Federal Judge Rules That Trump Cannot Block People From His Twitter Feed

We seem to have nothing but Hawaiian judges now.

President Donald J. Trump can't block his critics from following his personal Twitter account, a federal judge ruled.

The judge said the comment section of Trumpís personal account, @realDonaldTrump, is a public forum and that blocking users on the basis of political speech is a violation of their free-speech rights under the First Amendment.

I'm pretty sure that Democrat officials have me blocked-- Senators like Claire McCaskill -- so, will this judge demand they hear my criticisms?

...

"This case requires us to consider whether a public official may, consistent with the First Amendment, 'block' a person from his Twitter account in response to the political views that person has expressed, and whether the analysis differs because that public official is the President of the United States," Buchwald said. "The answer to both questions is no."

The judge declined to issue an order forcing Trump to unblock the users, saying her ruling should be sufficient to force a change in behavior.

The judge declined to issue an order because she has no power to order an Article II executive to do anything.

I hope Trump simply ignores her.

It's weird because I was just thinking yesterday that they may block Trump from Twitter or other social media outlets because he has been so successful in getting his word out around the media and they are angry little tyrants at this.

I thought it wouldn't happen because that would be yet another red line Americans would not support.

But then this happened. It's similar. Close. Inching towards stifling his tweets. This may be the "trigger" they are looking for. An excuse to ban him completely.

53 Oh, so much potential here. Just off the top of my head:
1) Newspapers that publish online, being public and run by public figures and nominally in the public interest (per how they're regulated), *must* have unmoderated comments sections.
2) Twitter, being a public forum, cannot ban anyone for speech alone, nor can they shadowban.
3) Twitter, being a public forum, must not manipulate "trending" hashtags and topics.
3) Congressmen must diligently check voicemail or add voicemail capacity. A full inbox is no excuse for closing out that particular "public forum."
4) No other elected or appointed-and-confirmed individual may block anyone from their Twitter feeds.

I look to the horde for more. Opportunity to turn this into a major blow against the speech controllers, should it stand?

Yeah, that is my wonder about the strategy of this. If Trump cannot block anyone then every tom dick and harry can post on his feed. If everything is allowed on his feed, it will become a thread of nothing but nonstop racism and illegal porn. People will block HIM. Therefore his ability to bypass the media and speak directly to the public will be compromised.

I'm sure there are tons more regulations they need to abide by, in all 57 states.

Haven't you noticed that these jerks can now go into any event, anywhere on a college campus or in town hall and start screaming, shouting, jump up on the stage and completely disrupt the entire event and no one does a single thing about it?

This shit started with Obama and his brownshirt OFA Marxists. They would go to every Tea Party event, space themselves out in the crowd and begin screaming, shouting , jumping up and down to where the crowd would try to move away from them so they could hear the speaker. And they would keep it up, hoping someone would dare punch one of them so they could get on TV and subsequently have the person arrested and then sued for assault.

I attended a Tea Party rally and had this exact thing happen with this asshole standing next to me screaming and shouting and scaring the little kids with their parents in front of me so they started crying.

378 This is a massive "own goal" for the Left.

They could have just gone with the excuse that blocking people prevented their 1st Amendment right to petition for a redress of grievances, but this sets the ground work to go further and could apply to all public personages... meaning that potential no blue check mark individual can block anyone.

But the really big deal is that Twitter is a "public forum" where one has "1st Amendment rights" to speech including "political speech". Presumably this can be applied to other similar Internet "public forums" such as Facebook and Youtube.

If used strategically, these companies can be forced to not only allow, but not even discriminate based on one's politics, which is in stark contrast to their dishonest manipulation of information.

438 This is nonsense. Yes, the official POTUS account, I can understand this ruling. But, for a personal account, this judge is 100% incorrect. She is circumventing the policy of a private business that is exercising First Amendment rights of the user.

