shows no signs of reasserting his authority. Rosenstein looks like he's part of the gang that wants to get Trump. Even if not, he gives no indication of thinking he should put an end to all this. Mueller won't resign or otherwise end this thing anytime soon.

So, who's left that can end this? Congress. They wouldn't even have to force an end. They could just do one of those Sense of the House / Senate Resolution things that they think the investigation should end. That would be enough to give Trump cover to fire Mueller or at least give him a deadline to wrap things up.

But, I don't think such a resolution would get through the Senate. Perhaps the House, but I wouldn't even bet on that.

So, it will play out. Mueller will keep spinning his wheels for not much of anything and the IG/DOJ investigations will slowly grind out some real indictments. People keep saying nobody in the deep state will pay, but I think that's wrong. Some people thought to be untouchable will be going to prison. It happened to Nixon's men, and it will happen to Obama's crew.

284 So, who's left that can end this? Congress. They wouldn't even have to force an end. They could just do one of those Sense of the House / Senate Resolution things that they think the investigation should end. That would be enough to give Trump cover to fire Mueller or at least give him a deadline to wrap things up.

But, I don't think such a resolution would get through the Senate. Perhaps the House, but I wouldn't even bet on that.

So, it will play out. Mueller will keep spinning his wheels for not much of anything and the IG/DOJ investigations will slowly grind out some real indictments. People keep saying nobody in the deep state will pay, but I think that's wrong. Some people thought to be untouchable will be going to prison. It happened to Nixon's men, and it will happen to Obama's crew.

The key here is to fire Rosenstein. He is obviously stonewalling Congressional oversight. Trump is on very firm footing to get rid of him.

Trump can then hand pick a successor who must necessarily review all of Mueller's work. He can also adjust the original mandate by specifying the crime as the law demands. Mueller will then have to put up or shut up.

Mueller is almost certainly playing this out for the grand prize, a raid on the Oval Office.

There was a story out of Dresden, Germany today about finding a large, unexploded WWII bomb. They evacuated a large number of people then tried to disarm the bomb by blowing the detonator off. This started a fire destroying even more property.

This reminded me of the 1984 incident in Philadelphia in which the police bombed radical black back-to-nature group MOVE which started a fire that burned out a neighborhood. At the time, we were told it was a mere smoke bomb that somehow misfired unexpectedly starting a fire. I looked it up today and find that they dropped two bombs designed to create a breach in their hillbilly fortifications to allow police entry. So were we being lied to back then, too?
