President Donald J. Trump can't block his critics from following his personal Twitter account, a federal judge ruled. The judge said the comment section of Trump’s personal account, @realDonaldTrump, is a public forum and that blocking users on the basis of political speech is a violation of their free-speech rights under the First Amendment.I'm pretty sure that Democrat officials have me blocked-- Senators like Claire McCaskill -- so, will this judge demand they hear my criticisms?
The judge declined to issue an order because she has no power to order an Article II executive to do anything. I hope Trump simply ignores her. Update:

"This case requires us to consider whether a public official may, consistent with the First Amendment, 'block' a person from his Twitter account in response to the political views that person has expressed, and whether the analysis differs because that public official is the President of the United States," Buchwald said. It's weird because I was just thinking yesterday that they may block Trump from Twitter or other social media outlets because he has been so successful in getting his word out around the media and they are angry little tyrants at this.
I thought it wouldn't happen because that would be yet another red line Americans would not support.
But then this happened. It's similar. Close. Inching towards stifling his tweets. This may be the "trigger" they are looking for. An excuse to ban him completely.

1) Newspapers that publish online, being public and run by public figures and nominally in the public interest (per how they're regulated), *must* have unmoderated comments sections.
2) Twitter, being a public forum, cannot ban anyone for speech alone, nor can they shadowban.
3) Twitter, being a public forum, must not manipulate "trending" hashtags and topics.
3) Congressmen must diligently check voicemail or add voicemail capacity. A full inbox is no excuse for closing out that particular "public forum."
4) No other elected or appointed-and-confirmed individual may block anyone from their Twitter feeds.
I look to the horde for more. Opportunity to turn this into a major blow against the speech controllers, should it stand?

Haven't you noticed that these jerks can now go into any event, anywhere on a college campus or in town hall and start screaming, shouting, jump up on the stage and completely disrupt the entire event and no one does a single thing about it?
This shit started with Obama and his brownshirt OFA Marxists. They would go to every Tea Party event, space themselves out in the crowd and begin screaming, shouting , jumping up and down to where the crowd would try to move away from them so they could hear the speaker. And they would keep it up, hoping someone would dare punch one of them so they could get on TV and subsequently have the person arrested and then sued for assault.
I attended a Tea Party rally and had this exact thing happen with this asshole standing next to me screaming and shouting and scaring the little kids with their parents in front of me so they started crying.

A sufficiently industrious lawyer/plaintiff could, however, turn around and use the ruling to beat Twitter, Facebook et al severely about the head and shoulders for suppressing "political" opinions that "public officials" might otherwise see, if the suppression had not occurred.
The phrase "slippery slope" applies here I think.
And yes, it's a really, really stupid decision.

They could have just gone with the excuse that blocking people prevented their 1st Amendment right to petition for a redress of grievances, but this sets the ground work to go further and could apply to all public personages... meaning that potential no blue check mark individual can block anyone.
But the really big deal is that Twitter is a "public forum" where one has "1st Amendment rights" to speech including "political speech". Presumably this can be applied to other similar Internet "public forums" such as Facebook and Youtube.
If used strategically, these companies can be forced to not only allow, but not even discriminate based on one's politics, which is in stark contrast to their dishonest manipulation of information.

As it is now, they pick and choose those that represent their agenda. And finally, is the judge saying that no one can block anyone? That sure seems to be the case. She states that the decision wasn't based on Trump being the president. It was based on it being a public forum. So either Twitter is a "public" forum and no one can block anyone, or it's a private forum and this judge has not standing to set policy on a private business. Which is it?

Courts usually issue Opinions and Orders where the opinion lays out the issues, the laws, the reasoning and then...ta-da...the actual order. Without the order part it is just an opinion. No one has to do anything with it, not even read it. It has no legal weight behind it.
She even admitted as much:
The judge declined to issue an order forcing Trump to unblock the users, saying her ruling should be sufficient to force a change in behavior.