Wouldn't this same ruling require the Editorial board of every single newspaper to accept and print every single letter to the editor? As it is now, they pick and choose those that represent their agenda. Since the NYT's accepts editorials from the likes of James Comey and Bill Clinton, wouldn't they now be obligated to accept my own personal entry as a guest Op-ed?

And finally, is the judge saying that no one can block anyone? That sure seems to be the case. She states that the decision wasn't based on Trump being the president. It was based on it being a public forum. So either Twitter is a "public" forum and no one can block anyone, or it's a private forum and this judge has not standing to set policy on a private business. Which is it?

537 Is this a Trump-only decision, or does this effect ALL government officials? I cannot see this standing up in court. Would Trump shutting down his Twitter instead of unblocking people be unconstitutional too?

538 80 So according to this judge, I can send Elizabeth Warren a dickpic via Twitter every day while imploring her admire my big medicine, and Liz just has to accept my super-valuable speech?

Can Twitter ban me for doing do without trampling my right to address Warren on Twitter?

Well, it depends. Which way does said, uh, member lean, politically speaking, of course?

It is from one of the greatest insults in all of cinema, and is from the movie "Billy Madison".

Here is the scene in question.

543 How exactly does congress go about impeaching judges?

Because I think it's past high time for that.
Posted by: What's a Seawolf?
---------

As Newtie has pointed out, it's much easier than that. The Congress just refuses to fund them.

544 "This may be the "trigger" they are looking for. An excuse to ban him completely."

-- If they do, he should sue that they can't ban him, just as he can't block people.

545 If she's on twitter I hope people tell her how idiotic her ruling is, if you can call that a legal ruling. His account is personal, it's not an open forum it's open to those he chooses to allow in. Again I think the judge is an idiot, and if she thinks she can order us to change his behavior she has another thing coming. Has our judicial system gone completely communist rogue?

546 I attended a Tea Party rally and had this exact thing happen with this
asshole standing next to me screaming and shouting and scaring the
little kids with their parents in front of me so they started crying.

That was assault on his part. I would have bum rushed him out of the event - thrown him in the street and told him he was barred from the premises, and that if he make any attempt to return I would have him arrested for criminal trespass.

547 Given this ruling, and that it is not possible for the government to feasibly spend the money to keep all sorts of things, like porn, racist speech, etc., out of their channels: Is the only responsible thing for government and government officials to do now is completely close down and shut down all social media? They can't police their comments any more, after all.

548 Hun, if Twitter is now a public form by judicial fiat, do they no longer have the right to censor conservatives as a private business?

549 I've seen posts on a gun forum that Gavin Newsom, left wing "progressive" candidate for California governor deletes questions and blocks people who ask them, if the question is clearly unfavorable to his left-wing crazy positions. So, maybe we should sue Gavin to stop him from blocking people from his page. Anyone think the 9th circuit court judges will rule the same same way?

Posted by: Guns Gardens and Yarn at May 23, 2018 04:37 PM (znV6x)

550 Ummm blocking is equivalent to not listening. There is no right to require one to listen. This judge should be impeached based upon incompetence. The only way to get the judiciary's opinion is to impeach a dozen or so of these political hacks.

552 If Trump can't block anyone because of 'Public Forum and 1st Amendment' I would think that also means that Twitter, Google, You Tube and Facebook can't censor anyone because 'Public Forum and 1st Amendment'.

Gosh, that might be pretty interesting.

553 Just because some else has free speech rights doesn't mean I have to listen to them or let them in my house. In the same way nobody has a "right" to force their opinion on me. Judge basically said Trump doesn't have the same rights as everybody else. Dumb Judge, dumb ruling.

You have made your ruling. Good luck enforcing it.

Especially since it is his personal twitter account. I might feel a bit different about @POTUS or similar.

The other aspect of this is that it seems to me that FedGov mail servers *must* allow spam, malware, and phishing emails. That seems...not right.
